Issue: Attempts to collect debt not owed
Subissue: Debt is not yours
Consumer Complaint: Im not sure who to take this to anymore, but Ive disputed this account several times with both the original creditor and the credit reporting agencies accordingly and Ive attached everything to support my dispute. However, I continue to receive a pre-template letter sent to me that its been CORRECT & VERIFIED?. How is it possible that this was verified if you continue to report incomplete, inconsistent, inaccurate, and unverifiable information on this account and a thorough and in-dept investigation? Im really worried that some of the information on my credit report on this account may be reported inaccurately. I understand that you must have procedures in place to respond to questions about credit reporting. It looks like some of the details that you guys are reporting arent true. For example : Account Type shows Auto Loan when I thought the correct term for this alleged account was credit sale. Anyway, can you please help me understand whats going on? Id like to see the following documents so that I can compare them to the information on my credit report. I would appreciate a thoughtful response from your office. Please dont send me an unintelligible response that doesnt address my concerns. Heres what Id like to see : 1. The complete original alleged promissory note that shows my signature 2. The account transaction history 3. Any required default or acceleration notices 4. The notice of sale document 5. The Calculation of Surplus or Deficiency letter 6. Any additional finance contracts including those related to insurance or finance products 7. The buyers guide 8. The purchase order 9. Any license, bond or registration document required by the state that allows you to hold or service this alleged promissory note

Consumer Complaint: I'm not going away! I'm filing a complaint with the state AGs office and directly to the CEO and President of GM. All GM has to do is step 1 ... prove that they sent the required notice of intent to take possession of the vehicle and that it was sent overnight with a signature requested. They can't do that because they never notified me! They can't do that because they didn't follow UCC regulations! They can't do that because they are sending form letters about ID theft and repeat requests. Well, I wouldn't have to do a repeat request if GM wasn't selective in what documents they want to provide. The first letter said " based on the information you provided ... this may be ID theft. '' I asked for debt validation - STALL TACTIC! The next three letters said, " no specific item was requested for validation ''. Well, I sent a whole list! What is nonspecific about : Please provide copies of the legal notices and proof of the commercially reasonable manner of the resale of the subject vehicle. If no such proof is provided within 14 days from receipt of this notice, the alleged claim of a deficiency will be considered null and void, and any continued collection activities or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA.In addition, if you singularly or severally fail to comply with the above requests, I reserve the right to seek damages against all parties, under all available State and Federal statutes and UCC - 9 remedies. Auto Purchase Plan Agreement Credit Application ( to corroborate the identity of the alleged debtor ) Sale Invoice ( to corroborate claim amount of alleged debt ) Vehicle Invoice ( to corroborate consistency of claim amount of alleged debt ) Retail Certificate of Sale ( to corroborate parity between sale amount and claim amount ) Payment History providing evidence of payments including last payment date and Charge-off Date ( to corroborate actual debt owed net any payments ) Vehicle Title XXXX Letter Repossession Assignment ( initial ) Any subsequent Repossession Assignments Repossession reassigns Account Profile/Repossession Approval Repo Check Sheet Notification Letter to Report Derogatory Status to Credit Bureaus Notice of Repossession/Right to Redeem with any additional fees ( e.g. Recovery fee ) to reflect Legal requirement to notify me personally, or by registered or certified mail at my last-known address, within 24 hours of such repossession. Notice of Plan to Sell Property at a Private Sale ( Notifying me of the time and place of a public sale and/or of the time after which a private sale has taken place ). Letter of Private Sale ( Disclosing Purchase price of buyer ) Total Loss Protection Assurance ( Covers the loss of the entire car minus any payment obligations until submission of claim ) Post-repossession assigns/assignments/assignment agreements Debtor Notification of Assignment pursuant to Bill of Sale for the sale of any chattel paper or payment intangibles relative to the debt This is total XXXX! They didn't follow the law and CFPB its time for you hold them accountable!!

Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE
