Consumer Complaint: In XX/XX/XXXX we had tried to sell our house on our own but it was not worth what we owed. We have a first mortgage through M & T Bank and a XXXX with XXXX. SO we hired an agent and began trying to short sale our home. M & T said we were not past due so they could n't help us until we were. They made us go through a long XXXX month process to try and do a loan modification prior to allowing us to short sale. We needed to relocate due to how far our work is so we did not want a loan modification, we wanted to sell and relocate. So after about XXXX months it got to the next stage of moving to Short Sale. They APPROVED it to go to short sale. After doing everything they advised they finally APPROVED the short sale in XXXX. So we have been negotiating with the XXXX mortgage to move to close. It is now XX/XX/XXXX XXXX XXXX year later XXXX and the negotiator on the file, XXXX, tells us that he reviewed the numbers and they are getting paid off so we DO NOT qualify for a short sale. After 1 year of ruining our credit and doing what they advise and them APPROVING us for short sale etc.. XX/XX/XXXX they advised us we do n't qualify now and they send us a letter stating if we do n't respond by XX/XX/XXXX they will move to foreclose. So they tell us XX/XX/XXXX & only give us a few days to respond and we just got the letter XX/XX/XXXX. So we have XXXX day to respond or they foreclose. After all the XXXX they put us through and they dropped the ball. We could have been negotiating with the XXXX mortgage only and not ruined our credit if they had done their job. How did they not realize this when we started? before we went past due, before doing the loan modification and getting approved for a short sale. They have totally wasted our time and now they move to foreclose? This is horrible business practice!

Consumer Complaint: We have a mortgage with M & T Bank and we have been approved for a modification under the HAMP program ; We are grateful for that, however M & T Bank assigns the mortgage to XXXX XXXX XXXX XXXX, and XXXX becomes the servicer of the loan, albeit on a temporary basis. Our complaint is that M & T Bank, throughout the HAMP application process and subsequent to successful completion of the HAMP Trial Period Plan, continues to sendout letters and account statements reflecting not only inaccurate financial figures, but also a veritable " blizzard '' of mailings that hit us as very intimidating, alluding to potential foreclosure proceedings. Since M & T Bank has assigned the mortgage to XXXX, they are technically no longer the loan 's servicer, and should not be sending such mailings. After much angst caused by the intimidating mailings, calls to XXXX result in our being told to just ignore the M & T Bank mailings, despite that many of the mailings specify that we must respond in writing within a certain time period.

Ref : http : //www.consumerfinance.govFew weeks back I went to XXXX XXXX XXXX for review on the current refinance offer the representative told me that by looking at your loan and down payment the XXXX XXXX financial had made the serious error on your mortgage. Please remove PMI and refer all my payment its was simple bank error or misunderstanding of law as per XXXX XXXX XXXX Associate who just do mortgage this for leaving. The Condition on the PMI are LTV ( Loan to Value ) Ratio must be less than 78 % for automatic termination of MIP. On the day of closing we initially expected to pay 20 % but we have put the down payment of 30 % to eliminate the PMI as we have accelerated payment so as per the original appraisal the Value of the property was {$520000.00}. The sale price of the house was {$460000.00}. We have issue the check of 30 % hence it was old broker error who later sold the all wrong loan to M & T Bank. In case we did not received the refund within XXXX days we like to file the complaint at Consumer Financial Protection Bureau. We have open the ticket and requested this over the phone and send message feature but no one are getting acknowledgement for error online and they have advise us to send the written notice so let us know as soon as you received the letter. Discontinuing Monthly Mortgage Insurance Premium Payments : Many homebuyers ask FHA if they can stop paying FHA monthly mortgage insurance premiums with their mortgages. FHA insures mortgages so that lenders will be encouraged to make more mortgages available for people. The FHA mortgage insurance agreement is between FHA and the mortgage company, so you must contact your mortgage company and ask them what they require to drop the insurance. Most mortgage companies will want you to have a substantial amount of equity in your home. If the periodic ( monthly ) mortgage insurance premiums are paid up for an FHA case before schedule ( i.e., accelerated payments were made and the unpaid principal balance is 78 % or less ), the month and year the last monthly insurance premium is assessed ( final bill date ) can be changed by the servicer or holder of the mortgage. However cancellation of the monthly premium can only be used for active risk-based cases that have a closing date after XXXX XXXX, XXXX and a case number assignment date before XXXX XXXX, XXXX and meet the eligibility requirements described in Mortgagee Letter XXXX ( with Attachment ). For mortgages with an FHA case number assignment date on or after XXXX XXXX, XXXX, the FHA insurance can be terminated by the servicer or holder if the mortgage is paid in full before the maturity date. When can I remove private mortgage ( PMI ) insurance from my loan? updated XXXX/XXXX/XXXXTo remove private mortgage insurance ( PMI ) that you pay on your mortgage loan, you must be up to date with your monthly payments. Consumer Complaint: My debit card was stolen from a restaurant/bar in XXXX and the suspect spent almost {$600.00} before I noticed and cancelled the card. Their purchases also caused my account to go negative. M & T credit the money back to me and now after their investigation they advised they are taking the money back out my account on XXXX. After. Multiple calls and associated they told me it was denied because suspects do n't usually steal cards and go use them at gas stations and car washes and XXXX XXXX Department store. I asked multiple times to speak to someone who could help me and there has to be some way I can fight this because if a proper investigation was done, it would show it was n't me using the card. I work hard for my income and am a single mother of twins. Taking this money from me was devestatipng enough to have to work with for the two weeks it took them to refund it and now to take it again is wrong. This is my hard earned money. I 've been a customer for years with that bank and have never been through this before. The fact that XXXX different reps just all said well it is what it is without any real help is not right. To say that the area where the card was used are places I have used before as a reason to deny is not acceptable. Of course when a card is stolen from the area you live in they 're going to use it at the same places. XXXX is not that big! The fact that I 've been in tears for two days and have had to repeat my story repeatedly to the different reps who all say the same thing " sorry claim was denied there 's nothing else to do '' is so demeaning. This money being taken means either my children wo n't eat or our rent will not get paid. I just do n't understand how a company that prides themself on customer service could treat me this way.

Consumer Complaint: As your office is aware, I am being sued by Wilmington Trust as Beneficiary for the XXXX XXXX XXXX Trust. HoweverXXXX XXXX does not allow for a Trustee to be a beneficiary and that is just the tip of the iceberg. Under XXXX XXXX XXXX XXXX Trust has specific criteria that must be met when a loan is sold into a particular trust. In this case, the alleged trust that the party claims my loan is tied to is in fact a XXXX Trust. It is the XXXX Trust. XXXX XXXX XXXX : XXXX XXXX XXXX and XXXX XXXX. Matter of fact, XXXX XXXX XXXX informed me over the phone in New York that they are now what XXXX XXXX use to be. Hearsay or not, that was the conversation from their trust department on a recorded line. Therefore, can you please have Wilmington Trust XXXX NOT M & T BANK, who continues to answer on behalf of the XXXX, WT in this case ) respond on whether or not they signed the XXXX XXXX Settlement agreement in which XXXX was given a XXXX XXXX DOLLAR NON RECOURSE LOAN and various trustees were settled with by and through acceptance as an accepting trustee? It appears that XXXX is settling with themselves! ~ HMMM! Interesting and all at the tax payers expense. REMEMBER THE BAIL OUT in which most homeowners received a whopping {$300.00} for all the fraud by and through their mortgage contracts, just so it could all go back into the economy. There has been no real settlements for the homeowners, only the big banks and their friends and families and buddy entities. Just look at their profits. The attorney firm negotiating this settlement had negotiations for the homeowner to the tune of {$4.00} XXXX dollars in relief for issues that had occurred through deceptive and fraudulent actions, none of which I have recognized, as I have been targeted and biased against because I sued XXXX XXXX, which is my opinion, which I believe to be absolutely true. It is evident that they despise me and vice versa. Since it has recently been brought to my attention in the state XXXX that there has been a particular deal made by and through XXXX XXXX with a homeowner in this state that has received a $ XXXX reduction on their loan and 2.5 % interest rate and if they default in the next THREE YEARS, all will go back to past status, which the $ XXXX deal will be off. ( ALL BETS OFF ). Funny, why three years? Could it be because that is when the NEXT huge catastrophe will happen and in the meantime the bank XXXX XXXX XXXX can profit through hedging/betting against their own deal? How great it would be to bring this sort of proof to the court, which may or may not happen at this point in time. To be determined still. So for clarity I am asking that Wilmington Trust state whether or not they accepted the XXXX Settlement Agreement by and through XXXX. Also, has the loan been pledged to the federal government? RE : CONSUMER RELIEF : Under the Consumer Relief Settlement XXXX is required to provide {$4.00} XXXX of Consumer Relief to distressed borrowers within essentially a 4-year period, commencing XXXX XXXX, XXXX and ending XXXX XXXX, XXXX. It is only XXXX XXXX, XXXX and there is no doubt that wrong doing and deception and huge misrepresentations were proffered upon me and my family. Afterall, just look at XXXX with relation to my loan for starters. That is just the beginning. Did XXXX XXXX sell my loan in XXXX to one of the biggest portfolio buyers XXXX who just disappeared. They disappear with the money now do n't they? Although this complaint is geared toward the Plaintiff at this time, XXXX XXXX is the absolute deceiver here and they are simply using Wilmington Trust name to steal the property after they already sold it and got paid. They do this after the fact by and through corrective deeds. Afterall, why would a corrective deed be necessary if all was truthful and forthright at time of foreclosure?

Consumer Complaint: I lost my home of 25+ years to a preditory lender. Granted I was behind in my payments, I was on XXXX with my company at the time. I took out money from my XXXX ( k ) at one point to catch up. When I called to tell them I wanted to pay on my account I was told that I could n't pay my lender any longer and they referred me to a Mortgaging Services Company ~ the representative from this company told me that she would send me paperwork to fill out, when I told her I just wanted to " catch up my account '' I was told that I no longer could, that I needed to apply for the HAMP (? not sure ) Program that was available for people like me that get behind. The home was my Marital home that I fought for when my ex husband and I split ... the plan was to make sure that I had a home to leave for my son, XXXX XXXX XXXX is XXXX and out of work. Unfortunately since losing his job of 10 years he has not been able to find another since he was XXXX in 2007! Trust me when I say discrimination against XXXX people is alive and well. We have seen it over & over in the last 8 years. Ok, back to the Mortgage Companies practices. She asked me " would n't you like to not only keep your home but lower your payment? '' So, I sent all necessary info EVERYTHING she asked for I sent, it was checked off and returned via XXXX XXXX. According to her I had to have everything to her ASAP, my deadline was insane. But she received it, I made sure I sent it " Direct Signature Required! '' So I knew when it was signed for ... well I waited and waited ... knowing my deadline for submission to be foreclosed was looming ahead ... So I began calling and getting her answering machine ...? Funny thing was when I finally did get her got her it was through My original Mortgage Company ... I called them and told them what was going on and the person I spoke to said " Hmmm, that does n't sound like " her name '' ... let me see if she 's available ... '' Now when they referred me to this " mortgage servicing company '' they acted as if it were a separate entity ~ they even alluded to it being in XXXX and not XXXX? Imagine my surprise when I discovered she was in the building? So when she came to the phone I asked her why I have n't heard back and she grabs my file and says that her Supervisor needed more information. Now my deadline is right around the corner. My question to her is " Why did n't you have these items on the original list, why are they even needed now? '' It was detailed information that seemed uneccesarry ~ like they just wanted me on a wild goose chase. As it turns out I get them the info requested and they send the Foreclosure over anyway. Keep in mind that this began with me trying to pay up with my Mortgage Company. Meanwhile I received a phone call from someone that I had spoken to months before in reference to a refinance and since I had him on the phone I asked him about what my Mortgage Co did ... he said that the red flag should have gone up as soon as MY Mortgage Co would not accept payment for my Mortgage ... that 's what they are there for, right? He said he wished he would have pushed a little more months before so that we could have saved my home. I DID come up with the money to save it and DID save it the first time ... or so I thought ... the XXXX XXXX I borrowed was wasted because they claimed it was n't enough to save it ~ so my plan was to move back into it ... I had also had renters in it with an infant so I was a bit concerned about them ... well, rest of the story, long story short ... they moved out ~ the place was infested with termites I was told it would be thousands to fix it so I stayed where I am. Thousands later and I lose my family home anyway ... it still breaks my heart. Banks should not have the capabilities to be able to do this sort of thing. I was n't a living, breathing person to them ~ I was only the $ $ that they saw ... crooks ... my son loses. Again.

Consumer Complaint: To whom it may concern I am contacting your organization to file a complaint against The M & T mortgage Bank. Since I have become unemployed, I have been struggling to keep up with my mortgage payments and have fallen behind on more than XXXX occasion but have been able to catch up. In XXXX of 2014, I had applied for the Keep Your Home California ( KYHC ) program for mortgage assistance and was approved for a {$14000.00} pay down in my principle, which was paid to M & T on XXXX XXXX, 2014. On XX/XX/XXXX after falling behind ( again ), I contacted M & T to make the XXXX payments due which should have put us up to date, when I was informed by XXXX XXXX XXXX that I was actually 4 months behind. Not knowing how this could have happened and upon further research by XXXX XXXX I was told that KYHC had contacted the bank " requesting '' that the money be returned. Upon hearing this, I contacted KYHC, to confirm this, but was told by that KYHC representative that they would never request the money be returned, and that once it was paid out they would not accept it back. With this information, I contacted XXXX, the woman supposedly in charge of our account ( XXXX XXXX ) after XXXX minutes of the conversation I was finally told that KYHC had not requested the money be returned, but that the bank had contacted the state of California, and arranged with a XXXX XXXX XXXX in XXXX to have the money refunded. All of this to take place without my knowledge or consent and on the XXXX of XXXX the amount of {$14000.00} was removed from my account and supposedly returned to California, although KYHC has no record of this Trans action-taking place. The banks actions had caused my account to go 4 months overdue. I was told that the Bank had sent me a contract that I need to sign ad return three times ( twice by XXXX and once by certified mail ) none of which I ever received. It became obvious to me that this was a blatant attempt on M & T bank to " force '' me into foreclosure. I had previously attempted to work with M & T bank to have my fixed interest rate ( which has been raised XXXX times to 6.875 % ) reduced sending them the required forms XXXX, only to be told that they required more documentation, and then to be bombarded with forms. I was finally offered a loan modification ( twice ) which consisted of lowering my principle and extending the life of the loan for three years which I declined, in writing and sent to a XXXX XXXX XXXX, although the bank said they never received it. It seems to me that M & T Bank has tried everything but what I would like them to do which is cut the interest rate. Now seeing as how I already have a signed contract, I have no intention of agreeing to or signing anything else, unless it has to do with lowering the interest rate I am currently being charged. I would also like the {$14000.00} located, and returned to my account, which will bring me current on my mortgage. Any assistance you can provide would be greatly appreciated.
