Consumer Complaint: Last year I refinanced my mortgage with the bank that was servicing it M & T Bank. M & T Bank had bought the servicing from XXXX. I was very careful to make sure the new account number got on the Bill Pay I use from my XXXX XXXX checking account. M & T claimed they did n't receive the very first payment after I refinanced. After many calls and submission of payment information I ended up in a XXXX way call with XXXX XXXX and M & T before M & T went back and found the problem. I was told the payment somehow got posted to an internal M & T checking account instead of my mortgage, which is why they could n't find it since they were only looking at the mortgage accounts. This has happened XXXX times in a row now. The way I have fixed it the last XXXX times was to call the lady at M & T who solved the problem the XXXX time. They are after me again for a payment I have already made calling me on a Saturday at XXXX. My fear is if I lose my contact at M & T ( the lady who cleared it up the first time ) I will have to deal with incompetent people who have no clue. It 's in my account record what has happened in the past. Does n't it seem logical that they, number 1 fix the problem so it ca n't happen again and 2 if it does happen again, check to see if the error just might be on their end?

Consumer Complaint: I have a home loan with M & t bank. I 've never been late. Even now. Part of my loan had a requirement that I open an M & T bank account and the loan payment is pulled from there into the loan. For XXXX yrs I 've had an automated transaction from my XXXX XXXX account to move {$580.00} into my M & T account. The loan payment is about {$570.00}. I always check my digital email receipt of the wells transaction and my physical loan mailing update to make sure all is ok. A week ago, M & T calls me to tell me I have overdraft charges. I assumed my automatic transfer of {$580.00} from XXXX XXXX to M & T failed. But it worked and my loan was paid up to date. I asked " how do I have an overdraft then? ". Them " well you did n't pay the fee '' Me. " what fee? Basically, they created a {$15.00} " under {$500.00} '' fee on my account that I was required to have. They may have sent snail mail to me but I have a XXXX ratio of junk mail from them so I only read my mortgage mail. My mortgage was up to date. I had been paying {$2.00} more a month and they took the fee out of that. When that was all taken they gave me an overdraft of {$80.00}. They say they ca n't refund it and I owe them {$5.00}. They " changed '' aka fixed my account so I is only for transfers but they ca n't " undo '' {$80.00} fee. Working with databases and CC transactions I know that is a complete lie and it 's just a rule to screw over customers. I have never been late. I want my money back. I was paying them on time for XXXX years. They make a profit off that. They charged me a fee on an account that I was required to have ( profit on profit without extra work on their side ). They did n't properly alert me to the fee ( not thru email possibly hidden in junk snail mail offers ). They took my money and then fined me for the unpaid fee that I was n't alerted about on a required account for a profitable transaction. Again, I have never been late. I have never used that account for anything other than my loan transfer. What can I do? They said a manager would call me back after they called back and told me my request was " declined ''.

Consumer Complaint: Due to losing my job we have had to apply for a customer workout to try and keep our home. Having never to go through this before, I filled out the paperwork and on the paperwork it indicated approximate and verified. I did not fill out the verified amount because I sent in all our bank statements. I thought the bank will verify the actual total. We were given a ridicously amount to payback, I spoke with their representitive XXXX ID XXXX and was told that is the amount we need to pay to keep our home. I asked how is it possible for a family of XXXX to live on {$500.00} left over a month. I said I can not even buy food for that amount. He said I did not list spending any money for food. I advised that I thought they would verify the amount from our bank statements and he said no. I said isnt that a little ridicously to believe that a family of XXXX would not spend money on food? He said no for all he knows we grow our own food. I said that is far fetched he said its my fault I did not feel out the verify amounts. I am furious that I have been calling and calling to give all information needed and have been trying to get this resolved to no avail. M and T received XXXX XXXX in tax bailout money and they will not help with an FHA loan.

Consumer Complaint: I sold a property in XXXX NY mortgaged by M & T Bank. The proceeds did not pay off the loan, {$4100.00} short although this was not a short sale, the sale closed XXXX. I tried negotiating with the bank to re-fi the amount owed, they would not help. I was able to pay them off in XX/XX/XXXX by then the amount was {$8200.00}. I was charged for {$3000.00} for property insurance and county and city taxes although I did not own the property, the new owner was on title. The taxes were paid for the new owner, double paid. I had to pay the entire amount as the property was already taken to foreclosure and the new owner would have filed a law suit against me, my attorney and real estate agent.

Consumer Complaint: I was in the process of getting a mortgage modification with M & T bank. The modification agreement had been approved and the papers were sent to me for signature. The transmittal letter advised that I consult an attorney before signing the agreement. After review the document, I hired an attorney to look it over. There were a few issues that I had with the document and my attorney contacted the underwriter! ) the property was owner occupied 2 ) the interest rate of 6.875 % has not been reduced. In other words the bank did not make any modifications at all. Subsequent to my attorney contacting the bank, all calls and correspondence were thereafter unanswered. I am still making the payments required, but the payments are not being credited, and each statement has charges added to my mortgage statement that are in dispute. Is there anyway you can get the bank to contact my attorney to resolve these issues.

Consumer Complaint: In XXXX 2010 I got a mortgage through M & T bank on a home thatneeded some repairs so I took extra money out to do repairs thebank told me it would make my loan go faster if I got a contractorsquote I asked them several times if I could still do the work myselfwith a contractors quote they told me yes well needless to say itdid not turn out that way after the closing I never received any of theextra money. I could not live in the home until these repairs wheredone and the bank knew this. XXXX years ago the bank tried toforeclose on me I got a lawyer and we went to court the judge toldM & T they had to redo my mortgage at the original purchase price. My lawyer sent M & T everything they needed to redo the loan. A month later my lawyer calls me and says M & T sent him a letterstating that they did n't get everything they needed but did not tellhim what we where missing when he called no one got back to him. Now I have to go through this again and I must say I 've had enoughM & T to this day has yet to send me a mortgage statement. Now theysold my mortgage to XXXX and I have called them and left messageand no one calls me back. I have e-mails from M & T about getting the extra money I borrowedI have XXXX that says they mailed my check out when I did n't receive itI called the lady and she told me that e-mail should of never went outif that 's the case why was it even typed up and sent. At this time I have no idea of where to turn. Although I am sure I shouldbe able to sue M & T for predatory lending.

Consumer Complaint: I acquired a vehicle loan in XX/XX/XXXX through XXXX car sales with M & T bank. Even though my interest was sort of high I wanted to have a chance to establish a better credit history than I had at the current time. My loan was for $ XXXXXXXX7.29 % interest. I started making my payments on time the XXXX few months. My payments were due on the XXXX of the month around XXXX I was making payments later than the due date but I called every time to talk to a representative and asked what my payment was and if I owed any late fees. I was told that my payment is {$530.00} which is my monthly payment and that I had no late fees because of the grace period. I got a bill XX/XX/XXXX stating that I owe {$320.00} in late fees. I called them and was told that since I did n't ask about the how much late fees when I called to make the payment they do n't have to tell me. I was also told that I needed to read the bill and not depend on the customer service for information pertain to my bill even though I asked every time to ensure that I was squared away. I was also told that if I did n't catch that I owed {$320.00} then it would have kept rolling over until the end of the loan then I would have owed a crazy amount to them in late fees. My point is when I asked I was told different and if I was reading my bill and not understanding then I cant depend on them because its not their responsibility to help me understand or inform me after I asked them the question. After I talked to XXXX person I called back to get the number so that I can make a formal complaint and I feel like the person on the phone was very disrespectful and was not concerned with the issue that I was having. Not once did any of the representatives ask if how we could fix the problem or what could they do to help. All they did was point the finger at me and I am definitely pointing my finger at them because I believe as a customer trying to keep up my end of the deal I am being wronged and taken advantage of. This is the only service that I know that handles business this way.

Consumer Complaint: I have a mortgage held by M & T Bank XXXX XXXX, N.Y. The loan is FHA. I 've been making payments for 5 years - not a single late payment. Due to an increase in home values in California over the last five years, my LTV is now much less than the 76 % threshold needed to cancel private mortgage insurance. M & T says it wo n't accept an appraisal to verify the current home value and therefore wo n't cancel PMI until the outstanding loan reaches the 76 % ratio solely through principal reductions to the original loan balance This is absurd, given that I could refinance ( but do n't want to ) and a new loan would be based on the home 's appraised value. This practice seems patently unfair. If however, this is law, as they state, then the law needs changing.

Consumer Complaint: I wish to raise an official complaint in respect to the treatment of my mortgage account with XXXX XXXX XXXX ( XXXX ) on the basis that I do not believe that I have been treated fairly. When I was on a XXXX Leave of Absence XXXX placed me on an unemployment deferment and stated that once my employment resumed that the options were deferment where I would put earnest money down to show good faith and then make payments that would pay off the arrearages over time but there was no formal process for this other than them asking a few questions. I answered the questions and was constantly deferred to the loan modification program which was not the program that I wanted to place in having recently being a recipient of the HAMP modification program. I did not have a single Point of Contact ( POC ) and even when a POC was assigned to my file it was an arduous task getting in touch with them, often times leaving numerous voicemails calls would not be returned for an inordinate period of time. Although XXXX was part of the National Mortgage Settlement it appears that they attempt to misguide customers that are in financial duress in a process that may be easiest for them to manage which in most instances in not in the best interests of the customer. Fast forward in numerous telephone conversations with XXXX I stated verbally that I would like to get a deferment and pay the arrearages over time. Comes now, XXXX denied having such communications on file to substantiate my request. Although during that time I was told to make an earnest money deposit for a deferment which I did in the amount of {$4000.00} on XXXX XXXX, 2014 which was later returned to my financial institution on XXXX XXXX, 2014. I contacted XXXX Bank to find out what would be a reasonable amount for my deferment on XXXX XXXX, 2014 and was able to get the support of my family and submitted a payment in the amount of {$7000.00}. XXXX in turn cashed my payment of {$7000.00} more importantly when I ask them to trace the check that was returned on XXXX XXXX they were made aware once more for my request for deferment. XXXX representatives sadly mislead me into believing that my request for deferment was being processed. It was my understanding on the basis of submitting an earnest money deposit and XXXX cashing that payment in the amount of {$7000.00} that I would be entered into a deferment program so I could keep my HAMP loan modification and have the removal of late fees that were incurred on my account as per my numerous requests. I have been mislead by XXXX Bank and do not believe they meet the National Mortgage Settlement guidelines of needing to be clear, fair and not misleading. I have also been advised of case law which supports the requirement for important conditions to be made clear and obvious in work out options to include deferments. That was definitely not the case in the mortgage documentation which was issued to me or in any communications from XXXX. XXXX sadly literally bullied me into another loan modification under the XXXX XXXX XXXX XXXX even though to my understanding I qualified for the HAMP Program. Nonetheless, I lost the terms of my HAMP loan modification under my initial agreement and my payment increased because XXXX rolled in ancillary fees to include late fees which I requested a removal of due to documented hardship. XXXX XXXX XXXX, XXXX XXXX XXXX did alert me telephonically that she did see communications for my request for deferment and she wished she could help but advised me that a modification would be the only way to save my home as XXXX denied any communications and she apologized for me being misled.
