Issue: Incorrect information on credit report

Subissue: Account status

Consumer Complaint: GM Financial has been reporting a late payment 30-59 days past due XX/XX/2016 since that time. I have contacted them over 20 times regarding this false late payment reporting. They have stated numerous times they have updated the credit bureaus however, to this day it is currently being reported on my credit report. I am in the process of buying a home and have asked them for a letter stating that I was not late XX/XX/2016 and have been told they ca n't provide a letter without proper authorization from their legal department. I have waited patiently and explained the situation and need for it to be rectified immediately. I have contacted them numerous times over the past two weeks without without compliance. I again contacted GM Financial today and was told by the representative that there was no one I could speak to and again to call back in 3-5 business days. I offered to send them a copy of the credit report as they are stating they did not report a late in XX/XX/2016 and the representative refused to provide info on where I could send the credit report showing the late reporting to. I would like a letter from GM Financial stating that I specifically was not late XX/XX/2016. To wait for credit reporting to be updated would not be beneficial as this late is the one thing holding myself and husband up from closing on a home loan. GM Financial have also reported to me that they have done this in the past however, the late is currently being reported as such. Thank you for your attention in this matter. You may reach me via email at XXXX and also via phone at XXXX.

Issue: Problems when you are unable to pay

Subissue:

Consumer Complaint: I had a vehicle loan with GM financial and after my husband lost his job my vehicle was repossessed. I was in discussion with many financial representatives for hardship status and after speaking with GMs representatives we came to an agreement amount in XX/XX/2016 that they would accept {$3800.00} as full settlement and agreed to dismiss the charge off and list it as paid in full per our conversation and agreement. This was not honored. I have worked very hard to improve my credit and have not abused lending. I have not been afforded any chances at reestablishing myself as GM/XXXX did not honor their end. If it was never the intention of the company to forgive the amount left over, they used a very dishonest way of misleading me into believing if I came up with this VERY large amount of money, that I would be free of this debt. They were able to sell the vehicle, I paid on the vehicle for a couple of years and I paid the settlement amount agreed upon. I would like this charge off, unpaid balance removed from my credit report and I would like an updated report sent to the companies who requested my information. Thank you for your time and consideration.

Consumer Complaint: My wife and I are XXXX. We are retired and live on Social Security and XXXX small retirement accounts I have. We had a XXXX XXXX XXXX that quit on us and the repairs were going to be close to {$3000.00}. There was no way we could do that so we started looking for a good used car. I had been on the internet looking at several dealers but had not contacted any of them yet. That afternoon a salesman from XXXX XXXX XXXX in XXXX, Texas by the name of XXXX XXXX called to tell me he had just gotten in trade a XXXX XXXX XXXX that was really clean. I told him we had no way to get to XXXX ( about a XXXX mile drive from our house in XXXX, Texas ). He said no problem, they would bring it down to us, leave it with us, and we XXXX XXXX it back up there. We did so and the car was quite nice. We ended up buying it but the next day started having problems with it. All of the lights would flicker up and down in intensity and the transmission would ( when taking off from a stop in drive ) have a loud grinding them a loud bang before accelerating. I took the car back to XXXX and the sales manager said he would have it checked out and call me with the cost. I told him to not call me, I had no more money I could put into the car. If he could n't get it fixed, I would either leave it on his lot or take it to XXXX XXXX who held the note on it. After arguing for a short while, he said they would fix it. They eventually got the electrical problem fixed but could not get the transmission working properly. They had the car for 3 of the first 5 weeks we owned it. I eventually took it back to them and said that if we continued to drive it the way it was we would probably have to replace the transmission in a year or so. My wife and I were afraid to continue to drive it. They said they would see what they could do about getting us into a XXXX XXXX XXXX they had. They called me later that evening and said they were working on a deal for the XXXX or a new XXXX XXXX XXXX. We went to XXXX the next day land the Salesman told us they could n't do the used XXXX but they had gotten a deal on the XXXX XXXX done with GM Financial. Our payment increased and our insurance went up. We did n't really like the XXXX but were told by the salesman that " That 's it ''. When I asked what did that mean, he slumped over to one side in his chair and said " That 's it. That is all we can do ''. The Sales Manager would n't even talk to us. I have inquired twice on line about used cars they have and the salesman finally called and when I asked if there was anything they could do he said no. Now they wo n't even respond to me. My wife and I both feel as though we were forced to take the XXXX XXXX. It does n't fit us. When we are in the car, we are constantly knocking elbows due to the cramped conditions. My wife has XXXX XXXX and ca n't walk for any distance because of XXXX. We have gotten a XXXX for her but can barely fit the XXXX into the car. I would like to get out of the XXXX and into a used sedan XX/XX/XXXX to XX/XX/XXXX. I ca n't do anything with the XXXX due to the negative equite we now have on it.

Issue: Shopping for a loan or lease

Subissue:

Consumer Complaint: Hello, I applied for a Pre-Approved Auto Loan through GM Financial only. The GM Financial application was sent to a XXXX Dealership. My authorization of the GM Financial application was to only allow GM Financial to use my information and run my credit. However, the chevrolet dealership was able to use my information from the GM Financial application to run my credit at multiple lenders. I never once gave approval for GM Financial to openly allow my information to be passed onto other lenders. The dealership took it upon themselves use my GM Financial application and send it to other lenders. I feel as though GM Financial and myself had a contract between only us. The information I provided on their application was strictly to be used for a loan through them not another lender. The lack of protection of my credit information by GM Financial is carless on their part. Additionally, the dealership is at fault as well. However, that is a separate issue. The key issue here is GM Financial falsely advertised that my personal information would only be used for a loan through GM Financial. However, the lack of control and security of their handling of my GM Financial application allowed the dealership to run my credit through other dealership without ever making a new application. The dealership information is below as well : XXXX of XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX VA, XXXX Work : XXXX EXT : XXXX Cell : XXXX Fax : XXXX
