Consumer Complaint: GM FINANCIAL violated 15 usc 1681a ( 2 ) ( B ), 15 U.S. Code 1681b ( a ) ( 2 ), and 15 U.S. Code 1681 ( A ) ( 2 ). Pursuant to 15 usc 1681a ( 2 ) ( B ) any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device should be excluded from a consumer report. The definition of a credit card under 15 usc 1681is the same as it is under 15 usc 1602 ( l ) which is the term credit card means by any card, plate, coupon book or other credit device existing for the purpose of obtaining, money, property, labor, or services on credit Notice, congress said ANY card. The credit card is my social security card. This is the credit card I used to originate the consumer credit transaction I am complaining about. Under 15 U.S. Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) in accordance with the written instructions of the consumer to whom it relates. Pursuant to 15 USC 1692a ( 3 ) The term consumer means any natural person obligated or allegedly obligated to pay any debt. Wouldnt I be considered allegedly obligated to pay the debt listed below? I XXXX XXXX the consumer never gave GM FINANCIAL any written consent to report anything on my consumer report. No consent is Identity Theft. Pursuant to 15 U.S. Code 1681 ( A ) ( 2 ) An elaborate mechanism has been developed for investigating and evaluating the credit worthiness, credit standing, credit capacity, character, and general reputation of consumers.. This law is stating that our consumer reports are our reputation. Under 15 U.S. Code 1681b ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) in accordance with the written instructions of the consumer to whom it relates. I XXXX XXXX never gave GM FINANCIAL any written consent to report anything on my consumer report. No consent is Identity Theft. You reporting something on my report without my consent is negatively impacting my reputation. This is a violation to my rights. Also, the debt listed below is a bad debt, so it is definitely hurting my reputation.

Consumer Complaint: This complaint is the result of numerous actions trying to get a fair solution to this issue. There is a late payment reported in XX/XX/XXXX on the XXXX AUTO LOAN : XXXX XXXX XXXX. Account # XXXX. I am a frontline worker XXXX and essential worker. I got an extension after lease was extended. I was affected by covid-19. I was locked out of app and when I called XXXX, they told me no payments were due. I have been through a really hard situation that has a simple solution. It has affected all areas of my life ( emotional, familiar, financial life ruined, etc. ). Your company has committed multiple violations of the FCRA : - Negligence - Unfair business practices - Failing to provide online access - Failing to give deferment - Failing to send late payment insertion notice My demand is to get the late payment or the entire account removed from all credit reporting agencies.

Consumer Complaint: My lease was up with GM Financial on my XXXX XXXX in XXXX of XXXX. At that point, COVID was at the height. You couldnt get a new car and I was an essential employee so I needed a vehicle because I had to go to and from work every day. They were sending out email, which I have copies of, that were offering extensions due to COVID. Basically it was on a month by month basis. During the time, I was paying the lease in full. I wasnt deferring the payments or anything. I was paying to use the car because I needed to use it. Fast forward to XXXX of XXXX. I finally was able to go get a new lease and turn the old one in. About 3 months later in XXXX I believe, I got a letter saying I owed money because I went over the allowed miles. When I called to dispute this I was told while my lease was extended, the miles were not. The person told me you have to separately ask to extend the miles. I explained why I needed the miles and couldnt understand why I would extend a lease without extend the miles. Why would I pay $ XXXX a month to let something sit in my driveway? They said that didnt matter. I was also told this was only waived for Doctors and Nurses which was insulting because I run a business that was just as essential during the pandemic and worked pretty much 7 days a week for 3 months. I was transferred to a supervisor who said nothing I can say will change this and I owe them the money. There is no way they are waiving the fees. I am now having issues with my credit and XXXX the problems is this bill. When I called them today, the woman on the phone wouldnt budge again. Claimed I " assumed '' wrong to think the miles would be extended with the lease. I asked if there was anywhere it said the miles dont get extended and she wouldnt answer. Just kept telling me I assumed wrong. Im pretty sure no one would think that in extending a lease, which INCLUDES miles each month, that those wouldnt be a part of it. I have emails they sent out where they offer to extend leases with no problem and nowhere in the email is it mentioned that the miles are not a part of it. I think its sneaky and shady of them to not mention that because I think most people wouldnt even think of it. I reached out to a lawyer today and it was recommended I send a complaint to CFPB. Ive attached the two Emails they sent at the start of COVID. Youll notice they gladly offer to extend the lease but nowhere do they mention you have to extend the miles.

I had insurance and GM Financial has reported to the credit bureau I owe " {$15000.00} '' and added damaging remarks of 'Voluntary repossession '' and " Voluntary Surrender ''. I do not owe any money on the vehicle and I did not voluntarily surrender or voluntarily give up any vehicle. This reporting to the credit bureaus is incorrect,

Consumer Complaint: vehicle turned in XX/XX/XXXX, excess mileage. invoice never came, GM FINALLY sends out there first collection notice in XX/XX/XXXX, and has been reporting me continuously late on my credit report, damaging my credit score. FINALLY get through to GM, and request a duplicate copy of the detailed involce, as the dollar amount they are attempting to collect FAR excess the excess mileage charge. I am told " we only provide 1 detailed statement, you CAN NOT HAVE ANOTHER ONE ''. Their process for lease end charges is ABUSIVE ; they do not provide final invoice at the dealership, they mail an invoice 1 time, ( which went to the wrong address ). 6 months go by until they make a collection call,. my credit is damaged as they have been reporting negative all along ; THEN THEY REFUSE TO PROVID REQUESTED DOCUMENTATION. And the dollar amount they are now aggressively collecting 6+ months later obviously includes other charges, hidden fees ect. Multiply this behavior x how many 10 's of thousand 's of leases they have outstanding and you have your answer as to why they operate in this fashion. Please investigate not only my situation, but the general behavior of GM Financial

Consumer Complaint: To Whom It May Concern, I made my car payment on XX/XX/2021 from my mobile app but got no confirmation. The GM Financial mobile app would not allow me to take a screenshot stating " can't take screenshot due to privacy policy ''. The morning of XX/XX/2021 I tried calling GM numerous times but was unable to get through to anyone due to high call volume. I then received an email on XX/XX/XXXX that my account was 30 days late. This email told me that my mobile app payment clearly did not go through. I immediately ran to my office and logged into my GM account from my computer as I did not trust the app and paid it ( again ) as it clearly did not go through from the mobile app on XX/XX/XXXX. ( I made my XXXX payment as well at this time. ) I then called GM as well on XX/XX/2021 after making the payment from my computer and spoke with a representative who assured me that it would not be recorded as a 30 day late payment. Today, XX/XX/2021 I was notified by logging into my XXXX account that my credit score dropped by over 50 points and that GM did in fact record XX/XX/2021 as a 30 day late payment. I would like this late payment taken off of my credit report for these reasons : 1 ) I made the payment on XX/XX/XXXX on the mobile app which clearly has issues and does not allow the consumer to take screenshots as proof of payment. 2 ) I made the payment again on my computer on XX/XX/XXXX and was assured that GM does not report until the XXXX day and since the computer payment registered on XX/XX/XXXX it would not count as 30 days late. 3 ) I was given misleading information as I spoke to GM again today on XX/XX/XXXX and was told that they record on the XXXX day and not the XXXX. If I am given bad information on what days will actually affect my credit it makes it impossible to maintain the credit score I have worked so hard to achieve.

Consumer Complaint: They claim I missed my XXXX payment. Spent hours on phone. Sent bank statements showing that check was processed with check # and dates when sent and when it went through my bank. Last billing statement had 2 different payoff amounts which we were told is wrong and gave us yet another figure. Told us we needed to send payoff amount to a different address. We told them yes is with the billing statement which they said no, that's not right either. They want me to send in more money for XXXX and they owe me money now. If I send what they say they want me to send in to save my credit score I will have over paid over XXXX dollars. Help please!
