Consumer Complaint: Per FCRA laws, due to multiple reporting innacuraccies, I am requesting that this account be removed from my credit report. On XX/XX/XXXX, I received a response from GM Financial referencing a request by me to present a contract that has my signature of authorization. The contract was forwarded to me through the CFPB portal. When comparing the document that GM Financial has presented to the credit entry on my credit file, I have noticed multiple innacuraccies and incorrect reporting. Theys also stated in the letter that they are providing accurate information per FCRA which is contrary to the evidence. 1. The contract states that this account was established as an Installment contract which is false. This was a retail credit contract through a dealership. 2. This is not my signature, and there is no ID attached to this document to compare my signatures to. 3. The address on the contract was not mine and I've never lived there ; had GM Financial conducted any kind of real investigation they would've recognized this. 4. You reported to XXXX 16 late payments on this credit entry,, while you report to XXXX 17 late payments. ( XXXX reports no late on XX/XX/XXXX, yet XXXX reports as 30 days late in that same month of XX/XX/XXXX ). 5.You report a payment to XXXX for XX/XX/XXXX but report no payment for XX/XX/XXXX to XXXX This is inaccurate, incorrect and an a serious FCRA reporting violation. Also, GM financial has reported the terms or number of payments on this account to XXXX and XXXX as " 81 '' months, yet their contract states that the terms or number of payments is " 72 ''. I have factual based evidence that is attached to this complaint.

Consumer Complaint: My daughter purchased a vehicle through GM Financial in XXXX on her own and it was repo. in XXXX. Her vehicle us showing up on my credit reoort within my bankruptcy and I never had an account with GM Financial. They fraudulently repo. car with up to date payments on it, and refused to give her the car back. None the less it was my daughter car not mine. GM Financial also resold the car for what was owed, and they keep popping up on my daughter credit, she keep having them remove it.

Consumer Complaint: I reached out to this financial institution on numerous occasions, via phone call in XXXX of XXXX and also by via USPS Certified Mail letters. I informed this company that they have in fact violated the FDCPA ( Fair Debt Collection Practice Act ) 15 USC 1692a ( 3 ) pertaining to the alleged loan they claim I owe on my vehicle. I received no response from this company. On XX/XX/XXXX I forwarded a certified document to this company- a letter of violation, demand and written instructions along with an affidavit of truth to validate the federal law they have violated.

Consumer Complaint: In XXXX, I fell on hard times. I managed to keep up with my car payments despite not having a job for nearly 3 years. In XX/XX/XXXX, my car was repossessed. The day before I was finally offered a job. The only caveat was that it didn't start for another month. I attempted to do everything I could to prevent a repossession. Once it happened, I attempted to pay. I was told that I had to come up with money in a 10 days. I asked for more time, as I had just gotten a job. I got a pay check 3 weeks later. I planned to use ALL of it to get the vehicle back. I was {$200.00} short. I begged for an extension of another 2 weeks or even just a waiver of the {$200.00}. I was told no by everyone I spoke with. Then I was told that the car was going to be auctioned off. I was not told where the auction was being held. That would have given me an opportunity to buy the car. Eventually, the car was auctioned off, according to GM Financial. Fast forward to XX/XX/XXXX. I wanted to resolve the issue. I reached out to GM Financial and spoke with XXXX. I asked her about settling the account and having it removed from the credit reporting agencies. She stated that they do not do that and that I would have to wait for it to " fall off. '' Under the FCRA, reporting to agencies is VOLUNTARY, NOT MANDATORY. She then stated that they delete accounts that have inaccuracies. I pointed out several. The amount owed, was different than the information she stated over the phone to me. Additionally, the loss was written off. GM received their money. Furthermore, the car sold at auction. Additional monies toward the account. She had informed me that the account was old and sent to the XXXX XXXX XXXX XXXX collection agency. Then, she stated that, it was a good thing because they could " offer me a settlement lower '' than GM Financial could. I called XXXX XXXX XXXX XXXX. I spoke with XXXX XXXX on XX/XX/XXXX. She stated that she could not locate an account with my name. That GM Financial had pulled it back from them. Mrs. XXXX advised me to call GM Financial back. I did immediately. I spoke with someone and explained to her the information that Mrs. XXXX at XXXX XXXX XXXX XXXX had told me. She placed me on hold. I was on hold for about 15 minutes. The call had been transferred and I was connected to XXXX again. She indicated that while I was on hold for so long, she was working out a settlement offer for me. The offer was {$2300.00}. I told her that I could not afford that amount and asked her to send the account back to XXXX XXXX XXXX XXXX. She stated that she would not do that. Several violations of both the Fair Credit Reporting Act and the Fair Debt Collection Practices Act occurred. 1 ) 15 USC 1692b ( 2 ) 2 ) 15 USC 1692a ( B ) 3 ) 15 USC 1692e ( 2 ) A 4 ) 15 USC 1692f ( 1 ) Failure to Comply With UCC Article 9 5 ) When the repossession occurred, peace was breached. 6 ) I was not given my personal property from the vehicle.

Once my payment was processed, XXXX listed my date as XX/XX/2021 on my confirmation receipt. They used this deceptive tactic and incorrect date in order to place a " 30 days '' late on my and the co-signer 's credit report files with XXXX, XXXX, and XXXX. This incorrect information caused BOTH credit scores to drop drastically and has had a NEGAVTIVE impacts our credit reports.

Consumer Complaint: This account is involved in litigation for fraudulent practices according to my FCRA rights. I have not supplied proof under the doctrine of estoppel by silence, Engelhardt v. Gravens ( Mo ) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. Note that the collector has to stop all collection activities until it can provide all the evidence. Under the FDCPA Section 809, Validation of debts [ 15 USC 1692g ] I have the right to verify any alleged debt on my credit report and if the alleged debt is being disputed, the debt collector shall cease.

Consumer Complaint: On XX/XX/21 I sent a leter regarding inaccurate and unknown things on my credit report to this day over 60 days later I have not received a response yet. I feel like Im being taken advantage of and being ignored of my disputes. Section 611 ( a ). It is plainly stated that a failure to investigate these items within 30 days gives a reason to immediately remove those items from my credit report I has been over 60 days so they should be deleted promptly. I demand these accounts be deleted immediately or I will file for ligation due to the XXXX you caused me. My information was also impacted by the XXXX data breach and may have got into the hands of the wrong person.
