Consumer Complaint: During XXXX I had a reduction of income in relation to starting a new business, launching a new law firm with another attorney. The first year of operations saw very little income, we may enough to pay our staff mostly. I inquired with Wells Fargo regarding refinancing options, XXXX etc. Wells Fargo stated that I could not be considered for any refinancing until I was in arrears in payments by at least 90 days. At the time of inquiry my payments were current. I allowed payments to become in arrears and was approved on 3 separate occasions for refinancing. Each time I returned the mail away closing documents as instructed and Wells Fargo declared the refinance invalid for various reasons each time. once they claimed a signature was missing, once a notary was missing and one of the packages was received and returned within 3 days and Wells Fargo claimed the documentation was not received timely. I looked back and Wells Fargo had included a required return date that predated my date of receipt of the closing package. Mind you, during this time I was a real estate closing attorney. All three refinance packages were completed and accurately completed on my end and doublechecked by myself and my staff. I strongly feel that Wells Fargo was misleading me during this process and sending refi docs for signature with built in false pretenses each time on a new reason to deny the acceptability of the loan packages after signature. The amounts I owed to keep the house from foreclosure continued to rise and eventually I had no choice but to succumb to the foreclosure. I recently requested a review and received a letter dated XXXX saying Wells Fargo does acknowledge an error may have occurred and enclosed a check of {$200.00}. I will not cash this check. Their misleading efforts resulted in foreclosure of my house and significant damage to credit for years, not to mention the social stigma and person anguish. I later moved to Alabama and began working as in-house counsel for a bank. I faced enhanced scrutiny from my new employer during the interview process regarding the foreclosure. Also when I applied for admittance to the State Bar of Alabama I faced enhanced scrutiny due to this foreclosure. I was required to appear personally at the state bar headquarters to explain this past history in great detail before they decided to admit me to the state bar. We visit and stay for at least one weekend a year with old friends in the same neighborhood where our house was foreclosed on by wells fargo and when i drive by I feel the sting and sadness and betrayal relating to that house and our experiences with wells fargo. That was the house we bought with our first real jobs and the house where we started our family.

Consumer Complaint: Back in XXXX, in the midst of the recession, both myself and my wife lost our jobs. We had a mortgage for the property at XXXX XXXX XXXX, XXXX, CA, XXXX, with XXXX XXXX ; after hearing about numerous programs to help with situations like ours, we contacted XXXX XXXX to get assistance with payments and try to get a loan modification. At the time, we had managed to stay up on our payments, but we wanted to be proactive because we were days ways from not being able to make our mortgage payments. Long story short, after being placed on a temporary new payment plan, at least three denials for modification, then finally, the modification went through in about XXXX. Since it had been years without making full mortgage payments, we were neglected to be told that we would need to back pay everything underpaid. This amounted to a large sum that was rolled back into the loan as part of the modification making our payment when it was all said and done HIGHER than it originally was. The mismanagement of our multi-year modification nightmare with next to no communication led to us finally getting foreclosed on in early XXXX since our income never recovered to what it was pre-recession, and our payment ended up being higher than before the modification. We experienced financial hardship, destroyed credit, and emotional distress through the entire, almost 5-year fiasco and since.

I am writing file a complaint with the Consumer Financial Protection Bureau ( CFPB ) regarding fraudulent hard inquiries on my credit profile. I kindly request your assistance in removing these inquiries immediately, as they have been reported inaccurately and obtained without my written permission or a permissible purpose, in violation of the Fair Credit Reporting Act ( FCRA ). The fraudulent inquiries mentioned above are in clear violation of the following laws : 1. 15 USC 1681b : This section of the FCRA requires that a consumer reporting agency may furnish a consumer report only when there is a permissible purpose. In this case, the inquiries were obtained without my written permission or a permissible purpose. 2. 15 USC 1681a : This section of the FCRA defines the terms used throughout the Act, including the definition of a consumer report. The fraudulent inquiries on my credit profile do not meet the criteria outlined in this section. 3. Section 611 - Accuracy of Information : This section of the FCRA requires that consumer reporting agencies maintain reasonable procedures to ensure the maximum possible accuracy of the information in consumer reports. The fraudulent inquiries on my credit profile are inaccurate and should not have been included. 4. Section 604f - Fraudulent Information : This section of the FCRA prohibits the inclusion of information on a consumer report that is known or should be known to be fraudulent. The fraudulent inquiries on my credit profile clearly fall under this provision. I have attempted to resolve this matter directly with the creditors involved, but they have been unresponsive and unwilling to address the fraudulent inquiries. Therefore, I kindly request your intervention to ensure that my credit profile is accurately represented and that these fraudulent inquiries are promptly removed. I have attached a copy of my Federal Trade Commission Identity theft report and a copy of the inquires on my credit report highlighted. These inquires fall under identity theft and the continuous reporting of them is violating multiple laws as mentioned above. I appreciate your attention to this matter and look forward to a prompt resolution. If necessary, I am prepared to take legal action to protect my rights under the FCRA. However, I would prefer to resolve this matter amicably through your assistance. Thank you for your time and consideration.
