Consumer Complaint: I divorced my spouse over two years ago and want my name removed from the mortgage at XXXX and XXXX XXXX credit agencies where I am listed as owning the mortgage. I filed a quit claim deed for the mortgage and an assumption agreement was filed by my wife as well. My dissolution of marriage judgement, marital settlement agreement, quit claim deed, and assumption agreement of my ex-spouse that M & T bank is a party to, all of which clearly show that my wife has assumed the mortgage were sent to XXXX andXXXX XXXX. Both have refused to remove the mortgage from my credit report. This has denied me the ability to purchase another home.

Consumer Complaint: XX/XX/XXXX XXXX XXXX Called to check the status of the short sale application. XXXX XXXX answered. The file has been closed as of this morning. I told them it's not okay to leave me a voicemail yesterday and when I call back tell me it's closed. He said they call me on XX/XX/XXXX, which is Saturday and yesterday, which I am returning. It's completely not okay to close it out in less than 24 hours from leaving me a message and a week from me speaking with me, when they were the ones who did not review my documents since XX/XX/XXXX. I requested a supervisor and was transferred to XXXX. I told him I have called XXXX, XXXX, XXXX, and today. They did not review the items I sent on XX/XX/XXXX and resent on XX/XX/XXXX. I also sent XXXX and pension letters on XXXX. He said I am not being given the correct information when I call, since they are still asking for updated pension and SSDI. I sent these on XXXX. He also wants the XXXX, since the one we sent is dated XXXX. That is not the case, it's dated XXXX. He said the XXXX is wrong, this one is XXXX, not FHA. He said resend correct FHA XXXX, pension, XXXX, XXXX, and entire application. This is insane, since we have re-submitted already and have been updating in a timely manner. XX/XX/XXXX XXXX XXXX Called to check the status of the short sale application. XXXX XXXX Answered. They still have not reviewed the documents as they are still requesting the same ones sent on XXXX. I asked him to escalate it and he said he would. I re-sent via email and fax. XX/XX/XXXX XXXX XXXX : Called to check the status of the short sale application. They are just now reviewing the docs I sent on XX/XX/XXXX. They said it was uploaded on Sat., and it can take 48 hours to review. I requested a supervisor since the application should be complete and they have had over 48 hours to review. XXXX XXXX is the supervisor and she said they had 48 hours to upload it and 5 b/d to review. She said if it's not reviewed by tomorrow, I can call back and have it escalated. If she does it now, they will reject it saying they are within their timeline. XX/XX/XXXX XXXX XXXX : Called to check the status of the short sale application. An automated machine said we are closed for the holiday?!? What holiday? XX/XX/XXXX is XXXX 's Day. XX/XX/XXXX XXXX XXXX : Called to check the status of the short sale application. I entered XXXX 's extension and it said thank you for calling, goodbye and hung-up. XXXX XXXX answered and said they are missing the XXXX, which I confirmed I sent on XX/XX/XXXX, she found it and it's not the right one. M & T XXXXorrower 's financial report, which is labeled the XXXX, but also sent in., and the 30 days of paystubs. Transferred to XXXX, the supervisor who said sometimes the faxes fail and emails are too big and to resend them. I requested 2 more paystubs to go with it.

Consumer Complaint: In XXXX of 2017 I transitioned into a new job. Almost immediately at my new job I experienced inappropriate behavior by my superior which caused me to quit. In the coming months I experienced XXXX, XXXX and gained XXXX pounds. I also was struggling to pay my mortgage due to loss of income and the XXXX. Finally at the end of XX/XX/2017 I was able to get a job. I have called the mortgage company, M & T Bank, to start the process of catching up on my mortgage payments. I offered to make payments to M & T Bank every other Friday until my mortgage is current. On the day that I called the representative stated that they had placed my mortgage in foreclosure that very day. Literally the day that I called. I told them that I find it no coincidence that the day I call is the day they place my house in foreclosure. I again offered to make payments every other week until I'm caught up. I said I would give them all my money for the next couple of months. She stated that I would need to send them over {$7000.00} that day to stop the foreclosure. My only other option is apply for a loan modification loan, which offers no guarantee I will be approved or that the foreclosure will be stopped. While they decide to approve me for the loan modification, the foreclosure will continue to proceed. M & T Bank has a consumer who is very willing to make payments to bring their mortgage current. I do not want to be homeless, I just want to pay my bills and take care of my family. They have made a very difficult last few months infinitely worse. Please help me save my family and our home.

Issue: Getting a credit card
Subissue: Application denied
Consumer Complaint: Hello, I applied for the M & T credit card on XX/XX/2018 via an offer sent to my email. It was a promotion that I am eligible for the credit card. It should also be noted that I have a bank account with M & T Bank. After a few days, I get a call from M & T bank and I confirm my citizenship status. I ask the person on the phone that whether there is anything you need. They say no. I don't hear back and I call M & T to get to know what is happening and they say my card is rejected as I am not a US citizen. I have a few cards with banks and I have never got rejected based on that. Let 's say the bank doesn't offer cards to non-us citizen, why did you send me an offer? isn't my information in your system. My credit score and time has been affected because of this. I have a letter from the bank and the only basis they reject my application is based on my residency. A preoffer condition depends on credit risk not factors that can't change. I am very sorry to say but this is a fraud on M & T Banks part.

Consumer Complaint: M & T Bank mortgage. Our home is in Florida. We received one month 's mortgage forebearance after Hurricane Irma on XX/XX/XXXX because my husband was out of work for almost a month. M & T referred us to XXXX who advised us to overpay our mortgage payments in XX/XX/XXXX and XX/XX/XXXX in order to avoid having to go on a payment plan. We did so. In XX/XX/XXXX, we realized they had applied the overpayment to the principal, not the missed payment. Called M & T was assured it was sorted out. In XX/XX/XXXX, I called M & T upon making the final portion of the missed payment to ensure all the money was directed to the missed mortgage payment. Was assured that it was. In XX/XX/XXXX, we received a {$59.00} late fee, notice of missed mortgage payment. Called again. Was refunded the {$59.00} late fee and assured AGAIN that the overpayments were applied to the missed payment. In XX/XX/XXXX, had ANOTHER {$59.00} late fee and notice of missed payment. Spent another hour on the phone with rep. It now appears to be sorted out ; however, our XXXX statement of mortgage interest for XX/XX/XXXX is understated by one mortgage payment or approximately {$800.00}. Was assured on Monday, XX/XX/XXXX that the statement would be corrected and would be available in a couple of days. Called again on XX/XX/XXXX and was told the statement hadn't even been ordered. My taxes are already with the accountant and the amount will have to be estimated now. I would like to know how to report M & T for fraudulent business practices. Misreporting mortgage interest on a federal form would seem to be a crime to me.

Consumer Complaint: XXXX XXXX XXXX sold my loan to M & T Bank , M & T Bank messed up my escrow account, causing my payments to double. I was advised by another banker to default my loan for them to fix my escrow. Upon doing so, M & T Bank offered a loan modification. The first loan modification was rejected because one signature was not shown on the documents and I was not advised. M & T Bank started a second loan modification which was approved. During this time, I had ALWAYS made payments as they requested, however, once the loan modification processed it showed I had not paid for years, which is completely UNTRUE. I am looking to purchase a second home and need these missed payments to be removed.

Issue: Managing an account
Subissue: Banking errors
Consumer Complaint: I had previously filed a complaint, CFPB case number XXXX, because M & T Bank had refused for over six months to update my account with my new address and was knowingly sending personal and confidential information to my old address. I filed my complaint as I was concerned that M & T Bank would send my XX/XX/XXXX XXXX tax information to my old address. M & T Bank response to my complaint did not make any sense but as part of its response M & T Bank stated that it had updated my address in its records and that my XX/XX/XXXX XXXX tax form would be send to my correct, current address. Specifically, the XX/XX/XXXX letter they sent to me states : " the address has been updated for any applicable year-end tax forms. '' However, my address was not updated and M & T Bank willfully and knowingly sent my year end XX/XX/XXXX XXXX tax information to my former address.
