Consumer Complaint: I purchased a new car utilizing GM Financial Funding in XX/XX/XXXX. From the start of my loan ( specifically the from the first monthly P & I payment ) I made timely payments ( including additional funds above my agreed payment amount the life of my loan. On XX/XX/XXXX the new vehicle I purchased in XXXX was involved in a total loss after my car was struck by another car. Shortly following the accident I reached out to GM Financial and indicated that I had been involved an in accident and I wanted to make them aware. As one would with an accident, I filed a loss claim with my insurance company who settled my total loss claim in XX/XX/XXXX, at which time funds were sent to GM Financial directly from the carrier in the amount of {$23000.00}. This was followed by a claim filed with my gap insurance company, who issued a payment of {$5700.00} issued directly to GM Financial. Lastly, I cancelled a dealer service contract translating into another check in the amount of XXXX. This check too was sent directly to GM Financial. During a discussion with two separate regarding overage payments made during my loan period, it was advised that I could obtain a payout of my overage. Please note since my first principal and interest payment in XX/XX/XXXX I paid over and above my agreed upon note payment amount, causing a surplus. The GM Financial associates I spoke with on two separate occasions In early XX/XX/XXXX quoted me two different amounts in which would be released. The second associate indicated the first associate I spoke with was releasing too little. I made it clear that I wanted to endure all incoming funds ( listed above ) would account for my full loan amount. In XXXX I received an overage payment which I believe led to me having an owed balance which GM Financial applied interest to - now requiring me to pay $ XXXX now - and which has been reported causing adverse action to my credit report. This all after I not only paid on time but over and above the amount owed monthly. I had a great experience with the purchase of my vehicle and would have suggested GM Financial to others. However this attitude of unaccountability is off putting. This is how you treat customers who have gone above and beyond the agreement. Additionally the folks I have spoken to in their customer care or loss/charge off area - continue to not listen or help. They rather keep telling me that $ XXXX is owed. Really {$200.00} is worth losing a customer. The last associate told me they do not have a complaint department, after being told that I could submit a complaint on their website. I was told on XX/XX/XXXX that all they do is log it but there is no one I could speak to or a complaint department. Rather I needed to talk to them because I owed money. XXXX down the tube to a company that is hounding me for {$200.00} that they released {$90.00} in error and charging me $ XXXX in interest.

Consumer Complaint: GM Financial XXXX. XXXX XXXX XXXX, TX XXXX. XXXX : GM Financial Account XXXX and RE : XXXX. FOR : 68 FEDERALLY PROTECTED CONSUMER RIGHTS VIOLATIONS UNDER 15 USC 1692, 15 USC 6802, 15 USC 1611, 15 USC 1635a and 15 USC 1692.. On XX/XX/XXXX, I, XXXX XXXX and XXXX XXXX are the consumers, Creditor-Seller. We never got a loan, we entered into a consumer credit transaction with XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, MD XXXX and GM Financial. As the Creditor and nature person we were violated of our rights in the retail installment sale contract simple finance. The contract listed XXXX XXXX XXXX as the Creditor-Seller. In pursuant to 15 USC 1602g the name and address listed on the contract is in violation. We, the consumer, Creditor-Seller were taken advantage of our consumer 's rights. In pursuant to 15 USC 1605 the determination of finance charges are in violation. In pursuant 15 USC 1611 this contract gives false and inaccurate information. In pursuant to 15 USC 1635 we were never provided a form for the right to rescind during our consumer credit transaction onXX/XX/XXXX. In pursuant to 15 USC 1692 the abundant of evidence of the use of abusive, deceptive and unfair debt collection practices by these debt collectors are appalling. Immediately, after we entered a consumer credit transaction GM Financial start sending us GM Financial account statements in contents of a letter, sometimes with a bright red color to the eyes of an adult and in which they never indicated that the communication relates to the collection of a debt. Which was embarrassing to have delivered to our home for other people to see. We received these GM Financial Account Statements every month from XXXX to XX/XX/XXXX. Approximately a few weeks ago GM sent me a copy of our Retail Installment Sale Contract Simple Finance Charge after I called to ask who gave them the permission or clearance to share our personal information with XXXX, XXXX and XXXX without our written permission. Also, to mention we were never provided the opportunity to opt out in pursuant to 15 USC 6802. In pursuant to 15 USC 1692e this contract is deceptive or misleading representation and caused us the consumers emotional distress. On XX/XX/XXXX I forward GM an affidavit of truth and invoice for 11 Federally Protected Consumer Rights Violations Under 15 USC 1692. On XX/XX/XXXX I submitted a complaint with CFPB in regards to our privacy being violated. On XX/XX/XXXX a XXXX XXXX from Americredit sent us what appears to be a letter from GM Financial Central Fraud and again our consumer 's rights to privacy was violated. CFPB complaint XXXX and the wording in this letter is very overwhelming to read. This sale contract simple finance charge has been breached. Enclosed is a copy of the cease and desist, invoice, 3 affidavit of truths. One affidavit was submitted in a previous complaint. One affidavit from the Creditor-Seller XXXX. XXXX and other affidavit from the other Creditor-Seller XXXX XXXX included in the consumer credit transaction. Proofs of violations including exhibits from pages 1-57, and other pertinent documents to show that GM Financial are using third party debt collectors to harass us.

Consumer Complaint: I would like to file a complaint with your office against repeated failures by GM Financial Leasing ( GM Financial ) to explain and correct billing errors over a two-month period, wrongful reporting to of an adverse credit event to credit agencies and hurting my otherwise stellar credit scores, and predatory lending practices by daily collection and harassment calls made by collectors from GM Financial to my cell phone number. I leased a new XXXX XXXX from GM Financial on XXXX, XXXX for a term of 3 years ( the Lease ). During the term of the Lease, I made monthly payments as requested on time every month via bill pay service offered thru my bank, XXXX XXXX XXXX XXXX XXXX ( Bill Pay Service ). GM Financial was responsible for making all property tax payments to the Town of XXXX as an owner of the vehicle and charge the same to me. At no time during the Lease was I informed in writing or otherwise that the applicable tax payments were not made or not made on time, and to the best of my knowledge, I have made all such payments promptly as requested by GM Financial. On XX/XX/XXXX, I received the last statement for my Lease ( attachment1 ). On XX/XX/XXXX, I made my last lease payment of {$320.00} to GM Financial via my Bill Pay Service ( attachment2 ). This left me with a XXXX balance on my account when I checked my account balance online on GM Financial 's website. In mid XX/XX/XXXX, I received a phone call from a GM Financial rep, stating that I have an outstanding balance of {$2200.00}, with no explanation of why I have incurred these charges. I checked their website and indeed found an outstanding balance of {$2200.00} with no explanation ( attachment3 ). I called the contact number on the statement immediately, spoke with a GM Financial customer service representative, and asked for an itemized explanation of the outstanding balance in writing. None was provided and there was no follow-up calls from GM Financial. Since then my husband and I have made numerous calls to GM Financials with the same request. To date, GM Financial has failed to satisfy our repeated requests. Starting in XX/XX/XXXX, I have been receiving 3-4 phone calls per week from GM Financial collectors asking for immediate payment of the outstanding balance and threatening to report me to the credit agencies. At every one of these collection calls, I have explained that we have not received a written description of charges. I have been given verbal description of some of the charges but this description changes with each phone call. On one or more of such harassing calls, I was told that most of outstanding amount ( including interests ) results from a bankers check that was bounced some time in XXXX. At no time was I informed in writing of such incident during the term of the Lease or thereafter either by GM Financial or my bank XXXX. I have separately confirmed from XXXX that the check in question was cashed ( attachment4 ). This is clearly a billing error by GM Financial but they have refused to correct the error. I am outraged by such unsavory and predatory lending practices by a heavyweight like GM Financial. One would think they should know better, and they clearly dont. I have filed a complaint with the state consumer protection agencies, and I would like to request CFPB launch an investigation of how widespread such practices are and how many consumers are negatively impacted. In the meantime, I have filed a dispute with the credit agencies regarding the same matter.

Consumer Complaint: I contacted GM Financial 3 to 4 times letting them know that I had lost a part-time job due to COVID-19 and that I was suffering a hardship. The first reply I received was asking if I had received a stimulus check and their were not any programs to help me, then they repossessed my vehicle the night before I had to go to work, leaving me stranded. Now I've had to pay them all back monies owed plus the fees for the repo. Now I might lose my house!!!!! Thanks GM

I, XXXX XXXX and XXXX XXXX are the consumers, creditors, and sellers of the GM Financial account. We did not enter a consumer credit transaction with XXXX XXXX with Americredit. In pursuant to 15 USC 1681b and 15 USC 6802. We did not give GM financial institution permission, consent, nor the clearance to disclose our personal information to a nonaffiliated third party. In pursuant to 15 USC 1692c. ( c ) I am demanding that XXXX XXXX and staff at Americredit cease all forms of communication with us through any and all mediums. In pursuant to 15 USC 1692d ( 2 ) stop harassing us. These abusive practices are a violation of 15 USC 1692c ( b ) .This is an infringement of our rights to privacy and it is causing us emotional distress. This letter included obscene language that was abusive and harassing to us. Enclosed is a copy of the cease and desist, the letter sent from XXXX XXXX and the certified mail receipt.

Consumer Complaint: Gm Finanial approved me for a vehicle loan on XX/XX/XXXX for XXXX XXXX XXXX XXXX with a {$500.00} dollar down payment and signed contract!!! After completing the deal and given the keys for the vehicle I brought my vehicle home everything was good!! I then recieved a text message from my salesman on the XXXX regarding my vehicle stating the bank needed 2 years of tax returns from me to complete my loan!!! At that time I ask him what he was talking about he then told me he was with a costmer and couldn't talk!! So I sent a text telling him to have a manager call me!! I didnt recieve a call until 3 days later when a manager named XXXX called and said I had not been approved and needed to return the vehicle and he could get me in a vehicle of XXXX dollars less value!! I informed the manager he could not do that per federal law he got mad and started yelling that I better return the vehicle right then or else! I hung up and called the police! The next day XXXX from XXXX XXXX contacted me via email to demand tax returns and I advised him that I had called the police and not to contact me again that I needed the owner or general manager to call me immediately!! I did not hear from the GM for over a week! At which time XXXX the manager for XXXX XXXX had sent me a document from GM Finacial that showed completely different loan information on it than the installment agreement I signed with a change of status to returned due to unable to verify 2 years of employment! This also didnt make since as I had provided 2 years of bank statements a XXXX tax return check stubs all to XXXX XXXX prior to the sale of the vehicle! I had obtained an approval email from my salesman on the XXXX of XXXX and I was never told about the change in contract the descepancy in length of loan and interest rates or the discrepancy in the amount of the loan which has over a XXXX dollar difference in the payment and finiace rate for the length of loan and no explanation as to where that XXXX dollars is! The documentation recieved from the dealer shows a fradulent car deal done purposely to commit criminal theft of money from me and the intent to have never intended to up hold the agreement!

Consumer Complaint: XX/XX/XXXX - and XX/XX/XXXX I wrote each credit bureau and asked them to verify the debt. I don't recall getting a response or updated credit report as requested so I sent a letter directly to GM. On XX/XX/XXXX I asked GM for debt validation because they were reporting a charged-off account to credit bureaus. As a result of doing some research, I learned that XXXX laws may not have been followed making this reporting unverifiable and inaccurate. I faxed a debt validation letter to GM ( attached with proof of fax delivery ) and after 30 days I have not had a response from GM or from XXXX XXXX or XXXX and the account in question is still being reported ( I saw the information on both MyFICO and Identity XXXX ( attached ). I want this deleted because ( 1 ) the GM reporting is inconsistent or incomplete ( 2 ) GM did not respond in 30 days AND ( 3 ) GM provided no documentation they met XXXX laws.

Consumer Complaint: I had autopay turned on at GM Financial and had made timely payments throughout the lifecycle of my lease. At my lease termination, I had returned my car and closed the account as the account was paid in full. Couple months later I found out that someone had added on {$36.00} fees without notifying me after autopay had paid off the account in full. 3 months later I find out through my credit report that I now carried a balance. I called GM Financial and even they were surprised stating this was the first time they had seen this either. However, no action was taken after I submitted 2 complaints and had 2 phone calls with them. It now shows that someone had closed out the account to cover their tracks but left the errors still showing on the account so now I have proof of their errors and evidence of hiding their tracks. This is a disaster of company operations and GM Financial should be held accountable. I can't imagine how many others are being affected by this as well.
