Consumer Complaint: I sent a registered security to GM Financial XXXX loan 's indenture trustee on XX/XX/ to process for payment for account number XXXX and also per the electronic transfers act to remit my interest coupon dividends to my account listed in an instruction letter. I have yet to see an update on my account reflecting my payment by way of a registered security. Nor have they sent the security back to me if they did not accept it which proves they either accepted the registered security or they mutilated it which are also terms for discharge in Article iv of there XXXX SEC filing. ARTICLE IV SATISFACTION AND DISCHARGE SECTION 4.1. Satisfaction and Discharge of the Indenture. This Indenture shall cease to be of further effect with respect to the Notes except as to ( a ) rights of registration of transfer and exchange, ( b ) substitution of mutilated, destroyed, lost or stolen Notes, ( c ) rights of Noteholders to receive payments of principal thereof and interest thereon, ( d ) Sections 3.3, 3.4, 3.5, 3.8, 3.12, 3.13, 3.14, 3.17, 3.23, and 3.25, ( e ) the rights, obligations and immunities of the XXXX Indenture Trustee hereunder ( including the rights of the Indenture Trustee under Section 6.6 and the obligations of the Indenture Trustee under Section 4.2 ). and ( f ) the rights of Noteholders as beneficiaries hereof with respect to the property so deposited into the Accounts payable to all or any of them, and the Indenture Trustee, on demand of and at the expense of the Issuer, shall execute proper instruments acknowledging satisfaction and discharge of this Indenture with respect to the Notes, when : ( i ) All Notes theretofore authenticated and delivered ( other than ( A ) Notes that have been destroyed, lost or stolen and that have been replaced or paid as provided in Section 2.5, and ( B ) Notes for whose payment money has theretofore been deposited in trust or segregated and held in trust by the Issuer and thereafter repaid to the Issuer or discharged from such trust, as provided in Section 3.3 ) have been delivered to the Indenture Trustee for cancellation ; ( ii ) The Issuer has paid or caused to be paid all Issuer Obligations ; and ( iii ) the Issuer has delivered to the Indenture Trustee and the Noteholders an Officers Certificate and Opinion of Counsel and if required by the XXXX or the Indenture Trustee an Independent Certificate from a firm of certified public XXXX, each stating that all conditions precedent herein provided for relating to the satisfaction and discharge of this Indenture have been complied with. SECTION 4.2. Application of Trust Money. Consumer Complaint: I am writing to file a formal complaint against the following companies for what I believe to be a violation of my rights under the Fair Credit Reporting Act ( FCRA ). I am seeking your assistance in investigating and addressing this matter. Under the FCRA, specifically 15 USC 1681 Section 602, I am entitled to privacy concerning my credit information. I have reason to believe that this creditor has violated this right by disclosing my credit information without proper authorization. Furthermore, in accordance with 15 USC 1681 Section 604 ( a ), Section 2, a creditor is prohibited from furnishing information regarding my account without obtaining my written permission. I have not provided written permission to this creditor for the disclosure of my credit information, and I believe they have acted in violation of this provision. Additionally, I would like to draw attention to 15 USCS 1666b, which states that a creditor may not treat a payment on a credit account under an open and consumer credit plan as late for any purpose. This creditor has incorrectly reported a late payment, I request an investigation into this matter. I kindly request that the Consumer Financial Protection Bureau investigate this complaint and take appropriate action against them if it is determined that they have violated the FCRA. Consumer Complaint: I was never provided given a repossession warning letter, nor a ( redemption notice ) which is required to be provided to me by law. My vehicle was sold in an auction within 7 days from being taken. GM financial continues to report false and or inaccurate information to XXXX, XXXX and XXXX XXXX credit bureaus. XXXX shows {$28000.00} as the original loan balance and {$29000.00} written off amount with a balance owed of {$9800.00}. Payments that I made while the vehicle was in my possession is not even listed or deducted from the original balance at all. The information being reported to the credit bureaus is false and inaccurate therefore its illegal and a direct violation of my rights. Please remove this inaccurate account off my credit report and I will like to be compensated for being violated by GM Financial.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602, There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and respect for the consumer 's right to privacy. '' It is the policy of the Congress that each financial Institution has an obligation to respect the privacy of it's customers and to protect the security and confidentiality of those customers non public personal information. The financial institution and the consumer reporting agencies XXXX, XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX and XXXX whether it be verbal, non verbal, written, implied or otherwise is revoked. XXXX, XXXX and XXXX are not maintaining reasonable procedures. They put it into collections because XXXX XXXX was in a company corporate name that wasn't personally guaranteed. This account never belonged on my credit in the first place. They took my consumer information and placed it on my credit report and that's not what should have happened. 16 CFR 313.7 15 usc 6802 Per the FCRA as a federally protected consumer I am now opting out of any and all authorizations I the consumer may have given you written, unwritten, verbally and non verbally per 15 USC 6802 it is effective immediately and indefinitely. Since the debt is now with a third-party collection agency, it has already been charged off. As outlined in XXXX XXXX XXXX, this represents a certificate of indebtedness, which is categorized as income. It's important to note that income is not reportable on my credit report. " If your debt is forgiven or discharged for less than the full amount owed, the debt is considered canceled for the forgiven or discharged amount that you no longer need to pay.
