Consumer Complaint: In accordance with the fair credit reporting act, this creditor ( GM Financial ) has violated my rights. Under 15 U.S.C S 1681 section 602 states I have the right to privacy. 15 U.S.C 1681 section 604 ( a ) section 2 states a consumer reporting agency can not furnish an account without my written instruction. Under 15 U.S.C 1666b a creditor may not treat a payment on a credit account under an open consumer credit account as late for any reason. GM financial has reported my payment as late to all three consumer credit agencies which is a violation of my privacy.

Consumer Complaint: I purchase a XXXX XXXX XXXX last year XX/XX/2021 and GM Financial was the company that was supposed tot have gave me the loan to the car. GM Financial acted as though they gave me the loan but really they violated 12 USC 1431 consumer code which states banks cant lend money because they are the borrowers. They also asked for my social security number which is also a crime according to 42 USC 408 and because there is no lawful money. According to 15 USC 1602 I am the consumer and the creditor in this transaction. I extended credit on my on behalf to GM Financial for me to obtain the vehicle.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: On XX/XX/2022 and XX/XX/2022, I sent a certified letter requesting that GM Financial provide me with specific information regarding a repossession. Under the laws of the State of Maryland UCC XXXX and State XXXX and XXXX statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. My certified letters were a request that GM Financial provide copies of every legal notice and proof of the commercially reasonable manner of the resale of the subject vehicle. This is my right to ask by law. And if no such proof was provided within 14 days from receipt of this notice, the alleged claim of a deficiency is considered null and void, and any continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA. In addition, failure to comply with the above requests, means that I reserve the right to seek damages against all parties, under all available State and Federal statutes and UCC 9 remedies. To date, GM Financial has failed to provide me with this information. Due to their failure to provide me this information, they have to remove this information from the ALL 3-credit report reporting bureaus immediately.

Consumer Complaint: There are multiple duplicate hard inquiries on my credit report. From XXXX XXXX through XX/XX/XXXX of XXXX. I bought a new car and I was told they were preforming soft inquiries. I understand upon completion of the loan that there would be a hard inquiry. I believe there are about 12 hard inquiries probably more in that time frame. Also there are duplicate inquiries, I didn't ask for my credit to be run that much. Also I think it is only right that at least the duplicates should be removed. It is literally like Americredit is on it 4 times. There is also a duplicate inquiry for XXXX XXXX. Can you please help me get these inquiries removed?

Consumer Complaint: attached to every monthly billing statement is a payable coupon. If filled out correctly and signed by law it is considered a negotiable instrument. I submitted my remittance payment and was told it wasn't accepted for value and that I have to submit cash which is fraud and coerecsion. According to XXXX XXXX and emergency billing act the remittance is completely legal and should be accepted for value.

Consumer Complaint: On XXXX I purchased a XXXX XXXX XXXX from XXXX XXXX. I was forced to place a down payment of XXXX on this car. This is in direct violation of 15 U.S. code 1662 ( b ) mixing cash with consumer credit transactions. Furthermore I was made to have on own car insurance on the car which is in direct violation of 15 U.S. Code 1605 ( c ) Finance charge defined and what is all included. At this point I want to rescind this contract under 15 US Code 1635 right to rescind rescission & 15 U.S. Code 1635 ( b ) right to rescind and keep property. I would like my down payment back XXXX, the cost for the insurance XXXX. All violations are fined at XXXX per violation and all car payments need to be refunded. I also want the title to my car sent to me. They have fraud in this contract.
