Issue: Trouble during payment process
Subissue:
Consumer Complaint: XX/XX/XXXX, I received an escrow analysis increasing my payment from {$780.00} to {$1200.00} because the company paid not only my tax bill, but a 2nd tax bill for a house in the area. They misappropriated {$2400.00}. When I called them, they told me I would have to prove that they paid taxes inaccurately. When I called the tax assessor for my parish, it turns out not only did they know they made an error, they had already requested a refund that was in process. They received this refund on XX/XX/XXXX. They refused to fix their error until they had the money back ( money I did not misappropriate ). They then told me they would allow me to pay my {$780.00} payment on XX/XX/XXXX and they promise not to mess up and mess up my credit or my amortorization on my loan. I can not trust this. They told my closing attorney 's office ( who called them ) 2-3 weeks and when I called today, they are now stating another 30 days to correct their own error. In addition, they can not read insurance documents ( or they are harassing me ) and sent me a letter that there is not enough insurance on the property. I have responded by fax today placing astrisks where the correct information is on the insurance doc proving the insurance is sufficient. This is the same insurance and insurance company that was approved for my FHA closing. My mortgage rep helped me get it so it would be accurate for my loan. I need my payment fixed immediately. I did not make an error. I did not misappropriate money. The supervisors do not care and expect that I trust they will not misapply the payment for XX/XX/XXXX. I can not trust this company. They can not read and they expect me to pay for my errors.

Consumer Complaint: When I opened my account with M & T bank, I did so online. I opened an account with them after receiving a mailer stating that customers would receive a {$250.00} bonus 90 days after opening an account as long as they had a direct deposit linked to the account. I applied for my account online using the special code " QC '' or " QD '' can't remember which. I even entered the code in the promo code box. My direct deposit started on XX/XX/XXXX and the account was opened XX/XX/XXXX. As of this date, I have not received my {$250.00} bonus.

Consumer Complaint: We have sent documents over numerous times that have required updating or new documents. We have saved money the sum of {$10000.00} to help reduce the amount we owe. We are very capable of making the payments on our house but the attorney fees and all the fees that have been added on have skyrocketed what we owe in order to catch up on the loan itself. They are telling us that we must pay all of it that totals over {$23000.00} when our loan to catch up is only about {$11000.00}.

Issue: Struggling to pay mortgage
Subissue:
Consumer Complaint: I am a resident in XXXX, Tx and my home was flooded during Hurricane Harvey. As a result of this flood, I sustained heavy damages and had to re-construct my home. As a result, I had to spend approximately {$27000.00} to fix the home and it took in excess of 7 months. The federal government placed a moratorium on all outstanding loans on homes that were affected by the flood and mortgage was not owed. M & T Bank is the lender that holds my loan. I paid the XXXX and XXXX loan balance and intend to pay XXXX onward. Due to this moratorium, I did not pay the mortgage for 120 days. The total balance owed from not paying the mortgage was {$10000.00}. Of that XXXX, {$9200.00} is interest expenses, so my new principal balance should be {$250000.00}. It took a month and a half for M & T Bank to give me a call and provide the new loan package. After the modification decision was made, M & T Bank contacted me and wanted me to verbally agree to a {$18000.00} principal balance increase with zero transparency with regard to a massive {$9000.00} addition to my loan, which is in direct violation of HR 4173 Sec. 1033 a consumer 's right to information, upon request, concerning the consumer financial product or service being obtained for any information relating to any transaction, series of transactions or the account including costs, charges and usage data. I requested paperwork that will show me how they came up to the {$18000.00} balance and why all of a sudden they tacked on an additional {$8700.00}. I repeatedly asked for a written break-down of how my principal balance increased from XXXX to XXXX from several representatives. The bank repeatedly refused and repeatedly violated Sec 1033 of the Dodd-Frank act and basically wanted to force me to accept this outlandish principal balance increase without understanding any of the calculations and how they came to that conclusion. My calculation shows an increase of {$9200.00} and their calculation shows ~ {$18000.00}, which proves that they are operating under Sec 1031 of H.R. 4173 article ( a ), section ( d ) subsection ( 1 ). Three of the representatives attempted to explain it to me and I received three different responses and I have zero understanding of the modification, which violates section ( 1 ) and ( 2 ) in its entirety under section ( d ). I believe their acts also violated Sec 1031 " Prohibiting Unfair, Deceptive or Abusive Acts or Practices. '' Their act of not abiding by Sec 1033 and possibly Sec 1031 is directly in violation to Section ( c ) and ( d ) in its entirety of Sec 1031. This is predatory lending. These banks are scamming its consumers ( and I am 100 % guaranteed I am not the only one in XXXX ) who have suffered from a major natural disaster and are forcing them to verbally accept ridiculous terms with zero transparency, and providing zero understanding as to why principal balances are increasing so significantly and without basis. I have recorded phone conversations that I am attaching to this complaint. These phone conversations will clearly show that these banks are not being transparent with their consumers and are in violation of multiple Sections under H.R. 4173. I have recorded phone conversations, a document calculating what the new balance should be and zero documentation from M & T Bank because they refuse to give it to you.

Issue: Managing the loan or lease
Subissue: Billing problem
Consumer Complaint: I contacted M & T Bank on numerous occasions once I received my XX/XX/XXXX statement and it reflected {$520.00} due with {$62.00} late charges for XX/XX/XXXX. Yes, I was late on my auto loan due to I missed payments in XX/XX/XXXX and XX/XX/XXXX. In XX/XX/XXXX I paid {$460.00} on XX/XX/XXXX ( normal payment amount {$460.00} ). On XX/XX/XXXX I caught the remainder past due amount up by paying {$880.00} which is the amount a customer service representative told me was the amount due. On XX/XX/XXXX my statement still reflected {$62.00} due of unpaid late charges. I then take a look at the recent transactions on my account online and it reflects I made a payment of {$820.00} and then a payment of {$62.00} that same day. It then shows on XX/XX/XXXX a payment was reversed in the amount of {$880.00} and then the last transaction shows a payment of {$880.00}. I never made a payment of {$820.00} or a payment of {$62.00}. I made one payment in the amount of {$880.00} which was never reversed by my bank. When I asked why it was reversed they could not give me an answer which is also proof M & T Bank is a fraud. The difference between the actual payment of {$880.00} and the payment M & T Bank is stating I made of {$820.00} is {$62.00} that they are saying I am still late for XX/XX/XXXX. I feel M & T Bank is cheating me out of {$62.00}. I contacted M & T Bank once again on Friday XX/XX/XXXX to get credit for the {$62.00} I paid. I spoke to XXXX who could not explain why {$62.00} is showing still as late so he transferred me to his supervisor XXXX who could also not explain why {$62.00} is still showing as late and stated she needed to reach out to her back office department and give me a call back. The first payment for the auto loan started XX/XX/XXXX. If you add up my car notes due from XX/XX/XXXX to XX/XX/XXXX which is {$460.00} per month totals {$4600.00}. If you add up my total payments from when the auto loan was opened til XX/XX/XXXX totals {$4600.00}. Therefore, XX/XX/XXXX 's payment should have only reflected I owe {$460.00} not {$520.00}. I want credit for my {$62.00} that they are saying I did not pay when I clearly did. For no one at M & T Bank to get to the end of my billing dispute is ridiculous. The customer service representatives and supervisors are worthless. I suggest you never take a auto loan from M & T Bank in your life. When you attempt to catch up your loan they still say you are behind and tell you a payment was reversed when it was not. I want a credit of {$62.00}.
