Consumer Complaint: Today. XX/XX/2022, I contacted GM Financial to make a payment on my new vehicle loan. The past due balance was more than it should have been. I reached out to a customer advocate to pay a payment of {$540.00} online. I just paid over {$900.00} on XX/XX/XXXX to become current. They did not correct the amount that was past due, and ignored my request. They went straight to asking me when I could pay. Also, today I addressed my concern with the negative effects with marking late on every month, which was not correct, on my credit, which I have paid and made payment arrangements. I was also ignored for my request to fix my credit report. GM has completely destroyed my credit and my ability to refinance or trade in my vehicle.

Consumer Complaint: Regardless of how many times I claim to be the individual writing this letter it seems this message is truly missed. For the record, Im the one whos initiating these disputes under MY NAME. The following items are UNKNOWN to ME. I dont get why youre claiming these are fraudulent or of a high risk nature. The documents Ive provided are legit. These are mine, filed with the appropriate agencies & support my position. Lets get the record straight!!! First of all I know that under FCRA Section 619 Obtaining information under false pretenses that any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under title 18 United States Code, imprisoned for not more than 2 years, or both. Most importantly, Ive never sent my documentation to anyone else which seems to be claim constitutes high- risk due to potential fraud. According to FCRA 611 ( a ) ( 3 ) Determination That Dispute Is Frivolous or Irrelevant ( A ) a consumer reporting agency may terminate a reinvestigation of information disputed by a consumer under that paragraph if the agency reasonably determines that the dispute by the consumer is frivolous or irrelevant, including by reason of a failure by a consumer to provide sufficient information to investigate the disputed information. ( B ) Notice of determination. Upon making any determination in accordance with subparagraph ( A ) that a dispute is frivolous or irrelevant, a consumer reporting agency shall notify the consumer of such determination not later than 5 business days after making such determination, by mail or, if authorized by the consumer for that purpose, by any other means available to the agency. Again, under 617 Civil liability for negligent noncompliance [ 15 U.S.C. 1681o ] Any person who is negligent in failing to comply with any requirement imposed under this title with respect to any consumer is liable to that consumer in an amount equal to the sum of ( 1 ) any actual damages sustained by the consumer as a result of the failure; and ( 2 ) in the case of any successful action to enforce any liability under this section, the costs of the action together with reasonable attorneys fees as determined by the court. A creditor that fails to comply with the requirements outlined in the XXXX Credit Billing Act forfeits any right to collect from the obligor. This is not a refusal to pay but a notice that this alleged debt is disputed. 12 CFR 1026.4 defines a finance charge. I respectfully request your company provide me with documentary evidence that clarifies this billing error. What authority do you have to collect debt in the United States? I consummated this consumer credit contract under good faith and credit. 16 CFR 433.1 ( i ) states " Consumer credit contract is any instrument which evidences or embodies a debt arising from a " XXXX XXXX XXXX '' transaction or a " financed sale* as defined in paragraphs ( d ) and ( XXXX ) of this section. '' In accordance with regulation Z, you can be fined up to {$5000.00} for giving false and inaccurate information as well as not providing the consumer with proper and respective disclosures. I have reason to believe your financial institution is violating federal law by knowingly furnishing false credit information. It is impossible to be late on an extension of credit. No law under the Fair Credit Reporting Act requires your financial institution to report negative information to a consumer reporting agency. I do not consent to the furnishing of any negative information to any nonaffiliated third party. Furnishing this false credit information is a violation of federal law and a violation of my right to privacy. The Right to Privacy was declared a fundamental right by the Supreme Court in XXXX XXXX XXXX XXXX XXXX. 2017. Furnishing false credit information to a nonaffiliated third party as a means of coercing payment on an extension of credit constitutes racketeering activity.
