Issue: Problems at the end of the loan or lease

Subissue: Excess mileage, damage, or wear fees, or other problem after the lease is finished

Consumer Complaint: I returned the leased car on XX/XX/XXXX to GM financial. In XXXX I received a letter stating that I owed {$1100.00} for excess wear and tear, ending lease fee, etc. I called GM Financial and they agreed to give me a discount so that I now owed {$910.00}. I was told that they would be sending out a new bill with the NEW amount owed on it. A few days later I received a letter saying that I owed the same amount. I tried to call back, but could not get through to anyone. Then at the beginning of XXXX, I got an alert on my credit report that I was reported to be 30 day late on a payment to GM Financial. I immediately called and they told me that when I called in XXXX, they " verbally '' told me that they couldn't send out a bill with the corrected amount on it, which they never said. Before I hung up, I paid the balance. I am not worried about the payment I had to make, I am concerned with my credit score losing 80 points because of their lack of communication. I tried to explain to the manager that I am a loyal customer of 4 years. I've had two cars leased through GM Financial and STILL have a lease and a loan with them. I have never missed a single payment. I want the 30 day late payment taken off my report and they kept telling me they couldn't do anything about it. Please help.

Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, FL XXXX ( XXXX ) XXXX ACCOUNT # XXXX On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. GM FINANCIAL XXXX XXXX XXXX XXXX, XXXX, TX XXXX ( XXXX ) XXXX, ACCOUNT # XXXX On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. CREDIT AGENCIES AGREE TO WAIT BEFORE ADDING MEDICAL DEBT TO RATINGS XXXX XXXX XXXX XXXX XXXX, XXXX Account # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Account # XXXX At this time I make the claim that the medical debt procured against me on any or all credit reporting agencies, should be deleted permanently. Too many consumers have learned the hard way that their credit rating can be tarnished by medical bills they may not owe or when disputes delay insurer payment. That should change under new policy agreed to this week by the three major credit reporting agencies. The agencies say they will establish a 180-day waiting period before medical debt is added to someones credit report. In addition, the agencies agreed that when an insurer pays a bill, the debt will be promptly removed from the consumers credit report, unlike certain debts that remain for years. The changes are part of a settlement between the credit rating agencies XXXX, XXXX and XXXX and the New York Attorney Generals office that aims to improve accuracy and enhance procedures for disputing credit report errors. The agreement covers consumers across the country. The three agencies gather information from banks and collection agencies about consumers credit such as payment history and how much someone owes to credit score for more than 200 million individuals throughout the country. A persons credit score is used as a measure of credit worthiness, and can influence peoples ability to get loans and the interest rates they are charged, among other things. This is going to help millions of people access more affordable loans, says XXXX XXXX, a principal at community Health XXXX in XXXX XXXX, XXXX. People will no longer be penalized for having a medical bill slip past them and get on their credit report even though the bill gets paid. Insurers sometimes wrangle with patients and providers for months before paying a bill. The new six-month waiting period will give consumers time to resolve such disputes, XXXX noted. Medical debt accounts for more that half of the collection items on credit reports, according to a report by the Consumer Financial Protection Bureau. Among people facing collection for only medical debt, about half have otherwise clean credit reports with no sign of past debt collection problems. On these subscribers that are reporting the affixed information, I am requesting full validation such as, original transfer rights to collect, confirmation of legal timeline to report on credit and/or collection procedures, validation of licensing requirements, posted bonding requirements, oversight on monthly payment histories, proper subscriber agreement compliance with credit reporting agencies, and overall compliance with all Fair Credit Reporting Act and Fair Debt Collection Practices Act bylaws as mandated by federal laws. If all of these requirements are not in order, then I have the legal right to request the deletion of this tradeline accordingly. This letter is addressed to the subscriber furnishing the information on my credit reports, and if this letter is addressed to any credit reporting agency, then it is considered a ghost letter mirroring the actual request for documentation of a credit trade line I may have issues with. It is my understanding that each credit reporting agency has an obligation to maintain accuracy within the banking/credit community, and I will fulfill my obligations to work within the credit system as it was designated. Thank you for your full consideration in this matter. Sincerely, XXXX XXXX XXXX XXXX

Issue: Problems at the end of the loan or lease

Subissue: Problem while selling or giving up the vehicle

Consumer Complaint: GM Financial has put a 30 day late delinquency on the disposition fee of the return on my lease. I had returned the vehicle on XX/XX/XXXX. My account was put on auto-pay, but was not aware that they had removed my auto-pay information after the vehicle was returned. I had a 3 year lease for a XXXX XXXX XXXX. During this time, we had moved to another apartment after the vehicle was returned not receiving the latest letters from GM Financial. I did receive a call that I do not have recollection of in the middle of XXXX as my family and I were dealing with COVID exposure and quarantining for 2 weeks. The balance was settled on XX/XX/XXXX, 2 days after the apparent 30 day bill in the amount of {$430.00}. I was never late on any payments throughout the lease and did not have insufficient funds. I was under the impression this would be automatically taken out, however this was an unfortunate miscommunication and timing.

Issue: Problem when making payments

Subissue: Problem during payment process

Consumer Complaint: I was a with GMFNANCIAL customer since 2017 and during that time, I have enjoyed my experience greatly. I am writing to see if you would be willing to make a " goodwill '' adjustment to your reporting to the three credit agencies. I have late payments on the above referenced account ( XXXX, XXXX, XX/XX/2017 ). Since that time I was an exceptional customer paying every month on time. Because of my exceptional payment history over the last years, I would like you to consider removing the negative payments from my credit report. At the time of the late payments, I was in the process of changing jobs. I say that not to justify why the payments were late, but rather to show that the late payments are not a good indicator of my actual credit worthiness.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: DEAR GM FINANCIAL SERVICES ; I was shocked when I reviewed my credit report this week and I found multiple inaccuracies on my credit report from the 3 major credit bureaus from a collection company that I never have dealt with before. I've attempted several times to ratify the issue with the original creditors and credit bureaus and they still reporting inaccurate, unverifiable information. I have disputed this item with the credit reporting agency and they reported you confirmed the account as valid. I honestly do not believe to ever have any relationship with this collection agency or original creditor. Also there are several inaccuracies with this account the way it's reporting and that's a total violation of FCRA and FDCPA laws and regulations. In a good faith effort to resolve the matter amicably, I must demand proof of this debt, specifically the alleged contract or other instrument bearing my signature, as well as proof of your authority in this matter. Absent such proof, you must correct any erroneous reports of this past debt as mine. I am writing to request that you please provide the following information : 1. Please evidence your authorization under 15 USC 1692 ( e ) and 15 USC 1692 ( f ) in this alleged matter. 2. What is your authorization of law for your collection of information? 3. What is your authorization of law for your collection of this alleged debt? 4. Please evidence your authorization to do business or operate in this state. 5. Please evidence proof of the alleged debt, including the alleged contract or other instrument bearing my signature. 6. Please provide a complete account history, including any charges added for collection activity. You have 30 days upon receipt of this letter to provide strict proof of contract. In the event you can not provide strict proof of contract, you must cease and desist any and all collection efforts and immediately remove any derogatory information reported to the consumer reporting agencies. In addition, you will need to provide me your agreement, in writing, that you are closing your file, ceasing collecting activity, and deleting all information related to this reference number from any and all credit reports youve furnished the information to. In the event you transfer this account to an attorney without providing proof of contract, and proving your claim, he/she will be immediate reported to the XXXX XXXX XXXX and XXXX XXXX XXXX for code of ethics violations.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: GM financial has refused to remove an inquiry that got on their system from identity theft. GM financial is claiming they got permission from the dealership but I never gave the dealership permission to even submit my information to GM financial. GM financial is now refusing to try to work with me to get this removed. I want GM financial to deal with the actual issue that they pulled my credit with no permission from me therefore by law they have to remove it nobody else can do that.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: In XX/XX/2020 my lease with GM Financial ended. The leased vehicle was grounded at the local GM dealership on XX/XX/2020. In XX/XX/2020 I received notification from GM financial of the remaining balance due on the account. It included a grounding fee that I believed to be incorrect as the dealership indicated they would purchase the vehicle and I would not be charged a grounding fee. I worked with GM Financial and explained this issue and in XX/XX/2020 I was given a 30 day deferment on payment in order to work with the dealership and continually told that I could defer payment while I worked with GM Financial and the dealership to resolve the issue. However, due to the COVID-19 Pandemic, it was impossible to discuss this with someone at the dealership and I was not able to reach anyone by phone. In XX/XX/2020 I spoke with the agent explaining the issues. I indicated that I would be mailing an initial payment soon thereafter and then setting up recurring payments to take care of the balance within the 12-month repayment window. In XXXX, I was notified by a credit monitoring service of a late payment on my credit. I immediately called GM Financial and was told by the representative that GM did not issue a late payment flag on my credit. I left it at that and continued to make payments, paying off the full balance in XX/XX/2020. I contacted GM Financial on XX/XX/2020 to try and resolve the issue and have the late payment flag removed, however, the agents indicated that they could not do this as the payment was late. The request was made to GM Financial on the grounds that there was significant confusion by the representatives based on the deferments and the fees charged and who the responsible party was for those fees ; the fact that a global pandemic had resulted in closure of most businesses and the inability to discuss this issue with the dealership in a timely manner ; financial impacts to my family due to reduced income ; a clean payment history for the life of the lease ; and the complete payment of all charges and closure of the account. I believe it to be unjust to flag my account with a late payment given all of these factors and I believe GM Financial to be in the wrong given the confusing and misleading information that was provided to me despite my continued effort to work with them and provide them accurate and timely information. I believe that GM Financials predatory nature during a time of global financial instability and their poor training for customer service representatives led to the confusion that resulted in a late payment.
