Consumer Complaint: In accordance with the Fair Credit Reporting Act, the auto loan account with GM Financial has violated my rights. Section 602 of 15 USC 1681 establishes my right to privacy. Additionally, Section 604A ( 2 ) stipulates that a consumer reporting agency can not furnish an account without my written instructions. Furthermore, under 15 USC 1666B, a creditor may not treat a payment on an auto loan account as late for any purpose under an open-end consumer credit plan. In addition to the previous information, it is important to note that my request sent in XX/XX/2023 to the credit bureaus via XXXX certified mail, regarding the correction of errors in my personal information and disputes, was never answered. This failure to respond violates the provisions of the Fair Credit Reporting Act, specifically Section 611 ( a ) ( 1 ) ( A ), which mandates that credit reporting agencies must promptly investigate and correct inaccurate or incomplete information upon receiving a consumer 's dispute. The credit bureaus ' non-response is a clear violation of this legal requirement.

Consumer Complaint: I purchased a XXXX XXXX on XX/XX/XXXX, financed through GM financial, and over the last 6 months I don't believe my payments have been applied or calculated correctly. I have been requesting my account balance and interest payments be corrected since XX/XX/XXXX but have received little to no explanation or resolution. I have been paying extra on my auto loan in an effort to pay down the balance faster with the expectation that anything above the {$750.00} due, goes towards the principle and not the following month 's payment. There was some confusion in XX/XX/XXXX as the GM Financial app and my XX/XX/XXXX statement showed {$0.00} due on XX/XX/XXXX. Because of this, no payment was made specifically for XX/XX/XXXX ( a payment was attempted XX/XX/XXXX but cancelled ). After a phone call with customer service explaining my intentions to pay extra each month, they corrected my XX/XX/XXXX payment. My GM Financial app then showed a balance of {$1500.00} ( {$750.00} for XX/XX/XXXX and {$750.00} for XX/XX/XXXX ). This payment was made, as noted in my payment history. I made another {$5000.00} payment in XX/XX/XXXX. After noticing the additional payment was being applied to XXXX and calling customer service again, the XXXX payment was corrected. I made {$1000.00} payments in XX/XX/XXXX and in XX/XX/XXXX. I then noticed on XX/XX/XXXX that my GM Financial app showed a past due balance. I called customer service again and was informed they would perform an " account research '' to determine why I had a past due balance. By XX/XX/XXXX I had not been contacted about the account research so I called again. They were unable to give any further info on the account research but did inform me that my XX/XX/XXXX payment was reversed which is why my account was showing a past due balance. I reviewed my bank statements and no money was refunded to my account, from GM Financial, in XX/XX/XXXX, or any time prior. On XX/XX/XXXX I called customer service again. I was informed the account research was approved and still open but nothing further had been documented. I was also told that the past due balance was stemming back to my " missed '' payment in XX/XX/XXXX and that each payment following ( XXXX, XXXX, XXXX, and XXXX ) had been partially applied to the current month and partially applied to the previous month to cover the past due balances. My GM Financial app and my account statements did not show a past due balance until the end of XX/XX/XXXX. I have made a payment for every month greater than or equal to the balance due, therefore I should not have any past due balance. After reviewing the transaction history, I have additional concerns about the amount of interest that was charged for the first 3 months, and why my XXXX payment was applied to XX/XX/XXXX. As noted above, I have called customer service several times but they have been unable to provide an explanation or resolution to the issues I have described. I sent an email requesting an explanation to the above issues XX/XX/XXXX and received a generic 'Please contact customer service ' message. When I called customer service, they again could provide no explanation, resolution, or info on account research in progress. I followed up this most recent phone call with another email on XX/XX/XXXX and have not received a response.

Consumer Complaint: I filed XXXX XXXX in XX/XX/XXXX, and my attorney advised me to give back my vehicle since it was a bad deal! It was leaking oil & gas, and the check engine light kept coming on after SEVERAL repairs were done! Plus, it had a high interest rate so I agreed. My attorney said he would inform me & GM Financial, on making arrangements to surrender/return the XXXX XXXX. They came & repossessed the vehicle on XX/XX/XXXX while the bankruptcy was still active, then sent me a notice saying it would be auctioned on XX/XX/XXXX and I would be responsible for the balance! I did not think this was correct, and I did not like the threat of the letter! My XXXX XXXX was DISCHARGED on XX/XX/XXXX & my attorney stated I am NOT responsible for any amounts remaining! As a matter of fact, GM Financial owes me for my down payment & money spent for repairs! GM Financial also needs to return to weatherproof mats and logo tag bracket I purchased per the Consumer Rights Act repair Section 23 : Right to repair or replacement!

Consumer Complaint: Hello, I have an auto load with GM Financial. I found out today that I am 30 days past due on a payment that was due in XXXX ( XX/XX/XXXX ). When I made my last payment the GM website said my next payment was due XX/XX/XXXX. It misadvised me because there was really a payment that was due XX/XX/XXXX that hadn't been made yet. I logged in today thinking I was 1 day late and I was really 30 days late. I called the company and pointed out that their website showed that my next payment was due in XXXX and not XXXX. They admitted that the information was wrong on the phone ( talked to XXXX XXXX on XX/XX/23 @ XXXX XXXX ), however, they refuse to make sure it doesn't impact my credit or remove any late fee. I made the payment immediately but their website is clearly misadvising consumers and misleading them - leading to increased late payment revenue for their company. I attached a picture showing the misleading information. Today is XX/XX/XXXX. I thought I had a payment due XX/XX/XXXX ( 1 day late ). The website says payment is 30 days late ( would have been XXXX payment I didn't know about ) - then it says my next payment isn't until XXXX. It says NOTHING about my XXXX payment - that was due yesterday. Extremely misleading and unethical. Something needs to be done to stop this from happening to consumers. It is gross misrepresentation and I would argue illegal to mislead consumers like that. All I want is GM Financial to quit misleading customers and do the right and ethical thing when they mislead someone.

Consumer Complaint: During or prior to me being called for XXXX XXXX service, I purchased a vehicle, financed by GM Financial. I, at the very least, made one installment payment before I was called on XXXX XXXX. During or while our I was serving on XXXX XXXX, GM Financial unlawfully repossessed my vehicle without a court order. Accordingly, GM Financial is subject to civil and or criminal penalties arising from a violation of the SCRA. On XX/XX/, I sent a letter to GM Financial ( through counsel ) explaining my position and demanding a resolution including a plateau of military orders as supporting documentation. On XX/XX/, GM Financial sent me a letter ( through counsel ) stating that they relied on the XXXX database verify XXXX XXXX time ; however the XXXX does not cover periods of XXXX XXXX time performed by reserve servicemembers. Therefore, upon request, I provided GM Financial additional copies of military orders on or around the date of repossession and for one year prior as they indicated they would reevaluate their findings.
