They wo n't accept a modification package from me.My First mortgage is current but they have no knowledge that M & T Bank has scheduled a sale date for XX/XX/XXXX to sell the home. This is second Mortgage I have been trying to work something about with M & T Bank. Each time it is a different person to work with. Can the second mortgage foreclose because of the subornation in New York? I made a payment to them XX/XX/XXXX and I thought I was on the right track. They are so very hard to talk with not to mention work out an agreeable term. When you call you have to go through about 6 or 7 people before anyone will discuss your account with you.

Consumer Complaint: I am a XXXX XXXX veteran and underwent major service connected XXXX XXXX in Spring XX/XX/XXXX. During this time my mortgage company, M & T Bank, were persistently attempting to convince me to refinance my mortgage. Against my better judgment I did so with the one goal of decreasing the monthly financial burden for my family while I was laid up from my XXXX XXXX. However, during the refinance process my mortgage lender failed miserably to accurately prorate my escrow payments needed for the upcoming year. Even though my mortgage company was aware of these mistakes in the months after, they did not inform me, nor reflect on statements until almost 8 months after the refinance was completed. At this time when they finally notified me, they had allowed my escrow to go several thousands dollars in the negative. Also this entire time no balance or account issues were being recorded as to what was happening on monthly and daily statements. All of these events led to my mortgage company giving me three weeks to come up with around {$500.00} a month extra in order to remain in my house with my family. I immediately contacted them and try to find out what happened. Once it was finally in the open of their massive failure in customer service, they refused whole-heartedly to even attempt in making this situation partially manageable for my family and myself. Instead my mortgage company offered zero assistance and instead only worsen the situation by being extremely rude and unprofessional while telling me that my family must Figure something out or else we wont have a house to live in anymore. A brief history, I purchased the house as a VA home loan in XX/XX/XXXX and have lived here since. I have always been able to pay my bills and not once ever put my family into a position where I could not afford the basics. In fact the only times in which I could not afford the monthly expenses was during this situation. This situation has produced and evolved solely from my mortgage companys disgusting sense of customer service and shallow pit of selfishness and greed. All while doing so without disregard of my wife and children. I have always been able to afford my house and there shouldnt be a reason that I cant now. However with my mortgage company putting me in this position financially, then finally over a year later, informing me they are DENYING any assistance for me my family and a chance of staying at our house. I was too sick to continue the phone call and requested them call me in a couple days. I simply do not know what else to do as everyone I have reached out to since XX/XX/XXXX when this began all I have been told is that theres nothing I can do. All I know is I fought a war for my country and in many cases I continue to fight that same war on a daily basis. I dont know how to feel when I am told they can not be held accountable. I have a hard time distinguishing between terrorists and my mortgage company seeing how they were allowed to XXXX and pillage my home and family while all I could do was stand here. I have never felt so helpless and weak.

Consumer Complaint: Recently I received notification from M & T Bank ( creditor ) that our escrow account was short. Our two options were to make a payment in full to satisfy the escrow shortage, or make monthly payments to satisfy the deficit. My family and I decided to make additional monthly payments. Three additional payments were made towards the escrow shortage. Separate checks were written and I specify on the memo section of the check that these additional payments should be applied towards the escrow shortage. M & T chose to apply my escrow check payment towards my principle & interest payments, therefore, they have failed to apply my escrow payments correctly. Several unsuccessful attempts have been made to resolve this matter. During my last attempt to contact them in XXXX 2017 I was finally promised that they would reverse the escrow payments that were previously credited to my principle and interest. Unfortunately, about two weeks later we were contact by the creditor, this time to inform us that they will not be able to correct their mistake since the error occurred more than 90 days prior. Again we have made several attempts to resolve this matter within 90 days prior to receiving the last letter from creditor.Furthermore, creditor is reporting that I am 30 days late on my mortgage based on how my account was credited. This erroneous reporting can be a detriment to my credit scores.

Consumer Complaint: On XXXX of XXXX I asked for my installment loan from M & T to be deferred by 2 months which was for XXXX XXXX and XXXX XXXX. I was approved for the extension and my next intstallment payment was pushed to XXXX XXXX. After I got approved I did n't follow up til XXXX when I realized the payment for XXXX was late, so I decided to call them and the rep stated that I was suppose to sign a document to confirm the extension which I were never informed about. That 's when I learned that the payment was late and passed 30 days. I called to complain and they stated that it was my mistake but the extension still was processed and my late fees were waived. I tried to get the late payment removed but they denied it twice, but I have proof of the payment extension agreement and still I was denied.

Consumer Complaint: i am writing to seek much needed help with getting a reasonable mortgage payment amount on my mortgage. i started to fall behind last year after the TOTAL ESCROW payment jumped sky high from XXXX monthly to XXXX monthly. i called and complained about it and was told that it was temporary and that it would go back to XXXX by XXXX XXXX of XXXX. the hurricane came in in XXXX ( XXXX ) and i got some damages which i reached out to the insurance company to take care of and they declined and threatened to cancel my policy if i did not get my whole entire home redone, tiles, roof, painting, bathrooms kitchen electrical airconditioning etc. which i have until XXXX of XXXX to provide color pictures to them after completion if not i will be cancelled. Since that time i have been trying to do repairs to my home slowly. which put a tremendous strain on me as I am a Realtor and do not make a lot of money as it is so slow in the industry. I was placed in foreclosure by M & T bank in XXXX XXXX, XXXX but thank XXXX the Hurricane came on the XXXX so I was blessed to have them toss the foreclosure aside if i did a new modification with them. It was a pain and almost near to impossible reaching M & T Bank then finally a rep told me to call the XXXX XXXX XXXX XXXX XXXX as they are the ones who is handling the loan it was transferred over to them. i have attached the agreement they sent me that i was forced to sign so i do not go into foreclosure. i called and spoke with XXXX XXXX who said he was going to check to see what he could do to help me with my financial strains and he sure did not. he came back with a payment schedule for 5 months of almost XXXX monthly i was floored. the first and only payment was XXXX which i struggled to pay but was able to do so but the 3200 monthly i cant even try to do that. i need my home for me and my XXXX boys and grandchild. I purchased this house in XXXX XXXX and managed through thick and thin to raise my children now a grandchild here im still in my home now almost 18 years and i intend to die here so please CFPB I know you all can help me to get the much needed help and fairness that im due. i do not want to lose my home i have worked so hard for. i am working hard as a realtor to place people into their home do you know how hard it is for me when i think about me and loosing my home and being homeless. Living under the Bridge or in a homeless shelter is not one of the options i need i am a hard working realtor and will continue to struggle to keep my home. i have since for almost 18 years. please i need my mortgage payments to be back to where it was before XXXX all the other colleages of mine who got modifications got low regular payments why are they not putting my past due to the back of my loan? why are they giving me a basket to carry water by giving me XXXX a month mortgage payment when i could not handle XXXX the amount they raised it to before. i was told that i was getting a fixed rate of interest but that was a lie. as a person in the business and having a better understanding now of mortgages and so on i found that they lied to me. They do not want to work with me. they are only focusing on trying to take my house. please have them give me a fair modification so i can handle my payments. this is ridiculous that the bank is trying to take my home that i have struggled so hard for and the insurance company that i am paying an escrow to every month would not fix anything in the house and force me to spend money to fix stuff they should be fixing. I did not get any damages from the insurance company first federated from of XXXX XXXX as they threaten to cancel me. HELP! HELP! HELP!

I recently applied for credit and I was denied because of the incorrect mortgage pay history that consist of my mortgage payment amount, mortgage balance, and open date of the mortgage that is being reported by M & T Bank on my XXXX, XXXX, & XXXX credit report. My mortgage balance and payment history is being reported incorrectly. Also M & T did n't report the terms of the mortgage modification agreement that is now my current deed. Consumer Complaint: My home mortgage is scheduled to come out of my checking account on the XXXX of the month and has been since my mortgage started in 2009. It is sent by mail from NY to MD on the XXXX. Allof a sudden it is not getting there before the XXXX, which is their late date and I was charged on 5 occasions at {$110.00} each. Why all of a sudden they are getting there late. One was even posted on the XXXX of the month. We spoke to XXXX, our bank, and they said it should not take 10-12 days to get to Maryland from New York. I did speak to M & T Bank and they did reverse 2 late charges but I feel they should reverse them all. They wanted me to let them have access to my XXXX account to pay my mortgage but I do n't want that. I am going to change the date that it comes out of my account or I may send it by mail myself.

Consumer Complaint: I opened an account with M & T Bank on XX/XX/XXXX after speaking with a Teller at their XXXX XXXX branch who informed me that they were running a {$200.00} promotion to open a new account using the code XXXX. Since I was a XXXX resident she stated that I would qualify for the code and that I should come back to open an account or open one online. Both my boyfriend and I opened our own individual accounts using the XXXX code since we just moved to XXXX and needed a local bank. We qualified for all of the terms to receive the {$200.00} but it never posted within the 90 days like it was supposed to. When I reached out to M & T regarding this on XX/XX/XXXX, they replied on XX/XX/XXXX stating that my name was n't included on the offer, but that they continually offer new account sign ups in branch, via radio, mailing, or internet for all customers, new and existing. However, I feel that is not a fair business practice and false advertising to potential customers as it was advertised to me in branch by their employee and both my boyfriends and my accounts qualified for the promotion.
