According to my records, the statute of limitations for this debt has expired, and as such, it should no longer be reported on my credit report. This account was settled in XX/XX/2016. Consumer Complaint: GM Financial has made my life a living nightmare over the past month. They have been harassing me and extorting me for money over an alleged debt for an auto loan. The account has been showed as paid off on my consumer report since on or around XX/XX/. On XX/XX/XXXX, they conspired with a towing company and stole my vehicle at my residence. I am in possession of the title for this vehicle lien free with them released as lien holder as of XXXX XXXX PLEASE SEE ATTACHED IN-DEPTH COMPLAINT AND SUPPORTING DOCUMENTATION. NOTICES HAVE ALSO BEEN MAILED TO COMPANY VIA USPS CERTIFIED MAIL and Fax.

Consumer Complaint: Per the FCRA, I am a federally protected consumer. According to the law, consumer reporting agencies are to exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. XXXX and XXXX are classified as consumer reporting agency, and I by definition am the Consumer. Pursuant to 15 U.S Code 6801, it is the policy of Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. GM FINANCIAL per 15 U.S Code 6801 is defined as a financial institution ; of which I am sure the U.S. Department of Justice, the U.S. Department of Housing and Urban Development, the U.S Securities and Exchange Commission, and the Office of the Comptroller of the Currency [ would ] consider any information that this institution engaged in illegal credit practices before the end of the institutions next performance evaluation. GM FINANCIAL is in violation of 15 U.S Code 1681a ( 2 ) ( A ) ( i ). GM FINANCIAL is under the regulation of many laws and as previously mentioned one of those is the FCRA, which states the term consumer report DOES NOT INCLUDE any report containing information solely as to transactions or experiences between the consumer and the person making the report. Pursuant to 15 U. S Code 1681c ( a ) ( 5 ) the publishing of any adverse item of information should not be on any consumer report. It clearly states except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information. Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This is a violation as they are reporting these items without my permission. 15 U.S Code 1681e states every consumer reporting agency shall maintain reasonable procedures designed to avoid violation of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title.

Consumer Complaint: I was given payment arrangements and call to reschedule a payment for XX/XX/XXXX! I was granted the request but was never told that my vehicle was in jeopardy of being repossessed. They repossessed the car without my knowledge before the scheduled payment. I never received any type of letter they say they mailed a letter on XX/XX/XXXX and I have not received it yet! I have 10 days to pay the car off or it will be sold. They apologized for their error but said its nothing they can do.

Consumer Complaint: Gm financial has a Very slow billing system that doesn't update properly doesn't account for payments doesn't show all payments, Doesn't provide an accurate balance... The customer service is generally grossly incompetent with absolutely no follow up from this company about anything... They waste your time and essentially dismiss your concerns. This company 's policies and procedures essentially is consumer abuse... I would add that in the past their statements had no information at times But insisted there was nothing they could do... I have absolutely no confidence that this company will do anything about any complaint...
