Consumer Complaint: In XXXX 2014, we filed for Ch. XXXX bankruptcy. Our home loan is included in the payment plan. M & T Bank is the mortgage servicer on the loan. My payments to the trustee are automatically deducted from every paycheck ( see " Payment Since Start of Case '' pdf, attached ). We were relocated by my job to CA and rented a home for 2 years. Recently, we moved out because the landlord is selling the home. We have been denied apartments because of the BK, and in this area, no one will rent a home to us because of the BK. Our only option for a home is to buy another FHA-financed home, which is justifiable for FHA due to the relocation. We are near the end of our home buying approval process and our new mortgage broker ( for the home we are trying to purchase now ) was notified that M & T Bank has been inaccurately reporting our mortgage payments to HUD, which is preventing the loan from reaching final approval with HUD. We called our assigned M & T Bank representative, XXXX XXXX, who admitted a discrepancy with the account. XXXX XXXX says that M & T Bank internally views my account as " in default '' even though I am in a Ch. XXXX payment plan. He could not explain the discrepancy between their alleged claim of default and my up-to-date payment ledger ( continue reading for the name of the attachment ). After I told XXXX XXXX that M & T Bank is violating my rights as a consumer by failing to report accurate information to HUD, which is a governmental agency, management and XXXX XXXX told me that they are referring my case to their attorneys who will communicate with my bankruptcy attorneys. Attached, you will also find a document named " XXXX That document shows that I am not in default, as M & T alleges, and has a letter in which XXXX XXXX admits that my account is current. Attached, please find HUD 's response, requesting that we ask M & T Bank to correct its erroneous reporting ( " FHA answer re XXXX ). M & T Bank refuses to rectify the issue and/or send it through the appropriate channels to resolve the situation.

Consumer Complaint: Hello Sir /Madam ( To whom it may concern ) I opened a checking account and a safe deposit box in XXXX XXXX XXXX in XXXX, XXXX NJ XXXX in XXXX which was closed in XXXX, in XXXX XXXX XXXX was taken over by M & T bank , And yesterday when I went to bank asking for the copy of the log book of access to safe deposit box, branch manager XXXX ( XXXX ) XXXX ( XXXXXXXXXXXX ) said they can not get it as the bank is changed and she called and emailed few places and said she will call me back and update me and today she left me massage that she can not get that information, as I know bank has to maintain the record for at least 5 years by law, and I need this information to provide it to court for some family dispute and its very important, is there any way CFBB can help me getting information from them. Consumer Complaint: My husband and I purchased XXXX properties for use as a warehouse and a showroom for his flooring company in XX/XX/XXXX A few months after purchasing the second property, the recession occurred which resulted in the company going into default with the mortgage payment. The lender is M and T Bank. An attorney who we had hired to advise on the matter, advised us to sell the properties by short sale as this would resolve the issue with the amount owed to the bank. We sent a copy of the short sale documents to the attorney and he advised us to proceed with the short sales. In XX/XX/XXXX we began receiving notices from M and T Bank stating we were owing approximately {$180000.00} which we have not been able to pay as I 'm the only working .As a result M and T has placed a judgement against us with the intent of selling our home.

Consumer Complaint: Lien Release Request : My home of fifteen years is currently in " Foreclosure '' with a Conventional Loan that has a 15 Year Balloon Payment, which has reached it 's maturity due date. I have been, met with several challenges attempting to refinance and / or modify the Balloon Lump Sum Payment that has come due. So, I decided to listed my home for sale to avoid Foreclosure. After doing so, I did received an offer, and entered into a contract to close on the property within 45 days or less. However the Title Co. revealed XXXX Liens. A First & Second. The Second Mortgage Lien had been " Written Off '' XX/XX/2012 and has exceeded the Statute Of Limitations for collections in my State. However the Title Co. would not complete and close the sale of my home without a Lien Release for the " Written Off '' Second Mortgage Lien. Both the Title Co. and myself made separate requests and follow up requests for a Lien Release to be issued. Our requests went unanswered, and the Lien Release has yet to be issued which resulted in several contract extensions, and ultimately the buyer losing patience, interest, and confidence that the " Lien Release '' would ever be issued. Currently the Lien Release has not been issued, but instead a statement of the amount of debt that was due at the time of the " Write Off '' which has been time barred from collection based on my State 's Statute Of Limitations laws. The Lien holder 's lack of cooperation in this matter is hindering the success of any sale or closing and my ability to avoid foreclosure.

An evaluation compamy contacted me to evaluate companies close to my home. Well I fell for it and they sent me a check to make purchases and it was fraudulent. but I did n't know that so I deposited it ( never touched it ) and they closed my account and told me the decision was made due to past history. do n't have past history. all I want is my account back.

Called back in to find out they have no record of such and re-faxed at the below fax number. XX/XX/XXXX at XXXX mst at XXXX XXXX at XXXX mst at XXXX ( Delivered/Confirmed via XXXX ) You have to wait 3 days to call back to find out if the fax/email were uploaded into their system. XX/XX/XXXX at XXXX mst at XXXXXXXXXXXX ( Delivered/Confirmed via XXXX ) XX/XX/XXXX at XXXX mst at XXXX ( Delivered/Confirmed via XXXX ) My assistant also faxed multiple times, but she is out of town and could not supply that information to me at this time. Here 's the challenge - because we needed to get the Authorization, Listing and Offer in within 37 days of the foreclosure sales date to M & T Bank, which we could have done had they acknowledged receiving the faxes and email. The XX/XX/XXXX foreclosure sale would have been postponed giving us time to get whatever else that may have been required. We are now a week away from the sale on XX/XX/XXXX.

The insurance settled in the amount of {$86000.00} which was less than cost of estimated restoration.When informed, XXXX from M & T Mortgage Loss Draft Dept., suggested that I payoff remaining principal on mortgage first and remainder will sent back to me to repair house. I signed check and mailed to M & T bank as directed by Loss Draft Dept., According to USPS, the check was received and on Wednesday XXXX XXXX, 2016. Till date M & T has refused to inform me when the balance of settlement check will be returned to me. In the meantime, I am suffering further losses in my house due to theft and vandalism. Note prior to sending the settlement check to M & T bank, I called its payoff department requesting a payoff amount for a future date of XXXX XXXX, 2016. I received a fax stating payoff as {$20000.00} if paid on or before XXXX XXXX, 2016. This date is exactly seven business days after M & T bank received check from me. I am afraid M & T bank is trying to take advantage and not close my account on time and in the process may ruin my good name. I have inquired of M & T bank 's Loss Draft depart., and also Customer Service Dept. , and received the same answer " We are working on it ''. I would like M & T Bank to credit payoff amount within 7 business days of receiving check and send balance back to my mailing address of record.

Consumer Complaint: Hello my name is XXXX XXXX XXXX living at XXXX XXXX XXXX XXXX NJ XXXX. I have a home mortgage at HUDSON SAVING BANK from XXXX at the interest rate of 5.5 ( A/C # XXXX XXXX ). From XXXX XXXX M & T bank takeover HUDSON SAVINGS BANK mortgage. Without my permission, now i have a problem with M & T BANK from XXXX XXXX. Every month i received 2 statements from M & T Bank. Saying that one statement says that i owe {$4300.00}. The second statement says that i owe {$2100.00}. MY monthly mortgage is {$2000.00} which includes my taxes. Due to my high interest rate i went to financial institution to reduce my interest rate, due to this two statement saying that i have a late fees on my mortgage. I have all my proofs paid my mortgage on time from XXXX to till date. i never paid any late fee so far. I went to M & T bank with these two statements to XXXX XXXX NJ Branch. I discussed with the manager about these two statements and the manager the other people are whose related to the M & T bank are not responding. Several times i called M & T bank try to explain why i am getting two statements every month but no response from them. With this i am loosing my credit score and no bank coming forward to reduce my interest rate. I am sick & tired with M & T bank. Finally, last two days back i went to M & T bank in XXXX XXXX to get some solution. The bank manager the other people say that " M & T works like this go and do what ever you want ''.
