Issue: Managing the loan or lease
Subissue: Billing problem
Consumer Complaint: My lease is throu gh GM Financial. I t ook it out in XXXX , XXXX . All payments have been made on time. At the end of XXXX i discovered a payment made on XX/XX/XXXX for XX/XX/XXXX due date was missing. I contacte d GM Financial an d they stated to fax in a copy of the cancelled check and remittance coupon which i did on XX/XX/XXXX . I had n't heard back so on XX/XX/XXXX i called and was on hold for ove r 30 minutes. They said further research was required and would call me back. As of 24 hou rs later I have n't heard back so I called again. As soon as i called the lady indicated rep yesterday was supposed to escalate this and she did n't so she will need to put me on hold and escalate this. I have {$75.00} in late fees that should be waived and I really hope this is not reported to my credit as late since i 've never made a late payment. I call them again and just put on hold. They cashed the check the day they received it, but getting them to apply to my account is much more difficult. There was a remittance coupon attached which showed my account #.

Consumer Complaint: I was in an accident on XXXX XXXX , 2016. I continued to pay until the insurance and GAP company paid. The final payment from the GAP insurance was cashed by GM Financial on XX/XX/XXXX . I paid XX/XX/XXXX another payment as there was still a balance. I paid 2 payments in XX/XX/XXXX as I was trying to pay off the loan. I found out when I applied for credit and my car insurance company went up on my rates that I was being reported as delinquent in payments. I checked my credit report to find that GM financial was reporting me as 30 days late. I tried to go on line to the GM Financial web site and look at the payment history which is inaccurate. It shows all payments from XX/XX/XXXX on, as being received in XX/XX/XXXX , when only one payment was received in XX/XX/XXXX . I tried several times to speak with GM financial because the online bill reporting is very confusing and inaccurate and they have repeatedly told me that the payments that came in from the insurance and GAP do not count towards any payments on the account even though the online statements state payment received so how is it not a payment. According to them even though the received a payment in XX/XX/XXXX from GAP and they repoprt it online as payment received that it does not count as a payment because it was not from me. I am attaching the statements for the months involved. Please help me. I feel I have been deceived by the online statements which are not accurate at best and misleading at the worst. When I spoke to a representative in XX/XX/XXXX it was only told to me that I needed to continue making payments until the car is paid for. They claim they told me that I was behind on my payments and that is not the conversation that I remember having with the representative. And when I told them that I may have to contact an attorney to resolve this issue because this does not seem proper they threatened that they would not be able to speak with me any further regarding my account. I have continued to make payments toward the remaining balance and will continue until it is paid in full.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: We were making payments as agreed with GM Financial on our account for the balance left on our vehicle that was a voluntary repossession . They wanted to raise our payments & provide additional credit towards our balance. They also offered a settlement option XXXX 2016 . Based on the information they provided at the time, I agreed to the settlement. I am attaching supporting documentation for the {$9000.00} settlement. I took the amount out of my pension account & considered the debt weighed more than the the tax penalty. In XXXX 2016 we received the settled in full letter. In addition without ever notifying me through this process, we received a XXXX for {$8000.00}. This was double impact to our taxes. I called XXXX & inquired as to why we were sent the XXXX & was advised that IRS required it to be sent out end of story. They failed to disclose this detail when they offered the settlement. I would have never proceeded with the settlement offer & would have worked out an acceptable revised payment plan. I am now faced with tax penalty on my retirement & additional taxable income based on the XXXX . This was very negligible on their part & I hope you are able to assist with reversing the XXXX due to non disclosure. Thank you

Issue: Problems at the end of the loan or lease
Subissue: Problem with paying off the loan
Consumer Complaint: In XX/XX/XXXX, I contacted Gm and asked to skip 2 payments due to financial hardship. In XX/XX/XXXX, I contacted Customer Service to make my final payment and was advised that my account had been paid in full. On XX/XX/XXXX, I received a threatening letter from GM which, stated that a payment of {$2000.00} was due immediately. I contacted GM and asked why the automated system stated the account was full paid yet, I had a balance due notice in hand and was advised that in XX/XX/XXXX, I was granted 2 skips and the payments were added to the end of the loan. The balance owed was the interest that was due. I contacted Customer Service who advised that I needed to sign a new contract immediately or, Collections would repossess my car, I did not remember being granted the skips and requested an account transcript, GM refused. I asked to speak to a Manager to request a breakdown of the charges and the computation of the interest. They refused. I contacted the automatic system today which stated that my account has no balance due. General Motors violated my rights because they billed me for interest on the skipped payments for more than six years without first issuing an account statement to advise me of the interest due until after the loan was full paid.

Consumer Complaint: I have an auto loan wit h GM Financial. On XXXX XXXX , 2017 the car was deemed a total loss. We were advised by the insura nce carrier and GM tha t the payment would be made and GAP insurance would cover the difference and not to worry. The car payment was due XXXX XXXX , 2017 and again XXXX XXXX , 2017 . My account shows an {$8700.00} payment made by XXXX on XXXX XXXX , 2017 when the car payment was due on XXXX XXXX . GM even waived the late fees for XXXX . GM d ebited my bank account on XXXX XXXX , XXXX for {$310.00}. I am now dinged with a 30 day late payment which is TOTALLY unfair. Auto payments should have been XXXX XXXX , XXXX XXXX , XXXX XXXX ( or until GAP paid the remaining balance ). So if XXXX made payment XXXX XXXX , they debited my account on XXXX XXXX and XXXX due date is not here why is my account showing 30 days late??????

Issue: Struggling to pay your loan
Subissue: Problem after you declared or threatened to declare bankruptcy
Consumer Complaint: I filed bankruptcy in XXXX Chapter XXXX . It has since been discharged. General Motors c alled my lawyer and we arranged a day to pick up the XXXX as I surrendered it in the bankruptcy. They picked it up XXXX . My husband filed chapter XXXX who was also on the loan with me. 2 months later they called and demanded he pick up the vehicle at the towing lot that day. We called and asked why they said it was ours pick it up or it will be surrendered to the towing agency. Now on XXXX they send a towing company to my old address asking for me and demanding the vehicle. Then they come to our present address and speak to my husband and demand to only speak with me. He was talking to him through the screen door the repo man attempted to open my door to yell in the house for me. He would not speak to my husband who is the only responsible party for the vehicle as my chapter XXXX had been discharged. He told him that I would be responsible for the visit fees the repo fee and towing fees and that he needed to explain this to me before he would leave.he also stated that this would not go away it would be added to the total I owed GM after they found the vehicle and took that I was just racking up fees to pay. I know that after chapter XXXX I am not legally in no way responsible for this vehicle, I can not be billed for it and I ca n't be threatened with legal action and fees because I filed Chapter XXXX and it was discharged. This company harassed people at my old house harassed my husband and threatened me. XXXX broke the law. The repo man works for them and it is their responsibility to ensure they are doing the right thing.
