Consumer Complaint: On XX/XX/XXXX I signed a contract with XXXX At XXXX to place my Dad in their facility on XX/XX/XXXX. My Mom placed a deposit and I paid by personal check for the remainder of XXXX 's rent. The agreement was for XX/XX/XXXX rent to be free. Their contract states that payments can only be made by ACH and I signed their ACH form along with giving them a voided check allowing them to debit my parents checking account. According to their contract, they are to provide monthly invoices and THEY debit on or before the 1st of each month. My Dad passed on XX/XX/XXXX and all personal belonging and keys were removed and given back to the facility. I assumed that they had debited XXXX 's rent according to their contract and everything was fine. I am on their contract as Financial Responsibility party ( I have authority to sign on my parent 's account ). I received a certified letter from XXXX dated XX/XX/XXXX on XX/XX/XXXX, saying there is a past due amount of {$1700.00} and to avoid collections I needed to pay immediately. The letter also claims that I was emailed three times with invoices for said amount. Upon receipt I called on XX/XX/XXXX and tried to speak with XXXX XXXX, the woman who sent the letter. She didn't answer and I left her a detailed voicemail asking what the amount was for, as XXXX should have already collected XXXX 's rent according to THEIR contract, so what is this for and I certainly never received any emails. She never had the courtesy to return my call ; so I sent her a certified letter dated XX/XX/XXXX, asking for documentation as to what this billing amount is for, the email address that she used and the invoices she claimed to have sent. She received my letter on XX/XX/XXXX. She finally responded with another certified letter dated XX/XX/XXXX ( well over a month ), which I believe I received the letter somewhere between XXXX XXXX ( my husband signed for the letter as I was at work ) providing the billing invoices I asked for to verify my parent 's owed the amount she stated and she provided the email address she used to apparently notify me of the balance due. The email address she used was WRONG. They had my correct email address, which they show on the 2nd page of the move-in invoice. So I had NEVER received any communication from her at all and she never provided any reasoning as to why XXXX breached THEIR contract by not collecting XXXX 's rent via ACH. By the time we received her letter, she had already turned the account over to a collection agency and I received notification from Transworld Systems Inc ( dated XX/XX/XXXX ) that they are attempting to collect the debt. Upon receipt of the collection notice I called XXXX XXXX at XXXX again..this time she answered and I told her that she used an incorrect email address to send the " invoices '' to me in XXXX, XXXX and XXXX... and she said too bad and that it didn't matter that I never received them..we owed the money and for me to talk to the collection agency. She literally gave us NO time to pay once receiving documentation from her that we in fact owed it. Copies of all letters both from XXXX and me are attached. I also sent via XXXX XXXX and fax the same documentation to their corporate office in XXXX, CO along with a letter to their Founder/CEO, XXXX XXXX XXXX I have also filed a complaint with the XXXX
