Issue: Attempts to collect debt not owed
Subissue: Debt was paid
Consumer Complaint: Subject : Cease and Desist Unauthorized Debt Collection Activities and Privacy Breach Dear Wells Fargo, I am writing to express my deep concern and dissatisfaction regarding the recent actions taken by your debt collection department in relation to an alleged debt. It has come to my attention that Wells Fargo has accessed my non-personal information in an attempt to coerce me into paying a debt for which I am not obligated. This blatant breach of privacy is not only unacceptable but may also constitute identity fraud. First and foremost, the unauthorized access to my personal information without my explicit consent is a violation of my privacy rights. Such actions raise serious concerns about the security of my confidential information and may have severe implications for identity theft. I insist that Wells Fargo immediately cease and desist from any further attempts to access my information without proper authorization. Moreover, I have discovered that Wells Fargo has added an account to my credit report without my authorization. Even if there were a permissible purpose for such an action, it is imperative to note that the consent of the consumer is still required. I want to emphasize that I do not grant consent for Wells Fargo to include any information related to this alleged debt on my credit report. This unauthorized addition is not only damaging to my creditworthiness but also a clear violation of my rights. I request, in accordance with Texas state laws and federal regulations, that Wells Fargo rectify this breach of privacy immediately. I would appreciate your prompt attention to this matter by removing any and all references to this alleged debt from my credit report. Failure to comply with this request will compel me to pursue legal actions to protect my rights and seek damages for the violation of my privacy. Furthermore, I am deeply disturbed that Wells Fargo has contacted me without obtaining the necessary consent to do so. I want to make it explicitly clear that I do not wish to engage in any business transactions with Wells Fargo regarding this matter or any other. I reserve the right to control communication with your organization, and I demand that you cease all contact with me immediately. To assist you in understanding the severity of these issues, I would like to reference specific Texas state law codes and federal law codes that are relevant to the information provided in this letter : - Texas Privacy Laws : [ Insert relevant Texas law codes ] - Fair Debt Collection Practices Act ( FDCPA ) : 15 U.S.C. 1692 et seq. - Fair Credit Reporting Act ( FCRA ) : 15 U.S.C. 1681 et seq. I expect Wells Fargo to take swift and appropriate action to address these concerns. Please confirm in writing that you have taken the necessary steps to rectify the unauthorized access to my information, remove the account from my credit report, and cease all communication immediately. Thank you for your prompt attention to this matter. I trust that you will handle this situation with the seriousness it deserves. Sincerely, XXXX XXXX

Consumer Complaint: The funds in the trust account became mine as of XXXX XX/XX/2024. I filled out all requested forms, notarized signatures, etc. as requested by trust holder ( Wells Fargo ) well in advance of this date, as requested by trust holder. They confirmed that everything was in order, and I owed them nothing else. It has been 10 days, and not only do I not have my money, but I can't get any information on when they plan to transfer it to me. Numerous e-mails and calls have been fruitless.

Consumer Complaint: XX/XX/XXXX I received a letter of apology and a cheque for {$4200.00} for wrongful repossession on XXXX XXXX, XXXX of my XXXX XXXX XXXX. This happened even though I made a payment arrangement that expired XXXX XXXX, XXXX. XXXX XXXX, XXXX I called the loan provider to explain to them that a portion of the money {$310.00} of the {$2300.00} I owed was taken by the bank. I reassured them that if they took what I had at the moment getting the rest won't be an issue. The lender refused to take anything less then the full amount I owed. When I woke up the next morning my vehicle was gone. Florida statute XXXX governs the repossession of vehicles and the lender nor the recovery company abided by this law. They did not give me the opportunity to retrieve my belongings. In fact, XXXX XXXX XXXX XXXX attempted to charge me {$100.00} to retrieve my personal property : cell phone, pictures of my deceased mother, and a gaming laptop amidst other things. I did not have {$100.00} because I only had what was left for me to pay the lender. The car was sold in less than 30 days after repossession. Despite the car being in excellent shape the lender sold it for less then it was worth. Then turned around and demanded I pay the remaining balance of my car loan even threatening me with litigation. This is a trend with wells fargo where they repossess the vehicle, sell it, and force the borrower to pay the remaining balance. This method triples the amount of profits for the lender but extorts the borrower.

Issue: Managing an account

Consumer Complaint: I recently discovered that {$30000.00} in monies left to me by my late grandparent were wrongfully kept by Wells Fargo without my permission. Wells Fargo refuses to advise me of the account infromation and I of course have no idea what the account number. If I knew the account number, I would not be filing a CFPB complaint. After my grandparen died, she bequeathed certain funds to me. Rather than advise me of this bequeath from my grandmother, Wells Fargo secretly opened an account in my name, without my permission or knowledge. Wells Fargo illegally kept this account open for at least one year before advising me of the existence of the account. To date, Wells Fargo has failed to give me any information about the account.

Issue: Problem with a lender or other company charging your account
Subissue: Transaction was not authorized
Consumer Complaint: I received a bank statement from Wells Fargo and noted that my account was low. I went to the Wells Fargo branch in XXXX XXXX on XX/XX/XXXX to inquire about my low balances. I was informed there appeared to be large fraudulent transactions in XX/XX/XXXX and XX/XX/XXXX and the branch manager said they saw small fraudulent transactions starting in XX/XX/XXXX of about {$500.00} on average, however, the balances significantly increased in XX/XX/XXXX. In XX/XX/XXXX, there were fraudulent transactions totaling {$6700.00}. In XX/XX/XXXX, there were fraudulent transactions totaling {$6700.00} and in XXXX there were fraudulent transactions totaling {$9700.00} and in XX/XX/XXXX there were fraudulent transactions totaling {$8600.00}. Since XX/XX/XXXX there have been various transactions with various amounts to the same company on the same day. I did not use these companies ' services or products. Their fraud alert system did not catch these transactions. I called Wells Fargo and I was informed they were going to investigate. I received a notification on XX/XX/XXXX notifying me my claim was closed and was only reimbursed {$1400.00} which was a fraudulent transaction they flagged on XX/XX/XXXX which I was not notified about due to their 60-day policy. I was not informed this was the first fraudulent transaction and therefore only received this amount. I spent an hour talking to XXXX from their claims team and he did not want to reopen my case or open up a new one and I lost my savings. Per Wells Fargo, they have a Zero Liability policy which states " Your Wells Fargo Debit Card comes with Zero Liability protection at no extra cost. Its built-in protection features ensure that you won't be held responsible for unauthorized transactions, as long as they're reported promptly. ". This is false advertisement to the consumer as they are not reimbursing me for all fraudulent transactions that happened in XXXX. I notified Wells Fargo as soon as I noticed the decrease in the transactions and they will not reimburse me for the recent transactions which decreased my savings significantly and they chose to reimburse me for a transaction from XX/XX/XXXX which is insignificant to the amount that was stolen since XX/XX/XXXX.
