Consumer Complaint: Due to a few financial issues, a loan with GM financial was delayed is getting paid off completely. As the loan contract expired, I was behind with XXXX payment. I payed that amount and had XXXX left to payoff the loan. I attempted to contact GM Financial to negotiate a payoff amount since the entire balance remaining was related to late fees. They would not meet the expectation, which is fine, that is there prerogative, but when I went to make the payment, I was told that I could not use the online system or a payment with an agent because the loan was no longer active. I was told I needed to mail a check, but the payoff was only good for 7 days. I don't know how, in the current world that we live in that they can make it so difficult to payoff the loan, unless it's designed to elongate the process and allow them to add additional fees, thus keeping me on the hook for even longer. I feel I have completed due diligence to get the loan paid off completely and I feel like at this point all of the remaining balance are fees ( not interest fees that were agreed upon when setting up the contracted loan amount ). The late fees are something that they can adjust.

Consumer Complaint: Offered an extension of my credit via a credit application on a consumer finance transaction for a vehicle at a delaership. Ive received a letter of adverse action reguarding the reason why stating to be credit score and deliquent accounts. This adverse action is unlawful if not confirmed to be % 100 accurate as the lender has not done its due diligence on the reports as far as Confirmed validation of status- Confirmed validation of transunion, equifax XXXX and experion being a gov. Agency which it is not- Confirmed validation with all records paperwork data and information reguarding these fraudulently reported accounts. For this adverse action not only am i unfairly unable to dispute on the spot as requested with the dealer being the intermediary party i also am never allowed to speak to the actual official agents who claim to have denied my application. As the consumer, not being able to speak to the direct person involved is extremely frustrating and most unfair as there can be violations done without chance for an oral on the spot rebuttal. And the reference numbers for the adverse action are NEVER properly documented. Everytime i call, they claim to have no information attached to my information to find the reference number for the adverse action letter, and how is it possible to pull a credit report on me then later claim to not have the reference number attached to my information. This is not a clear and honest system for the consumer.

Which in turn have funds return on the XXXX of XXXX, due to a misunderstanding with a dispute dating back 3 months which they in turn disputed a all transaction with in that time frame. Due to this mishap my vehicle was repossessed by GM FINANCIAL. Ive sent in proof of payments via bank transactions and proof they I myself approved said transactions. They claimed they never recieved payments when i recieved emails from other merchants as well stating they recieved payments

Consumer Complaint: Dear Sir or Maam : Pursuant to the Servicemembers Civil Relief Act ( SCRA ) 50 U.S.C. App. Section 527, this letter is my formal written request to reduce the rate of interest to six percent ( 6.0 % ) for the above referenced account. I am currently serving on XXXX XXXX with the XXXX XXXX XXXX XXXX. I entered XXXX XXXX on Date, which was after after the time I incurred the above referenced debt. The SCRA establishes a six percent ( 6.0 % ) per annum ceiling on interest during the period of a servicemembers military service. This reduced rate became effective upon my entry to XXXX XXXX on Date, and shall be applied retroactively to date of entry to XXXX XXXX. Under the SCRA, any interest in excess of 6.0 % per year shall be forgiven. Additionally, any payments shall be reduced by the amount of interest forgiven which is allocable to the period of such payment. I have retained a copy of your signature and date of receipt, as well as time-stamped copies of my credit reports, showing that you have violated the Fair Credit Reporting Act, Section 623 ( a ) ( 3 ) by not placing the disclosure within the required 30-day period. Be aware that I am making a final goodwill attempt to have you clear up this matter. The listed item is entirely inaccurate and incomplete and represents a very serious error in your reporting. Additionally, you have broken federal law by not placing the notice of dispute onto my credit reports within the time required by law. Consumer Complaint: So I recently purchased a vehicle with XXXX XXXX. When purchasing the vehicle I was lied to about the loan and final purchase price. I am currently paying at the end of my loan double the amount of the sticker price and my loan has only a XXXX percent interest rate. So only after purchasing the car did I find out how much Im actually paying for the vehicle. I feel like I was completely taken advantage of. I have fair credit and I also put down a substantial amount on the vehicle. In my excitement I think that they took advantage of that and knew that they could give me a predatory loan. Even the head salesman said they pulled some strings to get me the loan. Im currently paying XXXX $ every XXXX weeks on an XXXX year loan and Im very upset because I love the vehicle but feel like I was taken advantage of and not explained the loan in full detail. Consumer Complaint: On XX/XX/XXXX, I signed an agreement with GM Financial to lease a XXXX XXXX electric car. The agreement was to expire on XX/XX/XXXX. Based on the agreement, I pay a monthly charge and be entitled XXXXo drive 15,000 miles per year, or 1,250 miles per month. On XX/XX/XXXX, I contacted GM Financial to extend the lease agreement and GM Financial agreed to extend the lease agreement for two months. With the extension of the lease agreement, both GM Financial and I understood that the allowed mileage will be increased proportionally to be 15,000 X3 +1250X2= 47500 miles. I also paid additional monthly charges to GM Financial for the XX/XX/XXXX and XX/XX/XXXX. On XX/XX/XXXX, I returned the car XXXX day before the new end date of the lease agreement. The odometer read : 48,304 miles. After that, GM Financial sent me a bill charging me, among others, a milage fee in the amount of {$820.00} ( = ( 48304-45000 ) X0.25 ). This amount was calculated based on the originally allowed mileage of 45,000 miles, but failed to consider the 2500 miles of additional two months of driving. I paid GM Financial based on the following calculation : ( 48304-47500 ) X0.25 = {$200.00} and also explained the reason. GM Financial refused to listen to my explanation and also reported this issue to the credit agencies. GM Financial 's capricious business behavior damaged my credit score and impacted my financial activities including my loan application.

These abusive practices contribute to the invasions of individual privacy among other things which you General Motors Financial Company , INC are in violation as I never gave you my information directly ; I, a consumer in fact, agree with The Congress to eliminate abusive debt collection practices by debt collectors, and to promote consistent state action to protect consumers like me against debt collection abuses which you are attempting to do Pursuant to 15 U.S. Code 1692 ( e ) ; Take Notice that Pursuant to 15 U.S. Code 1692a ( 2 ) the term communication means the conveying of information regarding a debt directly or indirectly to any person through any medium and in this specific case you General Motors Financial Company , INC used email, postal service etc. to communicate indirectly with me a consumer who is defined Pursuant to 15 U.S. Code 1692a ( 3 ) as any natural person allegedly obligated to pay any debt ; Take further notice that I am the true creditor Pursuant to 15 U.S. Code 1692a ( 4 ) which clearly states that a creditor is any person who extends credit creating a debt therefore I, a consumer, created the debt via my extension of credit to General Motors Financial Company , INC ; Notice that under 15 U.S. Code 1605- Except as otherwise provided in this section, the amount of the finance charge in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended and are aware that General Motors Financial Company , INC violated this right as shown in Exhibit ( A ) as the finance charge is not the sum of all charges. Consumer Complaint: This is not a duplicate nor is this complaint being filed by a third party, I am filing this complaint myself. Please see this complaint is processed to the letter of the law. As required under Section 609 ( a ) ( 1 ) ( A ) Disclosures to consumers [ 15 U.S.C. 1681g ] ( ( a ) Information on file ; sources ; report recipients. XXXX, XXXX and XXXX shall, upon request, and subject to 610 ( a ) ( 1 ) [ 1681h ], clearly and accurately disclose to the consumer. If the consumer to whom the file relates requests that the first XXXX digits of the social security number ( or similar identification number ) of the consumer not be included in the disclosure and the consumer reporting agency has received appropriate proof of the identity of the requester, the consumer reporting agency shall so truncate such number in such disclosure. & Section 611 ( a ) ( 1 ) ( A ) Procedure in case of disputed accuracy [ 15 U.S.C. 1681i ] ( a ) Reinvestigations of Disputed Information. I tried contacting the XXXX, XXXX and XXXX Credit Bureaus and the account they have provided me with nothing tangible which reflects anything verifiable. There is definitely an error with their part. Consumer Complaint: XXXX is failing to comply with FCRA Sections 605B and is also in breach of Sections 616 & 617 for willfully non complying and neglecting to adhere to the rules and laws of the FCRA. XXXX is failing to block or remove the account from my report. I followed their guidelines. I filed a report on the FTC website, I specified how the identity theft took place, that I did not benefit or receive goods or services from the alleged accounts, I validated the identity theft with a federal law enforcement agency ( which they're claiming I haven't ), I submitted the identity theft reports, provided a report circle the fraudulent account, an affidavit from the FTC website & provide a photo ID for their records. XXXX has claimed the accounts listed below have been verified and are accurate. I'm truly confused by their antics/tactics on how to report this issue but they are ignoring this dispute and failing to comply with the rules set forth in the FCRA. I need them to be held accountable & have this account blocked/removed : GM FINANCIAL XXXX Date Opened : XX/XX/2019 Balance : {$0.00},. Im attaching the required FTC Report for you ( which complies with FCRA Section 603 ( q ) ( 4 ) which states ( 4 ) The term " identity theft report '' has the meaning given that term by rule of the Bureau, and means, at a minimum, a report ( A ) that alleges an identity theft ; ) ( B ) that is a copy of an official, valid report filed by a consumer with an appropriate Federal, State, or local law enforcement agency, including the United States Postal Inspection Service, or such other government agency deemed appropriate by the Bureau ; and ( C ) the filing of which subjects the person filing the report to criminal penalties relating to the filing of false information if, in fact, the information in the report is false. ) The following report included this language but XXXX is neglecting to process it to the letter of the law. Please see they are held accountable for as this is impacting my life in emotional, physical & financially... and I would truly not what to pursue a legal remedy ... and the bank 's records ( learned through more research both parties require ). Please block/remove this file. If you feel there is a possibility this account belong to me I require all documentation that bears my signature ( another research item I found that requires you to verify with 100 % accuracy that each account is 100 % true, accurate, correct, complete & VERIFIABLE ). If you do not provide any records & claim the item is verified please understand I will seek legal action. I do not take kindly to games nor does my attorney.
