Consumer Complaint: XXXX XXXX here, I am new customer to M & T ( end of XXXX ) and I was offended to see when I first looked at my statements from XXXX and XXXX that I have been charged over {$120.00} in ATM fees. I understand that account sometimes had fees but I had no idea that M & T would charge me {$3.00} per transaction just to check a balance?! I was charged {$3.00} approximately XXXX times in XXXX months to check my balance from other ATMS!? I was told at XXXX XXXX NY branch that " I thought they stopped that ''. I was charged to check my balance also! I feel as if I am being targeted due to my low income.

Consumer Complaint: I have delinquent mortgage that is being serviced by M & T Bank ( " M & T '' ). M & T placed forced insurance on the underlying property. An insurance claim was filed by me and XXXX checks sent to me with certain specific instructions from M & T as to how the insurance funds would be disbursed ( i.e., M & T wanted a proposal from a contractor, a lien waiver from the contractor, a contractor 's license as well as a signature on teh XXXX checks and an endorsement to M & T of the checks ). All documentation M & T requested was forwarded to them with the XXXX endorsed checks ( XXXX check for $ {$990.00} and aonther for approximately {$5900.00} ). Funds were expended by me for the repairs in order to protect the property ( a rof that leaked very badly and thast was causing additional dmage to the subject property ) and reliance on M & T 's representation that a " reimbursement '' would be forthcoming. After the checks were endorsed to M & T ( each check was written to both myself and M & T ) and forwarded to M & T they refused to pay the claim, notwithstanding significant documentation sent from M & T to me indicating that the insurance would be applied toward the claim if certain procedures were followed, which I did follow. As a second part to M & T acting in bad faith, they separately provide ( not in insurance documentation ) a letter on their letterhead ( not part of the forced insurance ) called an '' Acknowlegment of Term '' and thereafter indicated to me because I signed said document, and that because the insurance was paid by them and the loan was seriously delinquent and/or in foreclosure that " M & T could apply any and all insurance proceeds related to the subject property to the delinquent mortgage, as they saw fit. I indicated to M & T that I did not sign an " acknowledgment of terms '' upon which they used that fact to deny reimbursement to me for the insurance claim. Thereafter, a manager at M & T ( XXXX XXXX ) was put on the call where I informed him that the phone call, which he was recording, was going to be used for purposes of litigation, as well as several prior calls where M & Tindicated that they " did not have to pay over the endorsed insurance checks under any circumstance '', again, " since the property was in foreclosure ''. I thereafter indicated to M & T that I was filing a complaint with the CFPB and that I was an attorney and was filing a lawsuit against them and that this issue was ripe for a class action. I find it highly likely that M & T is doing that to many borrowers in default and are doing so in contravention to the documentation being sent to the consumer, XXXX various " red herring '' excuses not to pay over the claim but to apply the insurance funds toward the delinquent mortgage.

Consumer Complaint: My mortgage was bought out by M & T Bank XXXX XXXX XXXX XXXX, NY XXXX. I pay my payment through bill pay and it is set up to be delivered to M & T Bank by a certain date. If it arrives XX/XX/XXXX or after they will charge me a late fee according to their statement. They have gotten my payment before XX/XX/XXXX and charged me a late fee on several occasions. I brought this to their attention and they have failed to refund the fees for all of the times they have charged me a late fee when it was n't late, according to their terms. It happens often that they charge the fee regardless. I usually pay my payment between XX/XX/XXXX and XX/XX/XXXX the first years they had the contract, but now since they have been charging me a late fee regardless, and I ca n't get them to stop, I just pay it reluctantly with the late fee as part of my monthly payment.

Consumer Complaint: Found RV ( motorhome ) on XXXX interested in purchasing. Contact seller. Seller sends e-mail back with requested info. Seller indicated transaction to take place via XXXX motors. I receive invoice and am told to call XXXX XXXX number on invoice for wire instructions. I wire {$7800.00} from my account at XXXX XXXX XXXX to " EBPA '' account held at XXXX and XXXX XXXX XXXX Payment confirmation and shipping information received from " XXXX XXXX '' When the motorhome did not show up as indicated I called " XXXX XXXX '' to get after hours voicemail. Contact again on XXXX/XXXX/15 however, phone # does not dial, no ringtone, no voicmail. So I go to main XXXX page for anothe contact #. I call XXXX and give them the tracking number from my invoice only to be told that they did not have that invoice on file and there was no such tracking # in their system. I immediately hand up and contact my wire and initiate a " wire recall due to fraud ''. M & T bank is notified on XX/XX/XXXX & XX/XX/XXXX. I was told to call on XX/XX/XXXX for status. XXXX had rec 'd no response from M & T. Called again on XXXX told same thing. Decided I was not going to wait and that I would start contacting M & T directly. Was finally able to get an online teller @ M & T to convey the fraudulent activity to their Sec. Ops Dept. ( They would not speak w/ me directly as I was not their account holder. Told her that I had contacted Banking Commisssion ( which I had ) & that I was quite confident SOMEONE in their security dept would want to know that there bank was being used to perpetuate FRAUD & LARCENY. At that point she put me on hold for quite a while and then came back and took my information. I gave her the $ amount, the recipient Name and account number. I was put on hold again for a lengthy time. When she returned she indicated that although she could not divulge any details to me that the account had been flagged as being used for fraudulent activity and a HOLD was placed on it. Further I was told to " PUSH the issue '' with my bank and that my bank ( XXXX ) must submit a Hold Harmless Agreement. ( Having worked in banking for many years I then used M & Ts automated system along with the recipients info that I DID HAVE and did a " Check Verification '' for the amount of {$7800.00}. The system DID indicate the account was still with M & T and their were funds available to cover a {$7800.00} check. This was on XXXX/XXXX/15 at approximately XXXX XXXX. ) I then contacted XXXX again, spoke with XXXX in the " Escalated wire services dept. ) who indicated to me exactly when the SWIFT requests were sent to M & T and specifically what they said. Both indicated to return the money as it was fraudulent activity. She also stated that XXXX would not just send out the HH agrmt that M & T must request it via responding to the XXXX requests. I then phoned M & T to state they must request HH agrmt request via original XXXX request sent to them either on XX/XX/XXXX or XX/XX/XXXX. She then consults someone from " our lawyer room '' and was told they did not know what a SWIFT request was and they they would only respond to a " Service Request ''. During the time I was doing this a message was sent to my local XXXX branch stating " account holder no longer with bank, sender to contact them directly ''. The next morning my local branch rep called to tell me the response. I told her I had personally been in touch w/ M & T the day before and was told the account was put on hold. I also told her that this response was unacceptable and that I wanted to be contacted by someone from XXXX 's wire department that had authority to take some action. I hung up with her and then used M & T 's automated system again, ( XXXX/XXXX/15 @ XXXX a.m. ) and did another 'check verification ' for {$7800.00}. System indicates there are funds to cover that amount. I never heard back from anyone at XXXX, as requested. I also did it again just now on XXXX @ XXXX.

Consumer Complaint: I was granted HAMP XXXX mortgage modification by XXXX XXXX in XXXX of 2014. I have made XXXX trial payments plus have continued with the payments. XXXX XXXX can not finalize the agreement because M & T Bank will not subordinate the home equity line they hold. M & T claims their interest is not covered because of the property value. They said they will do another valuation, however the period to resolve this issue with XXXX XXXX has expired and they have put my property back in active foreclosure status. M & T has thus jeopardied over XXXX months of negotiations to reach an agreement and will force a new application for relief to be made or worse. M & T Loan XXXX

Consumer Complaint: I recently received a letter with a refund check from M & T bank. It said " On XXXX XXXX, XXXX, the Consumer Financial protection bureau published an order related to certain M & T free checking and totally free checking account open between XXXX/XXXX/XXXX and XXXX/XXXX/XXXX. '' And based on the order, I was eligible for a refund of {$56.00}. But {$41.00} has been applied against the overdrawn balance currently outstanding on the account. BTW, this account was closed in XX/XX/XXXX and I was n't aware of overdraft status. Based on a phone call with a bank representative, this overdraft status was resulted by the charges that the bank was order to refund me ( there was {$14.00} charged four times ) and the account was n't closed properly. I feel that it is unfair that they charged me with unfair charges to begin with, then took the refund away from me due to the overdraft charges resulted by these charges. I called them and they deny any of their wrongdoing.

Consumer Complaint: My Loan was transferred from XXXX XXXX XXXX XXXX M & T bank on XXXX/XXXX/2013 after never missing a payment but we had applied for Modification and they did n't tell M & T, I had perfect credit or M & T would not have bought the loan. We sent the first payment in XX/XX/XXXX from my billpayer company at my bank. Which I have the check and the statement proving it cleared. They have reported the payment as a bounced check and ruined my credit. I have a letter from them stating XXXX took the money from them. Because of XXXX mix up. Does a bank get to lie about you make up lies about your payment charge you thousands in fees and ruin your credit due to an error in paperwork between the to banks. I am XXXX and being bullied by this bank Is there anyway you can help??

Consumer Complaint: Vehicle Loan ComplaintOn the XX/XX/XXXX, I made a payment on my loan in the sum of {$340.00}. Then from XX/XX/XXXX to XX/XX/XXXX I made subsequent monthly payments of {$350.00} without any trouble ( or so I thought ) until I got a letter from M & T bank stating that " As of the date of this letter, we have not received the payment on your account. '' That I owed the bank {$280.00}. The bank has also charged me a late fee of {$14.00}. I could not believe what I was reading. I always make sure I pay my car note before the due date and I always make payments at the branch so what was the matter? I went to the bank and demanded to know what was going on only to be told by the bank officials that the check I issued for my XXXX payment for {$340.00} went missing and could not be traced since XX/XX/XXXX and therefore I should issue a check for {$280.00} to make up for the amount of the missing check. My question is, assuming that the check went missing since XX/XX/XXXX why wait till XX/XX/XXXX. Why is the bank telling now? If the bank had made me aware as soon as they realized the check was missing in XX/XX/XXXX, I could have issued a replacement check in XX/XX/XXXX for the payment. The bank for some reason decided not to inform me until now. My next question is, why is the bank demanding that I make both my current payment and the payment for the missing check by XX/XX/XXXX or else ....? I think that for the bank to demand that I pay a total sum of {$640.00} by XX/XX/XXXX without any negotiations is very harsh and unfair. My other question is if really I have fallen behind in making monthly payments, why is the bank asking for {$280.00} and not {$340.00} which is the regular monthly amount? Again why is the bank charging me a late fee? A few days later I received my regular monthly statement. My account transaction activity showed that on XX/XX/XXXX all the payments I had made from XX/XX/XXXX to XX/XX/XXXX were described as payment reversals. Then the same statement shows that payments were applied to my account from XX/XX/XXXX till XX/XX/XXXX. I also called the bank on XXXX and talked to XXXX different representatives who did not seem to understand my complaints. Since this matter is not entirely my fault, I think that in all fairness, the bank needs to agree for me to pay off the said {$280.00} in instalment. I can pay an extra {$30.00} monthly to bring the account current. I hope this matter is investigated and settled amicable. Your prompt attention to this matter will be greatly appreciated. Please find enclosed copies of the said letter and monthly statement account. Thank you

Consumer Complaint: On XX/XX/XXXX our mortgage was transferred by XXXX XXXX XXXX M & T Bank/XXXX. Since that date, I have made every payment on my mortgage. I have not received a statement from either entity acknowledging my payments or telling me how the money was allocated. I did get an incorrect statement from M & T in XXXX, with a corrected statement regarding what I had paid in interest and property taxes that actually indicated what my mortgage balance was. I applied for mortgage modification last XXXX and made the indicated trial payments on time. When I got the information for modification, there was NO reduction of the 6.375 % interest rate, simply the offer of a new 40 year mortgage. This was not at all satisfactory and our bankruptcy attorney said to not return the document. ( we filed for Chapter XXXX bankruptcy XX/XX/XXXX ) I have received several calls from XXXX re. the modification and told each person it would not be signed or returned XXXX weeks ago I had a letter from XXXX telling me that the modification had been denied since it had not been returned on time. This letter also said we had been " conditionally approved for the following liquidation options : Sell the Property, Short sale or Deed in Lieu of Foreclosure. It also indicated that if I did not complete a list of documents within 37 days, foreclosure proceedings would be taken. I am NOT behind in my payments nor have I missed any. I do NOT know where I stand with my mortgage and I now feel very threatenedby what these XXXX entities have done and not done. This has seriously affected my health because my XXXX had to increase my XXXX XXXX meds. I have formally send requests to both entities to send me complete accounting of my account - they have ignored the request. I need help. I do have documentation of times of phone calls and can make copies of all paperwork that I have received. Thank you for your help What I want is a reduction of my interest rate and I want a full accounting of every bit of money I have paid them and a stopping of letters that threaten foreclosure.
