Consumer Complaint: XX/XX/XXXX To Whom It May Concern : I would like to formally submit a complaint and request action be taken immediately to rectify this situation. My home loan was purchased by M & T Bank from XXXX XXXX XXXX XXXX XXXX ( XXXX ), XX/XX/XXXX. Before M & T purchased the loan I had been working to bring it to current with XXXX. I had a baby in XX/XX/XXXX and was unable to work causing my account to become delinquent. I was told by XXXX, who holds my 401k earnings, that I needed a letter of Default that showed threat of foreclosure in order to request the funds ( Demand Letter ). I requested and received the documents needed by XXXX XX/XX/XXXX. I then contacted XXXX and was told they no longer owned my loan and I would need to resolve the matter with M & T Bank. I received notice from M & T bank several days later ( letter dated XX/XX/XXXX ) and contacted them immediately. I requested the documentation needed by XXXX and was told that M & T could not apply or send out any late notices, fees or foreclosure information for several months while the loan transfer takes place and that the letter would be automatically generated and sent out after that time period. I contacted M & T several other times within that time period just to stay in contact and was told the same information, that I had to wait and it would be sent to me. After not receiving the letter I contacted M & T again at the begging of XXXX. I asked what could be done and how I could get the letter. The representative told me the delinquent statement would be enough for my 401k company even though its not the notice I requested. Feeling helpless I submitted the late statement to XXXX who again told me that was not enough. After receiving this information back on XX/XX/XXXX, just several days after my previous call, I again immediately contacted M & T and was informed my account had been put into active foreclosure. At this point I requested a supervisor and was put with XXXX XXXX. I explained to XXXX exactly what happened and after his digging into the history found out that the letter I was looking for was sent out prior to M & T purchasing the loan. I explained I had not received this letter from XXXX and was told repeatedly by M & T that they would be getting me the necessary documentation. I am completely capable of making the monthly payments. I intentionally did not make payments because I was informed the letter was coming to me and just needed the additional funds to bring the account current and then monthly payments would proceed as usual. XXXX said he would try to have a copy of the letter from XXXX sent out to me but would not contain the full amount because it was from months ago. Finally with his help, I did receive the letter and sent it to XXXX on XX/XX/XXXX. I contacted M & T that day to let them know I had the information sent to XXXX for funds and was informed it had now been assigned to an attorney and even more fees would be applied ( which should not be applied ). I requested the attorney information and contacted them as well. I was very proactive in staying in touch with M & T since they purchased my loan. Had this been addressed correctly, the issue would have been settled easily. I am a single mother of two and now in serious threat of loosing our home because I was lied to and misinformed for months by M & T Bank. The information I requested was withheld and no one ever informed me I was in threat of foreclosure even up to conversation just several days before the status change. If this is not addressed by XX/XX/XXXX I will be contacting the Better Business Bureau, the Consumer Financial Protection Bureau as well as the Attorney General. Sincerely, XXXX XXXX at M & T Bank suggested I file a formal complaint to M & T Bank regarding my situation and the events that occurred with my loan since the purchase of my loan. I took his advise. The events below are the results of that complaint. The above letter was sent to M & T Bank XX/XX/XXXX and I was contacted back by XXXX XXXX XX/XX/XXXX. She apologized and said she was doing an investigation and would have something sent out to me by the end of the week. I never received anything. I contacted XXXX back approximately Tuesday XX/XX/XXXX to find out why I hadnt received anything. She again told me she was working on it and would have something out by the end of the week. I again received nothing. I called XXXX back Wednesday XX/XX/XXXX to check the status and left a message. XXXX contacted me back the following day. The only thing I was told was exactly what my complaint to them stated. She again apologized and admitted that M & T had given me incorrect information time and time again and she was escalating my case to her superior on Tuesday XX/XX/XXXX. I have been continually put off and was never offered other options to correcting my loan. I am told that I was given false information and yet no one has done a thing to correct their mistake. Consumer Complaint: I am writing concerning my below. I am retired with one income. I had everything ok until the past few months. I made a complaint but M & T used my ex-husband 's account. The employees do n't know what is going on with my account and I have tried everything to get answers to no avail. I have applied 4 different times for repayment assistance and have heard nothing back. I need help and ca n't lose my home. Someone needs to investigate M & T because they are awful and are incompetent. Please help me I do n't know what to do. M & T keeps mixing up the two accounts and I feel I have done everything to fix this. I feel they owe me to fix this. I feel my account should be caught up to date without any negative affect on my credit. M & T should write off my past due and clear my account back to up to date and good credit rating. Consumer Complaint: I would like to request a Streamline Repayment for my property located at XXXX XXXX XXXX XXXX XXXX MD XXXX Recently, I was offered a repayment but it was not feasible as a single mom of XXXX children. I quickly contacted my Asset Manager XXXX XXXX who stated my home was referred for foreclosure the 2nd week in XX/XX/XXXXwhile I was being considered for alternative foreclosure options. Here is my question if I am being considered for alternative foreclosure options why was my home referred for foreclosure by XXXX XXXX XXXX? Have I exhausted all of my options due to unfortunate life circumstances? I am praying for a miracle for me and my children and need all the help we can get. We are working with a Credit Counselor through XXXX XXXX and they have been very resourceful. I am literally having anxiety and can not sleep at night worried if the Sheriff will be knocking on my home to put my children and I out on the street. I was required to go on two Medical Leaves of Absence - due to complications related to XXXX XXXX XXXX and the XXXX of my daughter in XXXX who was hospitalized in the XXXX XXXX at XXXX XXXX XXXX Hospital XXXX MD awaiting a XXXX XXXX. OnXX/XX/XXXX my divorce was finalized which is public record reference - XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. My household income was cut in half and I had to an insurmountable amount of legal fees associated with my divorce and custody of my minor children. I have being working diligently in alleviating my monthly financial obligations : I was granted an Economic Loan Deferment for my Student Loans, XXXX I was able to get free clothing for my children, XXXX XXXX food and prescription assistance. While I have been the only wage earner I have submitted applications to alleviate our monthly financial obligations : I was granted an Economic Loan Deferment for my Student Loans, and I have not acquired any new revolving debt in over 8 years. I am back to work full-time and would like to propose a reduction in my interest rate to 3.85 % thereby reducing my mortgage. Please consider lengthening my loan term to 32 years so I can pay back the arrearages now that I am back to working fulltime. If thats not an option please consider reducing my principal to current home market values using my current loan rate. I need my home for the stability my children and elderly parents a foreclosure would not be beneficial to my community, particularly now that I am able to pay and have resumed working full-time. I, XXXX XXXX XXXX have determined the estimated current property value to be XXXX based on the average values received from : 1. XXXX Lists estimated home values based on recent sales available through public records with the County Clerks Office . 2.XXXX Lists current properties for sale in community and recent sales activity. On XXXX XXXX, XXXX, our mortgage was sold to M & T Bank. M & T Bank XXXX XXXX XXXX XXXX, MD XXXX XXXX When our home was sold, we were notified via postal mail. However, since then, we have had numerous financial difficulties, have been entered into a loan modification program, and just recently while getting together all necessary paperwork, I have noticed that when M & T Bank took over our loan, they have instituted our loan for the maximum amount of {$220000.00}. Upon our ending and closure with XXXX XXXX, we owed {$220000.00}. We made 7 payments to them in the amount of {$1700.00}. These payments were not applied to our transfer to M & T Bank and I feel that this is wrong and not legal. I have contacted a legal representative and they also stated that I should contact you and seek assistance. Consumer Complaint: To whom I may concern, On XXXX, I XXXX XXXX XXXX received a copy of a refund check for {$780.00} from XXXX XXXX XXXX made out to the Estate of XXXX XXXX XXXX. On the back of the refund check, XXXX XXXX endorsed the check to deposit in her personal savings account at M & T Bank. I contacted a representative of M & T Bank at XXXX, and she did not know the policy and procedures if an Estate check can be deposited.in a personal savings account. XXXX XXXX XXXX at Register of XXXX ( XXXX ) in Delaware gave explicit instructions that an estate account for the Estate of XXXX XXXX XXXX must be established at a bank with all three co-administrators must be present at the same time. All three co-administrator names must be on the estate account, so any transactions for the Estate of XXXX XXXX XXXX would require three signatures. XXXX XXXX XXXX XXXX XXXX have refused since XXXX to meet with me at any bank to establish an estate account. On XXXX, XXXX XXXX and XXXX XXXX went to XXXX XXXX in XXXX, DE and liquated XXXX XXXX XXXX XXXX 's personal checking and savings accounts, but did not establish an estate account. I am requesting M & T Bank to freeze the {$780.00} refund made out to the estate of XXXX XXXX XXXX that was deposited in XXXX XXXX 's personal savings account. M & T Bank can schedule a appointment date and time when all three co-administrators can meet at M & T Bank to establish an estate account. As an alternative, remedy, M & T can issue a check for {$780.00} for the Estate of XXXX XXXX XXXX to XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX DE XXXX, M & T Bank should follow all State and Federal regulations and compliance for a estate account, since there is a great distinction between a estate account and a personal checking and savings accounts, especially when there are three co-administrators. If possible, I would like a copy of the policies and procedures pertaining to an estate account at M & T Bank. If there are any additional questions, please do not hesitate to call me at XXXX. Consumer Complaint: Early in XXXX I requested that M & T Bank drop the PMI insurance from my mortgage. I was subsequently sent a notice that the PMI would not be dropped because I had not met 2 of the criteria in order to do so. One of the criteria required me to make an additional lump sum payment towards the principle, which I did. The other requirement was that the loan had to be in effect at least 5 years. I was told verbally by M & T that that period would be in XX/XX/XXXX. When I called in XX/XX/XXXX to find out when I would receive a new payment break down, I was told that the PMI could not be dropped until XX/XX/XXXX because the 5 year mark was on XX/XX/XXXX. The payment statement that I received from M & T shows an increase in the monthly payment due to their escrow analysis, which includes the PMI charge that I will no longer be responsible for. I called M & T Bank today ( XX/XX/XXXX ) and asked again for a new escrow analysis so that I would know what my correct payment should be on XX/XX/XXXX. I was told that I could not receive that new payment figure since the 5 year mark ( XX/XX/XXXX ) had not yet arrived. I asked if I called on XX/XX/XXXX if they would then send me the correct payment amount so that I could make my XX/XX/XXXXpayment on time. I was told that the analysis may take up to 60 days before it takes effect. It is obvious to me that M & T Bank is stringing us along, and probably thousands of other mortgage holders as well, in order to collect additional PMI payments. The resolution to this problem is simple. I need the correct payment amount for XX/XX/XXXX that does not include the PMI. Thank you in advance.

Consumer Complaint: The bank continues to send me notices, in which, they include the mini Miranda disclosure making them collection attempts. These letters state that they need my XXXX XXXX insurance policy. I had called them several months ago and gave them the number and information to call the condominium association. Being the absurdly horrible bank that they are, they have n't done this. I live in a condominium with well over 100 units, so I 'm sure they could cross reference with other mortgages at my address or they could contact the condominium association as I had directed them in the past. If these letters continue, I will pursue legal action against M & T bank for the time I have spent on this matter as well as attorney fees and applicable damages. It 's particularly interesting that no other bank that has owned my mortgage in the past ( there have been many ) has ever made this request. It further speaks to M & T 's incompetence, laziness and disregard for their customers time.
