Issue: Problems at the end of the loan or lease
Subissue: Unable to receive car title or other problem after the loan is paid off
Consumer Complaint: We leased a XXXX XXXXXX/XX/XXXX from XXXX XXXX XXXX in XXXX Nebraska, it was a 3 year lease. The vehicle was financed through GM Financial account number XXXX under XXXX XXXX. In XX/XX/XXXX we decided to purchase the vehicle and went through our bank, XXXX XXXX XXXX XXXX XXXX for the financing. This was completed on XX/XX/XXXX. Our GM Financial account shows it's paid in full however we have tried to get plates on the vehicle and the Nebraska DMV shows their is a lien on the account. We have contacted GM Financial several times and was told there was not a lien and they would send us a letter stating this. We received a letter ( attached ) but it only states AmeriCredit was acquired by General Motors Company. We need GM Financial to get this corrected so we are able to register this vehicle.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: The account with GM Financial for {$3700.00} and reporting as 3 charge offs is inaccurate. This account is in regards to a XXXX XXXX XXXX XXXX XXXX that I leased through GM Financial on XX/XX/XXXX. This lease was set to terminate in XX/XX/XXXX. I traded this vehicle at XXXX XXXX XXXX XXXX in XX/XX/XXXX for a XXXX XXXX XXXX. The vehicle was left with XXXX XXXX XXXX at this time. Recently, I have been working towards repairing my credit in the hopes of obtaining a mortgage in the next few years and upon reviewing my report I noticed that I still had a balance remaining with GM. I reached out to GM on XX/XX/XXXX to inquire about the remaining balance as I thought it was rolled into the loan for my XXXX XXXX XXXX and the balance was higher than the remaining balance when I traded the vehicle in XX/XX/XXXX. I spoke to multiple people who all informed me of different reasons as to why the balance was so much higher than when I traded the vehicle in XX/XX/XXXX. I was told by one person that the balance was the remaining lease payments plus depreciation. Another person told me the balance was due to excessive wear and tear on the vehicle. Another representative for GM Financial informed me that I was responsible for the entire value of the car, which was $ XXXX, and the balance was the difference between what the car actually sold for at auction ( the car was sold on or around XX/XX/XXXX ). I requested an itemized bill as proof of validation of this balance since I had received so many different reasons as to why I had a remaining balance but was denied. On XX/XX/XXXX, I called GM Financial again and spoke with XXXX, ID # XXXX. I again asked for an itemized bill as validation of the remaining balance be mailed to my home address. XXXX advised me that the already sent me a validation and for legal and liability purposes that GM will not send more than one letter. However, she can go over the reason for balance with me over the phone or mail me a balance due letter. I asked again for an itemized letter be mailed but she refused to send me one because in her records one had already been sent. I asked her when the letter was sent and she explained that she actually does not have a copy of the document in my account but it is typically sent within 30 days of the vehicle being sold and it can take up to 90 days for a copy of the itemized bill to appear in my record. I advised that the vehicle was sold at auction in XX/XX/XXXX so it had been greater than 90 days so the document should be there. She again confirmed that it was not and denied sending me an itemized bill. XXXX also confirmed that our conversation was recorded. On XX/XX/XXXX, I received a missed call from XXXX with GM Financial following our earlier conversation. I returned the call and began speaking with a gentleman named XXXX. I again asked for an itemized bill describing the balance due and XXXX explained that he had been instructed by management not provide me with this document. He states that according to their records one had already been sent to me as well as a balance due letter. He advised me that the balance due letter was sent in XX/XX/XXXX. I asked him to provide me with the date the itemized bill was sent to my address and upon review my account these is no documentation or date that an itemized letter was sent however it is typically sent 30 days after the sale of the vehicle. I asked multiple times to have an itemized bill sent to me as to why I owe the balance prior to resolving the debt and was denied multiple times. I asked XXXX if our conversation was recorded and he replied that it may or may not be.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: GM Financial illegally repossessed the vehicle without notice or warning of default, during the worldwide Covid-19 pandemic, and the company used to do so breached my peace in the commission by entering in a gated area to repossess the vehicle which is illegal in the state of Georgia. Neither GM nor the repossession company ever contacted me to resolve this issue or make me aware that there is an unresolved balance after the bankruptcy. Again, after multiple attempts to contact GM Financial, they refuse to contact me regarding this or reinstating the loan after filing for bankruptcy. GM failed to not honor my request to reinstate the loan after multiple attempts. GM Financial subsequently sold the vehicle at a private auction after I submitted both a CFPB complaint ( XXXX ) and a certified letter ( attached ) advising them of the disputed repossession and my wishes to exercise my right to a public auction. Both were ultimately ignored and GM sent a deficiency notice. Finally, all my possessions were not returned from the vehicle. In order to obtain my belongings ( nearly a month later ) XXXX and the company that repossessed the vehicle mad me sign a waiver prior to handing over and examining my possessions. The day the vehicle was repossessed, I withdrew {$4000.00} out of my checking account ( copy attached ) which was still in the vehicle at the time of repression that was not returned. Additionally, other items including my {$500.00} radar detector, a broken iPad along with other business property, checkbook, and wheels were not returned from the vehicle causing a further financial loss after GM Financial decided not to work with me. As shown in the pictures ( attached ) from the dealer who now has possession of the vehicle, personal items including the bracket where my radar detector once sat and my {$3000.00} wheels are still in the vehicle. I am requesting GM Financial settle this matter and return my possessions, otherwise, legal action will ensue for the value of the items not returned, the deficiency balance of more the {$25000.00} due to not honoring buy wishes for a public sale, and ultimately, the illegal repossession that occurred.

Issue: Struggling to pay your loan
Subissue: Loan balance remaining after the vehicle is repossessed and sold
Consumer Complaint: On or around XXXX of XXXX my vehicle was repossessed by company GM Financial. After the vehicle was repossessed I was never contacted nor given any information as to the whereabouts of the vehicle. Not being notified nor given the information made it a problem for me to either get the vehicle back or collect all of my belongings from the vehicle. As stated by both Maryland ( state vehicle was purchased ) and North Carolina ( state of repossession ) : Under the laws of the State of NC ( State of repossession ) : Before reselling your vehicle, the repo company and or creditor must provide opportune time to redeem the vehicle and/or possessions prior to being sold at an auction. Before selling the vehicle at a public sale, the creditor must notify you of the date, time, and place of the sale. You may attend the sale and bring bidders if you want. If the creditor sells your car at a private sale, the creditor must notify you of the date after which the car will be sold. Under the Laws of the State of MD The Maryland Department of Labor ( State of vehicle purchased ), a creditor may issue a Discretionary Notice at least 10 days prior to repossessing the vehicle to all signers on the loan by personal delivery or by certified or registered mail. You are not required to pay any repossession expenses if the creditor failed to issue you a XXXXiscretionary Notice. Also, send a Required Notice to you by registered or certified mail within 5 days after the repossession of the vehicle and retain the repossessed vehicle for 15 days allowing you the opportunity to reinstate the contract. I was never given any information now was I contacted about the above info. On XX/XX/XXXX I sent out a letter ( certified mail by USPS ) in order for company GM Financial to provide me information in support of the above information in which they received this letter on XX/XX/XXXX at XXXX XXXX Today is XX/XX/XXXX, and I have yet to receive any information from the above company GM Financial. I have disputed this information with all three major credit bureau and have yet to receive information from anyone concerning this matter.

Consumer Complaint: I was looking through my report and noticed a vehicle that I returned to the dealership where it's reporting completely incorrect. I had the opportunity to talk to several lawmakers and friends, and learned some basic laws in regards to voluntary or repossession of a vehicle. Under the laws of MASS and UCC 9.506 as well as State RISA and MVISA statutes, a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. PLEASE HAVE THEM IMMEDIATELY REMOVE

Issue: Problems at the end of the loan or lease
Subissue: Problem extending the lease
Consumer Complaint: Due to Covid and unfortunate family circumstances, we held the car past the lease term ending XX/XX/2020, but continued to make monthly payments to show good faith that we were extending the lease. Never once was my payment rejected or returned for the next several months. GM issued an order of repossession in XX/XX/2020 to get the car back, but this repossession had nothing to do with a financial obligation. Our credit report indicates we owe a balance. As this was a lease with no payout due at the end of the lease term, there is no balance due, merely the car was to be returned and that is why GM supposedly " repossessed '' the vehicle.
