Consumer Complaint: I am a XXXX XXXX resident who works in XXXX XXXX. I have had both checkings and savings accounts with M & T Bank for several years. For the past several weeks, I have been experiencing issues using my checking account. I XXXX noticed this problem when attempting to purchase groceries at my local XXXX supermarket about a month or so ago. When I chose the credit option, my card was declined. I knew my account had more than enough money to cover my groceries, so I instinctively used the debit option, and the transaction approved. Every week since then, I have experienced the same issue, despite purchasing groceries every Friday at the same supermarket, around the same time of day for the past year. Last week, I went to purchase crabs for {$100.00} and once again, my card was declined under credit although I had the funds. I instead used another credit card. I called M & T Customer service who informed me that due to high fraud activity in the area, M & T would not allow credit transactions, and that I have to use debit because entering my PIN verifies my identity. The customer service agent could not confirm where the fraud was occurring or how long the bank would inhibit credit transactions. Recently, I treated my boyfriend to dinner at XXXX XXXX in XXXX. Our bill was {$180.00}. When I attempted to pay, the waiter informed me that my transaction kept showing an error and requested I used a different card. As you can probably imagine, this was extremely embarrassing. Once again, I resorted to using another credit card. Knowing I had the funds in my account to more than cover the bill for the meal, I called M & T Customer Service after leaving the restaurant. XXXX XXXX employee ID XXXX ) informed me that my card was declined due to fraud in the area. Once again, XXXX could not inform me where the fraud was occurring XXXX please note my transactions fail in both XXXX and XXXX XXXX XXXX and he could not confirm for how long or the monetary amount these transactions would be stopped for. XXXX also informed me that the next time I go out to eat, I should call M & T Bank and ask them to allow the transaction to go through. I informed XXXX that this is unacceptable and also asked him what I should do if my transactions fail when customer service is closed. He then suggested I take out cash or ask the company to do smaller transactions that cover the whole bill. I informed XXXX that this is ludicrous and that I do n't feel comfortable going to the ATM late at night or walking around with large amounts of cash. I asked XXXX if there is anything that could be done and he told me no. We ended the call. I then called my sister and mother, who stated they have been experiencing the same issues with M & T Bank. My sister suggested I contact the Attorney General. When I called M & T back and informed XXXX that I would be contacting the Attorney General, he no longer decided nothing could be done. He transferred me to his supervisor, who informed me she would place a " fraud exclusion '' on my account, which would now allow me to make purchases on my card without problems. I highly suspect that these issues are not truly fraud related or preventative. M & T never sent me notification that fraud was a concern and that I would only be able to use debit. Additionally, M & T used to allow my transactions to go through, and would email me about potential fraud relating to the completed transaction. I was fine with this approach. I do not agree with M & T stopping me from being able to use MY money that I work hard for in the manner that I please. M & T was recently in the news for charging erroneous overdraft fees to their consumers. It appears M & T is continuing unethical business practices towards consumers.

Consumer Complaint: I HAVE JUST REFINANCED A COMMERICAL PROPERTY THAT I PURCHASED TWELVE YEARS AGO. I HAD A MORTGAGE ON THIS PROPERTY WITH XXXX BANK, THEY LATER SOLD MY MORTGAGE TO M & T BANK. AT THE TIME M & T BANK PURCHASED MY MORTGAGE FROM XXXX BANK M & T BANK CHARGED MY MORTGAGE ACCOUNT WITH A TRANSFER FEE OF {$400.00}, WHICH I HAVE CONTESTED THIS CHARGE FROM THE DAY APPLIED TO MY ACCOUNT. ON XXXX/XXXX/2015 I REQUESTED A PAYOFF ON THIS LOAN, PER M & T BANKS INSTRUCTIONS I FAXED THE REQUEST FOR THE PAYOFF WITH MY SIGNITURE. I WAS ADVISED BY THEIR PAYOFF DEPARTMENT I WOULD RECEIVE THE PAYOFF AMOUNT WITHIN 24 HOURS AFTER RECEIVING MY FAX. AFTER FIVE BUSINESS DAYS AND XXXX LENGTHY CALL THEIR PAYOFF DEPARTMENT I RECIEVED THE PAYOFF FIGURES THAT I REQUESTED. ON XXXX/XXXX/2015 WHEN I CONTACTED M & T I WAS NOT AT ANY TIME DURING THIS FIVE DAY AFAIR THAT THERE WOULD BE ANY SPECIAL FEES. WHEN I MADE MY REQUEST ON XXXX/XXXX/2015 FOR THE PAYOFF I INFORMED THE BANK THAT I HAD A CLOSING AT XXXX XXXX/XXXX/2015. I DID NOT RECEIVE THE PAYOFF UNTIL XXXX PM XXXX/XXXX/2015 AT WHICH TIME IT DISCLOSED THE SPECIAL FEES THAT HAD BEEN APPLIED TO THE PAYOFF ON THIS LOAN. THE {$400.00} CHARGE THAT I HAD DISPUTED, A {$770.00} " 60 DAY NOTICE FEE?? ", {$290.00} RELEASE FEE, {$100.00} A PAYOFF LETTER FEE. THE TOTAL ADDITIONAL CHARGES FOR {$1400.00} I WAS FORCED INTO PAYING IF I WISHED TO CLOSE THIS LOAN I HAD NO OTHER OPTION. I HAVE BEEN PAYING M & TBANK 7.5 % WITHOUT THE OPTION TO REFINANCE WITH THEIR BANK. MY LOCAL BANK PROVIDE A XXXX XXXX RATE ON THE REFINANCE. MY ATTORNEY WHO IS IN HIS XXXX YEAR IN HIS PRACTICE, THE FINANCE OFFICER THAT PROVIDED THE LOAN HAD NEVER CLOSED A LOAN WITH SUCH UNRESONIBLE PAYOFF CHARGES. Consumer Complaint: My home loan was with XXXX XXXX XXXX and I went into a slow pay with them and started paper work with them at that point. I was told that they would not work with me at all and I was told to wait till I was 2 months behind and maybe said they may want to help.. They did not do anything for me. Then a few months later they sold my loan to M And T bank and they send me a letter telling me that I was now with them and to start making payments to them ASAP. I called to make my payments and they told me that I could not make anymore payments till we sent in a modification package to see if they could help me. They would not take my payments then I sent all the information everytime that they asked me and then told me my documents were not current so they asked for info again and again and again and always at the 30 day mark. I was sent back again and again and never got help. Then I spoke to XXXX XXXX and he informed me that we would not have to make a payment and we would be review again. Do n't worry everything should be fine. I then revcived a letter stating that I got turned down for the modification and that I was going to lose my house. I called the bank and tried to make payments but they said they could not take them I was only 3 months behind. They told me that I could not make the payments. They then told me to re-apply and they said that I would not get approved but to try anyway. Then I went to find someone to help me but after 1 month they came back with a forbearance and they said that the payments would be XXXX per month and that the agreement was for 6 months and after the agreement they would reconsider for a additional term. I made all the payments on time and XXXX XXXX 2015 was the last payment for the forbearance and I sent the payment but 5 days later they started a forclosure sale date of XXXX XXXX 2015 and told me that they did not have to reiview me again unless I sent info 30 days in advance. I never received a forbearance agreement from the bank and I never signed XXXX. I have been requesting Info from the bank since XXXX/XXXX/2015 to show a signed forbearance and the terms but to this date they have not complied with my request this is now over XXXX days. I also contacted the trustee quality loan services and requested them to respond to QWR and they did not comply. I just yesterday XXXX XXXX 2015 reinstated my mortgage in hopes that someone would help me. This bank is really a mess and if not for many hours of work I would have lost my home.

Consumer Complaint: I signed up to M and T auto draft on XXXX/XXXX/2015. The purpose of auto draft was for M and T to automatically draft my payments for my mortgage. M and T sent me an email thanking me for signing up for the service on XXXX/XXXX/2015. The email stated that I did not need to reply and I received no further correspondence in regards to the auto draft. All bill notices I receive from M and T indicate that if I am signed up for auto draft, the bill will be automatically paid. I have attached those emails. On XXXX/XXXX/2015 a letter was sent to me indicating that I could lose my home due to failure to make payments. I immediately contacted the bank after receiving the letter and made the payment of the phone. I wanted to dispute the late charges as I felt it was due to an M and T error/ miscommunication. I also wanted confirmation that it was not reported to the credit bureaus as the late payments were due to M and T not auto drafting. The person on the phone said they could not do that. I asked how I could follow up on that and the rep on the phone stated I could write a letter or go to a branch. I went into the branch at XXXX XXXX XXXX, XXXX NY XXXX on XXXX/XXXX/2015. In the branch I reviewed my concerns and made the above requests. This was escalated to the branch manager and they said they would look into it. I also asked to file a formal complaint and for documentation on M and T banks complaint procedure. The representatives stated that they could not provide this to me and that I could not file a complaint in person in the branch. I am at an absolute loss for what to do and I feel bullied by misinformation and apathy by M and T bank. They have a large amount of control over their customer 's lives and must be accountable for their actions. It is a simple case of an error that they made and they have done nothing to help fix it. I am requesting the fees to be waived, documentation that they did not contact any of the credit reporting agencies and for them to make filing a complaint easy so that issues can be identified and addressed. I would also like to be pointed in the direction of where I can locate my rights as a consumer when it comes to being able to file complaints with banking institutions. I have dealt with an unnecessary amount of anxiety over this issue with no assistance from the bank holding my mortgage.

Consumer Complaint: We have been scheduling our mortgage payment through our bank ( XXXX XXXX for scheduled payment prior to the due date each month. For XXXX out of the last XXXX months M & T has failed to cash our check in a timely manner and has blamed us for the late payment. They have charged us late fees and refused to remove them XXXX even when we have offered to take a picture of our XXXX account information showing the payment was debited from our account in timely manner ). We believe they have unethical practices and are just trying to cash payments late or say they " lost '' payments in an effort to make more money and collect late fees. They have even gone so for as to have there " mortgage assistance and debt collection '' department call me at work. This is beyond unconscionable. I have never been late with a payment and have never had trouble with making online bill payments with any other payee.

Consumer Complaint: I was essentially extorted by M & T bank into obtaining a mortgage through them. Due to a report filed with XXXX by M & T Bank in XX/XX/XXXX, I was banned from opening a First Time Home Club savings account with any bank other M & T bank. The charge that was reported to XXXX was grossly inflated due to what I feel were inappropriate NSF charges. Even though I did n't think the report was fair, I did pay the amount owed to M & T, in full, less than one year after it was report to XXXX. Around XXXX XXXX and XXXX XXXX, I attempted to open a First Time Home Club account with XXXX & XXXX XXXX XXXX XXXX, but both were declined due to M & T 's XX/XX/XXXX XXXX report. After being declined by other banks, my housing counselor advised me to speak with M & T to see if they could withdraw the XXXX report. I contacted M & T at a branch to inquire about them withdrawing the XXXX report, but was informed that they could n't do that. However, they told me, I could open the First Time Home Club account with them. It seems preposterous that a company can report someone for a delinquent account ( which I believe was not legitimately delinquent ) & then force that same person to use only that bank. It seems to me that the system is designed ( at least in this instance ) to ensure that a consumer has no choice but to select a certain bank. To make matters worse, after successfully completing the First Time Home Club program and receiving the mortgage, and without informing me, M & T switched our First Time Home Club account to a different type of account that charges a monthly fee of {$7.00}. I believe it is the practice of M & T to do this to others in the First Time Home Club program. The account was charged the {$7.00} fee each month until the balance went negative, then it was written off by M & T -- all without ever disclosing the fees or sending me a statement. Upon completing the First Time Home Club program, I told M & T of our new address ( as was required in order to take funds from that account ) but M & T never updated the address for the account. Interestingly, they did have the correct address for our mortgage account. When I inquired about this with M & T they told me it was my fault for not changing the address and that I can not obtain the funds I had remaining in my account before the fees were charged and the account was written off ( they refused to confirm whether this account was also report to XXXX, but implied it was not ). They also provided me with several old statements and told me a fee was only charged XXXX times, but upon reviewing the statements I discovered at least XXXX as many fees as they claimed. At best, switching First Time Home Club accounts to fee bearing accounts without disclosing such a change is deceptive business practice. It is also not plausible that they did not have my current address because they acknowledged having it for the mortgage which was obtained as a result of that particular savings account.

Consumer Complaint: Good Morning All, I wish to have these very important & relevant questions answered by the Plaintiff, Wilmington Trust, the entity claiming to be the holder of my mortgage note that was allegedly sold on the secondary market XX/XX/XXXX by the servicer, XXXX XXXX XXXX XXXX , XXXX ( loan originator as well ). The Plaintiff in its sole capacity claims the mortgage was sold into the deal XXXX at some point between XX/XX/XXXX-XX/XX/XXXX. Your office retains a copy of the note with endorsements. Please note that XXXX did not exist any longer in XX/XX/XXXX/XX/XX/XXXX for failure to file annual returns with Secretary State of WA. This means that first endorsement on the note was fraudulent in nature as the entity had DIED, but purports to be assigned to a trust well into the future before its creation. The same holds true for the XXXX endorsement. I see nothing that indicates that these endorsements reference Successor By Merger! That is just the tip of the iceberg. There is so much more to discuss. So we have an entity claiming they have legal standing to foreclose as they claim they are holder of the note. The agreements between themselves are ridiculous & have no merits for the homeowner to legitimately track their COT ( Chain of Title ) at the recorders office. They simply do not match! They can fabricate their agreements at anytime amongst themselves which allows for further deceptive fraud against the homeowners ( FYI XXXX and XXXX ). My case is not going to be used to set favorable precedence for any bank entity to help them steal other homes in the judicial arena in the state of Washington. I will absolutely MAKE SURE this WILL NOT happen. I am a responsible individual and also a steward of the state and the public should be aware of various facts that surround this case so they understand what is at stake. To not know would otherwise be harmful to the public. IF ONLY THEY REALLY KNEW! I wish to know the trust balance specifically related to my property. I wish to have a NOD stating amount owed and to whom I am actually in default to. Now what would be the reason why a valid and legal NOD would not be given to me? Can anyone guess? I just want to compare the balance in the trust to what the complaint indicates. Simple, right? Furthermore, I wish to know how the Servicer ( XXXX XXXX who claimed they sold all their rights & interest XX/XX/XXXX ) continues to make assignments on behalf of themselves and XXXX, well after the trust date closed? As your own XXXX XXXX said to me : How did the entity get the loan out of the trust to make further assignments after that date? My response to that is : PERHAPS they are double and triple dipping. Fraud on the homeowner, fraud on the investors, SEC violations! PERHAPS, JUST PERHAPS the asset never really left XXXX XXXX XXXX XXXX. What do you think XXXX and XXXX. I am onto all possibilities and realities to be proven in a court of law of course. BUT, I am not the Plaintiff that bares the burden of proof. Does n't mean I can not disprove what WT states. Let us not forget about the XXXX Manual ( the attorneys manual for foreclosures ). Last, it is quite obvious that XXXX XXXX is behind it all and I have felt this. They need to show me what they did with approximately {$150000.00} in payments made direct to them after my XX/XX/XXXX Chapter XXXX BK DISCHARGE, where mortgage was not re-affirmed, but yet I, XXXX . Homeowner exercised GOOD FAITH in paying them as I have always INTENDED on keeping my family home in which my husband himself built and we used some of our own money. Now comes the NPV issue. So we have a Trustee for a Trust claiming I owe X amount of dollars. But yet they can not even provide me a NOD to match the amount & entity on their complaint? WHY NOT? What 's it going to hurt? Could the Plaintiff state the actual amount owed to the Senior Beneficiary? In this case, it appears to be investors for a trust.
