Consumer Complaint: My uncle had a little house is XXXX XXXX. The lenders kept sucking him into cash out refinance and continued to attempt to do it even after being told he had XXXX. I am a real estate broker and quickly ran comps. He was upside down during the time they were still trying to cash out refinance. The house was worth about XXXX and he owed XXXX. I cleaned up the house so he could go home to live his final days and I cleaned it out more upon his death. I live in XXXX and this involved several trips and time away from my business to do so. The bank then tried to get a default judgment on me even though I was never living in the home, never a signer on his bank account, and never on his mortgage and I lived over XXXX miles away! I had to spend thousands of dollars defending myself from this legal action. My husband and I were in the process of building a home a home here, and this would have messed up our financing! Despite a court order dismissing me from the case, the bank continues to try and collect from me. My uncle passed on XX/XX/XXXX and I 'm filing this complaint on XX/XX/XXXX. M & T Bank is a predatory lender on elderly veterans, and XXXX XXXX XXXX is unscrupulous company that is violating the debt collection laws. Also, note that I left the house cleaner than any repo I 've handled in my 17 years in the real estate industry. Please note : I put my personal information on this form. Consumer Complaint: The bank is : M & T XXXX, NY., I have been customer for several years. It seems that in the past couple years, I keep going over my account amount of money. This gets to be quite a lot of money at almost {$40.00} a hit. They sometimes reverse the transaction as a courtesy, they said. Most of the time, it seems to be happening in the last week of the month. What I want is if a company that tries to withdraw money ( using my bank debt ), be it auto withdraw or used at a XXXX, and the amount goes over what I have in the account to PREVENT it from going through. This would save the consumer a lot of money. I do n't know what the financial or legal steps are involved please look into this and see what can be done. Additional, although, M & T ( which is a commercial bank ), has no XXXX and understanding for the " little guy '', I would like the bank withdraws that they have robbed from me for a least the last two years. Please understand that every pennie is important. I am XXXX XXXX XXXX. My income comes from XXXX monthly. I receive just over {$700.00} per month for several years. No I have no overdraft protection as my credit is poor. Expenses have gone up but my income has not. I have taken a the steps that I can to make sure the monthly withdrawal are done after the first week. This takes into account weekends and holidays. They told me it ca n't be done ( block with draws that cause the account to go over. ) I say WHY NOT. Why ca n't it be changed to protect the consumer that lives from paycheck to paycheck or monthly SS. I have tried by best to ask them to prevent theses type of over changes but they refuse to work with me. Summary, 1. Prevent withdrawals from withdrawing if it causes account to go overdrawn. 2. Return these over drawn charges for the past two years. Not just to me but to all the consumers in the same type of situation. 3. Levi a fine on behalf of the consumer.

Consumer Complaint: On XXXX XXXX, XXXX, I paid in full the FHA mortgage loan began with M & T Bank on XXXX XXXX using the amount of payoff given to me verbally. Within an hour ( EST ), I sent my check via US Priority Mail ( tracking number XXXX XXXX ) signed by one of their officers. The check # XXXX for {$160000.00} was drawn on XXXX and it was received and signed for. A week later after questioning the process, a bank representative transferred my call to another officer for clarity. I learned then that they had not posted my payment as final for it did not arrive at their office. I sent the check to M & T Bank, XXXX. MD. XXXX. A day later an officer returned my call stating that the check did come but the amount quoted was n't accurate and they now wanted to take this ( mysterious amount ) from the overage in the escrow account which then had {$870.00}. Without knowing whether this was legal, or right, I sought the advice of a lawyer who called on my behalf -only- to get the " run around ''. He suggested that they probably were wrong and to make a formal complaint as a consumer to your office. To date, I have three different letters from three different offices requesting more money -adding interest- as though the cashier 's check -had not arrived timely and the full amount of the payoff was incorrect. I used the figure quoted through XXXX XXXX, XXXX in the amount of {$160000.00}. For your records, I have a copy of the Priority mail express receipt showing that the letter would arrive by XXXX of XXXX XXXX, XXXX. My question to you is this, why if I paid the full amount quoted to me that would close the mortgage loan in full as stated, would this bank recompile another figure and take it from my accumulated escrow balance. And if this is an FHA loan, should they be allowed to dupe the consumer in this way? Such dishonest? I do not have the where-withal to attach the official check, the priority mail receipt, the four letter stating the balance on the closing day of XXXX XXXX if XXXX with Interest through XXXX XXXX, XXXX calculated at XXXX, pro rats MIP of XXXX and recording fees of XXXX total amount to pay off loan in full ... .. XXXX. The letter then said, the current escrow balance is : XXXX. The following clause : An additional month of interest is due if payoff funds are received after the first business day of the month, all figures are SUBJECT TO CHANGE. This statement expires on the last business day of the month. Figures must be updated after that date. In addition, figures will be adjusted if any transactions such as escrow advance, payment reversal, or fee assessment take place ....

Consumer Complaint: I am writing you today to express my frustration in working with M & T Bank on a mortgage modification under the Making Home Affordable program instituted by the Obama Administration. I am at a loss as to what to do now that will encourage them to act in a timely manner to finalize a modification process that began over 4 years ago. It is my hope that in filing a complaint that a resolution regarding my application for a mortgage modification can be expedited, and pressure placed on M & T Bank to fulfill its obligation to act in a timely manner not only on my behalf, but on behalf of others that are facing the same obstacles regarding their applications for mortgage modifications. I find it very observed that I have been trying to get a loan modification for over years, and yet, till this date, we have not been able to resolve the issue. It has come to my attention that my loan modification was approved for a Streamline Loan Mod which only reduced the interest rate .25 % which actually caused my payment to increase dramatically making matters worse. I have executed reports and viewed all the guidelines necessary to qualify for an affordable monthly payment. You mentioned you could not arrange an affordable payment to support a Loan Modification due to excessive obligations to support a payment. We fought back and forth with you including the court. You have received everything you needed in regards to the Loan Modification process. Now I 'm not able to complete my modification and get out of trouble with foreclosure due to a misunderstandings and a misinformed process to resolve the loan modification. It is neither my intentions nor my fault that this debt has increased. I been trying to resolve this issue for the last 4 years with no results, basically with the same action, " I do not qualify because I do not have enough income '' when in reality everything is already clear, and you have records of this. I just find this really obnoxious and idiotic when you have a citizen like myself, asking for help, reaching out to you throughout all this time, just because I want to keep my home, my investment, the house where my children reside. In news reports I hear that M & T Bank claims to be overwhelmed with applications for modifications. As a result, your bank is top XXXX worst servicer processing a modification. When times were good and banks were encouraging everyone to take out 1st, 2nd and even 3rd mortgages they did n't seem to have any problem keeping up with the high demand. Full documentation Mortgages could be initiated and closed inside of 2 weeks. Now, when someone asks for help, it takes years with no immediate results. I understand that across the country there are several lawsuits being filed against M & T Bank, some seeking class action status. I think it would be worth your time to look into doing the same on behalf of all Home Owners that are facing the same uphill battle with you M & T Bank as I am. Please take in consideration that I really want to keep my property. I am a single mother of XXXX children. I do n't want to move my children from the home they love and the schools they go. They have friends and participate in school activities and it would be heartbreaking for them to leave. Since my divorce, I been trying to keep consistent in their lives. Please help me the best you can, I know I qualify for a better Loan Modification, and it would be under our best interest to qualify this loan.

On XXXX XXXX, 2016, my husband and I received a letter ( see attached ) from our investment property Mortgage Company ( M & T XXXX. XXXX XXXX, XXXXXXXX XXXX, phone # XXXX ) stating that we do not have sufficient flood insurance and that our investment property is in a [ Special Flood Hazard Area ]. And the letter went on to state that if they ( the mortgage company ) did not receive updated flood insurance, that they will obtain another flood insurance policy on the property. On XXXX XXXX, 2016, I called the XXXX of XXXX XXXX where the investment property is located and inquired as to what type of flood zone our property is in. According to the letter sent by the City of Sunrise, our investment property is not located within a Special Flood Hazard Area based on the Flood Insurance Rated Map ( FIRM ). [ See attached letter. ] On XXXX XXXX, 2016, we faxed a copy of the above letter to ( XXXX XXXX XXXX Insurance Agency ) and emailed a copy of the letter to M & T Mortgage to their offered website in their letter XXXX XXXX XXXX. Approximately on XXXX XXXX, 2016, we received a letter from M & T Mortgage stating that they had placed another Flood Insurance Policy ( see attached ) on our Investment Property, knowing that my husband and I already have sufficient flood insurance on the investment property. The mortgage company needs to have more respect for laws, policies and for us as property owners. M & T Mortgage does not own us and we are not someone to push and kick around. M & T Mortgage has falsely placed another flood insurance policy on our investment property causing us the responsibility of XXXX insurance payments. I hope you can inform M & T Mortgage that a federal policy/law is in place on this matter and they are not abiding by it, so they need to. We actually do not have to carry flood insurance because the property is not within the flood zone map, according to the XXXX of XXXXXXXX. But, M & T Mortgage Company goes and force place flood insurance on our property like we are some type of insignificant individuals. And took the flood money out of our escrow already, which I hope you inform them that they need to replace it back.

For several months I have been trying to pay off. First a wire was sent they held for four days then sent back. Then I overnighted a bank check as per instructions and they sent that back. I re-overnighted the check and they have had it since XXXX XXXX and told me they would email attorney and cancel sherrif sale. Thank god I went to court because they disd not. As of today they cant locate check and payoff still not completed. How many other consumers are dealing with this at M & T.

Consumer Complaint: City of XXXX. property tax dept. notified me of a refund for XXXX prior years available to me. I was given by the city all the steps to obtain this refund and notified M & T bank/ mortgager and obtain all needed documentation from M & T Bank and sent everything to the XXXX . Property tax revenue dept. I obtained lettered permission for the refund to be sent to me by M & T bank. Followed up to find process/and check was approved but notified that the check will no longer come to me but to M & T Bank per a petition filed by M & T Bank on their own after my petition was submitted. Per the city the check was made out to M & T Bank and has already been sent to them. The bank denies the submission of an alternate refund request and denies of any change in payee. M & T states they will keep the check and not sent it to me but place it into my escrow account and will do a 2017 review and lower my mortgage payments for just one year instead of returning the refund. The bank continues to deny why the switch happen and continues to deny any check received from the City of XXXX Revenue Dept. I have documentation of the approval letter from M & T giving the Dept. of Revenue permission to send the check to me. I believe this is a fraudulent move by the bank to obtain funds for property taxes for a period of 3 years totaling over XXXX dollars that has already been paid through my past and present mortgage payments. I suspect that I am not the only person to expeirence this bate and switch. The City of XXXX Dept. of Revenue and M & T bank are blaimiing each other for this event. Consumer Complaint: 2 years ago I went to M & T bank to open a Bank deposit box -- I was told at that time I had to open a checking account to have the box. I disputed it but they insisted- we signed the basic paper work and since I need the box to store valuables belonging to my son while he was in XXXX I agreed. I started to wonder why I was getting charges greater than the cost of the XXXX XXXX XXXX When I accumulated the records I took it to the office and they told me it was a combination of insurance fees and late penalties-even though I paid for the box usually XXXX4 months in advance at the $ XXXX cost. I told them I never buy insurance but they insisted I did- I requested they show me the documents- they said they did n't have them and stalled so I reported it to the state XXXX office- all of a sudden they produced a document that had my initials stating I agreed to the insurance. I did n't but it was XXXX of those just initial here and here and here- and I did n't read the documents so I blamed myself for not being more careful, but I said I should n't have been charge late fees because the took the insurance payment out of my checking account and then my payment was short about XXXX or XXXX dollars causing what I assessed at approx. XXXX {$90.00} over all. I requested a refund and forwarded it to the XXXX 's office -- the bank eventually sent me a letter reiterating the information I already had-and basically said- this was the reply, have a nice day- notify our customer service dept if you have any issues. I replied that the initial complaint was to the customer service dept and that the letter was inadequate because all it did was state I had a box and resolved the insurance issue. However they did n't address the fact that I was lied to about having to have a credit account and that there were any late fees- No fee information was given to this date. I responded to the Banking industry and XXXX office again- but to date nothing and I believe they just logged it away. I am located in XXXX- the bank has its main office in XXXX so XXXX would do nothing- and XXXX just placated me with a 'have a nice day '' letter- Never did they address the failure to inform issue or the fees that I requested to be refunded. So unresolved issues are Denial of failure to disclose- unpublished fees for late payments- what constitutes a late payment and confirmation information of insurance that I had no idea I had, plus the fees that were charged that were never reimbursed

" bundling '' all accounts allows us to not have a minimum balance and avoid fees. twice this year our account has been overdrawn because they are charging us unjust fees and twice this year we have had to go to the bank and have them reverse the fees because our " bundling package '' was never set up correctly. I 'm wondering if this is fixed or are we going to have to go through this again! then we found out that when we deposit checks without envelope through an ATM and the amount of the check deposited is different than the real amount ( even by XXXX cents ) they charge us {$8.00}. Outrageous! Also, I never read anywhere that when we use our ATM card in a non-M & T machine we pay the ATM charge to the ATM provider but also a {$3.00} fee from M & T! their charges are fraud!

Consumer Complaint: In having a very hard month and being unemployed and searching for a job, I check my account balance on a daily basis. on checking my account on a Saturday. I saw that a scheduled charge had gone through on that day, which had made the account negative. I had checked the day before, on a Friday, and the account was not negative. on seeing that the account was negative on Saturday XXXX, for the first time, I proceed to borrow {$20.00}, from a friend to deposit, in the account to ensure that the account wont be negative. I never believe that any account should be in the negative, no matter how dire a situation is. This action on Saturday XXXX, removed the account from the negative. and all was well. the account was out of the negative. until the following Tuesday after the holiday, to my The bank to my dismay charge me {$40.00}. I am currently seeking employment and have no money to buy food to make. I checked my phone right after I saw the {$40.00} charge ( with no money ) and my account statement indicated incorrectly that I made the {$20.00} dollar deposit on that following Tuesday and not the Saturday of the XXXX. That 's a huge lie!. I have my deposit slip, which proves that the deposit was made on the Saturday XXXX. I then walked XXXX mile to the bank ( no car ) to get an explanation, and they humiliated me, because I am an XXXX XXXX man. any opportunity to humiliate an XXXX XXXX guy who doesnt look " correct '' is most welcome. talking loudly so everyone could here, afterwards then pleasantly dismissing, me. My deposit slip, and they refused to see it. They said the bank ordered them to do so. They didnt care what I had to say. Bank personel must have repeat that they couldnt do anything almost 5+ times. I need my {$40.00}, back as it is all I have left for the next couple of weeks. I am not a liar as they made me out to be. I have my deposit slip.
