Consumer Complaint: I made a complaint already to the financial consumer complaint in Michigan and in the state of New York where my mortgage account is at. They refuse to take a single payment.. Im stuck paying every 2 months making a double payment because the bank will not work with me or allow a payment to go into my account. I paid a double payment in XX/XX/XXXX and in XX/XX/XXXX I called to schedule a payment on the XX/XX/XXXX. They said I wasnt in default yet and it allowed a single payment. Now XX/XX/XXXX came along and my payment was mark insufficient WHEN THE FUNDS WERE THERE! Come to find out they again blocked my account to accept the one payment. So since then I made a double payment at the end of XX/XX/XXXX since they would reprocess the single payment in XX/XX/XXXX.. XX/XX/XXXX my account was blocked to put a single payment and XX/XX/XXXX I mailed out 2 payments.. well they said I needed to all of a sudden pay all 3 out of 3 in XX/XX/XXXX after just making the double payment in XX/XX/XXXX! This mortgage company has not helped me or even given me proper information to get my account out of default! I dont have any demand letter saying I have to pay 3 out of 3 payments in XXXX! There policy never generated that when they clearly see I have the money to pay them they are trying to take my house from me! Since the state of New York contacted them nothing got resolved! They instead claimed they mailed a letter in XX/XX/XXXX I have to pay all 3 after I was only behind 2 months not even to being with! They started counting the month that Im in even with a schedule payment as a month behind! Mortage company can not charge u the month ur in and currently making a payment for .. if a payment not in by the XX/XX/XXXX the charge u and consider that a month behind! U have up until the XX/XX/XXXX to avoid late fees and technically till the end of the month to pay .. if u dont then its consider a month behind! No one has even attempted to help me! The moment they got the complaint they went against normal procedures ( forced to pay 2 of 3 payment and next month 2 out of 4 payments! ) they clearly know that they are not follow Michigan laws on mortgage companys completely blocking accounts! I cant wire mail or schedule a single payment anymore! They kno I pay bi monthly cause of this issue. They went against normal policy and charged me all 3 in XX/XX/XXXX ( XX/XX/XXXX they claimed the letter went out! ) XX/XX/XXXX a 2 payments processed into the account! This is my second complaint they now refused to take my 2 month payments for XX/XX/XXXX and XX/XX/XXXX .. and said my hosue Is in foreclosure. Im now taking this matter public because no one has helped me resolve this matter! And this provider shoudk be able to stop them from doing this to home owners

Consumer Complaint: I have tried everything that I know how to do correctly, Still, XXXX, XXXX and XXXX will NOT remove this from my credit report even though I have submitted this information to you 3 times already. Not only that they decided to double the amount to add insult to injury. This loan should have been removed 2 years ago it's NOW 11 years later & it's like gum stuck to the bottom of your shoe they seem to want to punish me for the rest of my life cause I lost my job ... ..the Law in NJ under Statue :, New Jersey Statute of Limitations on Debt Collection, SAYS -- - Demand Notes when no demand is made : 10 years. If demand made : 6 years from date of demand, ( 12A : 3-118 ( b ) ). THIS DEMAND IS PAST THE STATUE?? ( M & T Bank ) I'M trying to get a better job & place to live but they, ( XXXX ) ( XXXX ) ( XXXX ) NOR ( M & T BANK ) ARE ALLOWING ME TO MOVE MY LIFE FORWARD. Issue: Struggling to pay mortgage

Consumer Complaint: I am XXXX XXXX XXXX and have been serving in the XXXX for 19.5 years and I have a home that I purchased XX/XX/2005. I have never been missed a payment until late last year when the tenant I had living in my home XXXX XXXX. I was trying to keep up with the payment with me no physically living in the home it became very challenging. Fast-forward I received a phone call from a mail carrier that I know who delivers mail in the area my home is in and she asked me if I knew that my home was in foreclosure and my response of course was no. I reached out to M & T bank and they said that they have been sending notices although I never received anything in the mail. I am not sure how the process work so I reached out to a real estate professional and I was informed to contact the bank again and see what the for sale date is. The bank the referred me to the attorneys who was taking my case. I contacted the attorneys who were handling my date and they emailed me the amount in arrears, the payoff amount and the Foreclosure for sale date. I have tried to work with the bank to get this date postponed as having an active foreclosure and I was told that there was nothing to do. I was told that I did not qualify for the program for military because I bought my house before the program for military was in effect. I do not want to loose my home. I am planning to move into my home once I retire which is in 1 year. I really need help with this matter. I did not work hard to keep up the payments of my home to just finally loose it without any notices at all. I hope that I can get some help in this matter. Thank You XXXX XXXX XXXX

Consumer Complaint: I opened an account with M and T bank and used it for a balance transfer. When i finally paid off the balance I called them and asked to make my final payment and close my credit card account. I had never used the card except to transfer a balance and pay it off. I successfully paid my final bill of about 1,000 USD in XX/XX/XXXX. In XX/XX/XXXX I received many calls from M and T bank about having unpaid fees and charges. I told them that I had closed my account and paid the balance so I did not understand how I was still accruing any charges. She explained that there was some sort of final charge and I reluctantly paid the XXXX dollars. Just today, XX/XX/XXXX I received a call from M and T bank alerting me that I had unpaid fees and charges amounting to over 100 . I am still shocked at how, having closed my account, paid a balance as well as some extra fees I am still being hounded and charged by this company. Please help.

Consumer Complaint: My mortgage was transferred to M & T Bank on XX/XX/. Because I was in the process of a bankruptcy when my mortgage was transferred to M & T Bank, it was automatically sent to their bankruptcy department. I received and signed a reaffirmation agreement with M & T bank XX/XX/XXXX that was submitted and approved prior to the discharge of the bankruptcy. The time allotted to rescind the agreement ( 60 days ) ended over a month ago meaning that this reaffirmation is now legal and binding. I was told by my M & T representative, XXXX XXXX, that after the rescind period was complete the account would be released from the bankruptcy department and would also start reporting to the credit bureaus. This has not yet taken place. I have called numerous times over the last month to get this taken care of and my calls go unanswered nor will XXXX XXXX return any of my voicemails. Because this loan was reaffirmed, it has survived the bankruptcy as a valid mortgage and needs to reported as such. Payments to my mortgage company were always made on time prior to, during and after the bankruptcy and should accurately be reporting as such.

Consumer Complaint: Despite paying each installment of our loan over the past 2 years, M & T Bank states that we are in default. This is due to XXXX ( our previous mortgage holder who sold to M & T ) misplacing a payment at the end of XX/XX/XXXX We have been trying since XX/XX/XXXX to correct this issue. Unfortunately, XXXX sold our loan and informed the new mortgage holder that we were in default at the time of the sale. M & T, despite receiving proof of this error on multiple occasions has perpetuated XXXX error for 12 more months. This has grossly damaged our credit over the past year and has led to several thousand dollars of our money being given to M & T in extra payments and fees charged, all in an attempt to stave off problems until XXXX error could be corrected. The details of this case are included below and in more detail in the documents attached ( including a record of all payments to both companies and a detailed record of our interactions with both companies ). SUMMARY OF THE FACTS : Please find attached legal proof of payment for all transactions made over the course of our mortgage with XXXX ( the previous mortgage holder ) and then M & T Bank starting from the first payment to XXXX on XX/XX/XXXX and ending with the most recent payment to M & T Bank this month. All payments we made through Prearranged Payment and Deposit Entry which legally only requires a copy of our bank statement showing the removal of the funds and the name of the receiver of the funds. Also find attached a summary of all payments made to XXXX or M & T and the manner in which they were intended to be credited. You will note that XXXX has lost a payment which should have been credited to the XX/XX/XXXX installment. Thus began a 12-month process of trying to get credit for a payment we have already made. We first contacted XXXX on XX/XX/XXXX to address a letter we had received stating that they had not yet received our XX/XX/XXXX payment. We sent the attached proof of the payment to the fax number XXXX to the Attention of the Research Department, Payment Dispute. We never received any correspondence or response to this inquiry from XXXX. On XX/XX/XXXX we received a letter informing us that M & T had purchased the loan. We contacted both XXXX and M & T and were told that we would have to wait to contact M & T in XX/XX/XXXX to dispute the payment history. We went ahead and made a payment to XXXX at that time because by our records, even though we had paid the disputed XX/XX/XXXX payment, the XX/XX/XXXX installment was due. This payment was subsequently forwarded to M & T by XXXX, apparently on XX/XX/XXXX. On or around XX/XX/XXXX we successfully spoke with a M & T representative for the first time and requested that the missing payment be researched. Following this, we received a letter dated XX/XX/XXXX from XXXX XXXX in the XXXX XXXX XXXX acknowledging the inquiry and stating that someone would contact us as soon as the research is complete. We never received any contact regarding the conclusion of that inquiry. We made multiple calls inquiring about the results but were always informed by representatives in the XXXX XXXX XXXX that it took time to process these types of requests and that we would hear from someone soon. We continued to pay the accelerated payments in an effort to keep our credit from being affected while the research took place. On XX/XX/XXXX, after we had already paid the disputed amount in full awaiting the inquiry resolution, we called in to again inquire about the resolution of the payment inquiry. We were informed that the missing payment had finally been located. For this reason, we were told we did not need to make one payment since we were one payment ahead. Unfortunately, we were then contacted regarding our late XX/XX/XXXX payment. We were told that the missing payment had never actually been located and we were therefore behind again. On XX/XX/XXXX we again requested that an inquiry be launched into the missing payment. To date, despite multiple calls spanning MONTHS ( from XX/XX/XXXX to XX/XX/XXXX ) and requests to know the status of our inquiry, we never received any type of contact from a representative of the XXXX XXXX XXXX in the process of researching this payment or giving us a conclusion to the research. After finally contacting the Customer Service Department, we were told on Tuesday, XX/XX/XXXX by XXXX, a supervisor in the Customer Service Department, that M & Ts research into the missing XX/XX/XXXX payment was concluded in XX/XX/XXXX and that it showed it was located by XXXX and transferred to M & T on or around XX/XX/XXXX. We believe this to be incorrect as the only payment forwarded to M & T by XXXX after the purchase was our XX/XX/XXXX payment, as reflected by our M & T statements. Respectfully, we have sent the proof of payment to XXXX once have presented M & T with this information on 4 occasions. Meanwhile, over the past year we have suffered negative effects to our credit, the stress of trying to keep current on a loan we for which we have actually been ahead and have been subject to late fees we did not deserve. We ask that you facilitate correcting this egregious error.
