Consumer Complaint: We paid off the life of the auto loan balance but several weeks later we get a letter saying ( paraphrasing ) " you still owe late fees for this account. '' However, we know for sure before the loan was transferred to GM financial we did not have late fees and the deferment payments was added to the back of the loan in which we were told. So, I do n't know why we still owe late fees when we paid off the life of the loan, please explain that to us.

Second is GM Financials ( their Contract XXXX pages attached ) provided to me on XXXX XXXX, XXXX with a Fraudulent Signature and multiple changes including a crossed out amounts, and several discrepancies including payoff is {$0.00}. Third is Dealership Copy of their Lease which is unsigned. I have notified the XXXX as well as the Attorney Generals Office and have enclosed all paperwork for your file.

Consumer Complaint: My Auto Lease payment was due on XX/XX/2017. I made my payment early on XX/XX/2017 Credit Card Payments that is used with GM Financial online payment option was XXXX via GM Financial online system when I log into my account. The Payment Option Link for XXXX. When I click on the link from there website It ask me to enter the Bill Payer, I entered GM Financial and a drop down came up to select GM Financial Leasing ( I have a lease ). I continue to enter my payment amount {$560.00} and XXXX XXXX confirms the payment and I paid same day service 2-4 hours fee of {$44.00} ( Total Transaction including my lease payment and XXXX XXXX fee {$610.00} ). After I get my payment conformation via XXXX XXXX Tracking number ( MTCN ) : XXXX. I email GM Financial right away asking them if the received my payment. I then receive an email from GM Financial 2 days later telling me that the payment has not posted. At this point I am very concerned because I always pay my balance on time and before the due date and somehow this payment is taking forever to apply to my account. I check my Credit card with my Financial Institution and the charge had already posted to my Credit Card I used on the same day. I contacted GM Financial several times to ask what is going on with my payment, my bank acct is drafted and payment is confirmed with XXXX XXXX, what is taking so long to post my payment to my account. I spoke to several managers and one Manager XXXX looked into research with the payment processing department and found the payment was made. I was told that the payment would be posted to my account at XXXX. Low and behold my payment was not posted the next day. I called GM Financial several times on the next day and was told they found my payment but somehow it was routed to another department and they are forwarding my payment to my account, and this time it will post in 24 hours, at this point its 5-6 days later. Today XX/XX/2017 I check my online account and I still see payment has still not posted. My Credit card has a posted charge deducted for the payment and XXXX XXXX has confirmed the payment on same date XX/XX/2017 and GM Financial has confirmed the payment and still they have not applied my payment to my account, causing me account delinquency.

Consumer Complaint: I have repeated requested that GM Financial correct their Credit Reporting on the Auto loan # XXXX that has been subject to a XXXX CANCELLATION OF DEBT. I received the XXXX For tax year XXXX, wherein I had to include it in my tax return and incurred tax consequences. The continued reporting of a past due balance on my credit report is highly damaging to my ability to obtain favorable finance terms and is putting my family in a position where we are unable to secure housing due to this. It 's quite the troubling scenario, I ca n't actually PAY this bill to GM FINANCIAL because it has been cancelled, yet I am unable to correct my credit report and have it show that this debt is not past due {$11000.00} as of XX/XX/XXXX. This is a huge problem. Numerous correction attempts with the credit bureaus and GM Financial have yielded no results. I have done research on the topic and would like to advise both the CFPB and GM FINANCIAL that this issue has been litigated extensively, and that it has been decided numerous times by courts that it is inequitable to allow a creditor to belatedly enforce a debt after it received the tax benefit of the Charge-off, in addition to it being inequitable to require me to report this cancelled DEBT as income on my federal tax return and face tax consequences and STILL hold me liable on the debt. Below, please see all the research I have done in my favor. See : See, e.g., In re XXXX, XXXX ( XXXX. XXXX ) XXXX v. XXXX , 36 XXXX . XXXX XXXX XXXX. XXXX ) XXXX. v. XXXX, XXXX XXXX. XXXX. XXXX XXXX ( XXXX. XX/XX/XXXX ) ( " It would be inequitable ... to require that [ Defendant ] report the discharge of debt as income on his federal tax return or face the potential tax consequences and hold that the plaintiff may continue to hold him liable on the debt. " ). " is in direct conflict with the Internal Revenue Code and the fact that cancellation of indebtedness income is included within a debtor 's gross income. '' Id. at 270. The court further determined that the issuance of a Form XXXX reflects that a financial institution has, in accordance with 26 U.S.C. 6050P and 26 C.F.R. 1.6050P-1, discharged an indebtedness. Id. at 271.

This is not a refusal to pay, but a notice that this account is disputed. This vehicle was repossessed in California on or about XXXX XXXX, and resold at an unknown date. Under the laws of the State of CAUCC 9.506 and State XXXX and XXXX statutes a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. GM never provied copies of the legal notices and proof of the commercially reasonable manner of the resale of the subject vehicle. Because GM never provided this information, the alleged claim of a deficiency will be considered null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA.

Consumer Complaint: GM Financial somehow lost my {$300.00} payment that was sent to them in XX/XX/XXXX and/or XX/XX/XXXX. Their records indicate that I never made a payment ; I sent them my statement from that time period that confirms that they did indeed receive and process the payment for {$300.00}. I contacted them in XX/XX/XXXX to resolve this, and no one has done anything so far. Everytime I speak to someone over the phone or via email, I am told that management is looking into it. It has been almost 3 months. This needs to be handled ASAP. My loan had an original payoff date of XX/XX/XXXX, but now it shows that I owe {$1000.00} in late fees that never should have been there. I paid my bill on time every month. They need to locate this missing payment. It was taken out of my account and processed by them, and they refuse to acknowledge this. This loan is showing negative marks on my credit as well as a leftover balance of {$1000.00} due to GM Financial 's error.

I was informed by GM Financial credit department that on XX/XX/2016 they were unable to pull my report and that I needed to unlock my credit again .... This LIE repeated on XX/XX/2016 and XX/XX/2016. I was deceived by GM Financial into unlocking my report when they clearly ran my credit multiple times when ONLY one time was warranted and authorized. GM Financial credit department made a false and deceptive statement to me creating financial damage, stress and harm. I have seen with my own eyes that your company in fact lied and deceived me on : GM FINANCIAL Inquiry Date XX/XX/2016 GM FINANCIAL Inquiry Date XX/XX/2016 GM FINANCIAL Inquiry Date XX/XX/2016 ran unauthorized credit report on me. At no time did I ever authorize them to run my credit more than once in FACT I HAD IT FROZEN. They have made it impossible for me to refinance my home mortgage that I need to do NOW! Your blatant false statements and actions against my credit are unconscionable and need to be corrected at ONCE!

I make extra payments each month and ask them to place the extra amount past my regular payment and they keep placing the extra money on the next months due and future payments. I specially am making extra payments to the principle so that I can pay my car off sooner because my income will drop. Please how can I get this resolves so that I do n't have to complain each month or call them each month and they still get it wrong. I need help. They just want to take the extra interest money from me monthly.
