Issue: Attempts to collect debt not owed

Subissue: Debt was already discharged in bankruptcy and is no longer owed

Consumer Complaint: I was informed by an agent by the name of XXXX XXXX with XXXX that in order to overturn a denial to my application for a lease on an apartment that was already approved, when my wife applied alone because their application didnt originally let me be added as her spouse, that i needed to pay an outstanding debt of {$150.00} to a debt collection company called TSI . She gave me the number in a text message as followed, Okay so from what the billing department stated was this : Please have them contact TSI at XXXX to pay the {$150.00} balance due on that account. Once this is paid, please email over the proof that the balance is paid in full and once received then I can get the approval to overturn the denial. so I called TSI and this debt is no longer active and closed and has no balance because it was a debt discharged with my bankruptcy in XX/XX/2016. The original debt was with an apartment community named XXXX in XXXX Texas and then sold to TSI in XX/XX/2016. Nonetheless, XXXX is stating they need some form of documentation from TSI that the balance was paid or at XXXX in which I asked TSI for but they are stating they can only fax such letter and it will take 3 days. This is an issue for me because this to begin with should not be reported by the consumer reporting company the leasing desk/real page, secondly Im being told to pay a debt I am not longer liable for because it was included in my bankruptcy. This is hindering from moving in to my apartment but its not even something I owe to begin with. So the leasing desk is repeating wrong and XXXX is reporting wrong and XXXX is showing wrong that I still owe something I dont.

Issue: Problem with a company's investigation into an existing issue

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I have been disputing this account for over a year and no success. I have requested for them to validate this information that they reported to my credit file. It's very detrimental which is holding me back from receiving any new credit. I seriously have no idea where this alleged debt came from and they have failed to inform me on such. I asked for the proper information to help me in the process of trying to validate and verify such alleged debt and all they will send is a some thing with my name on it and some other information. I want to know how does that validate anything? It doesn't! Rules of FDCPA Debt Collectors-subpart B 1006.34 Notice for validation of debts states that for an alleged debt to be validated is as follows : Validation information. Pursuant to paragraph ( a ) ( 1 ) of this section, a debt collector must provide the following validation information. ( 1 ) Debt collector communication disclosure. The statement required by 1006.18 ( e ). Official interpretation of 34 ( c ) ( 1 ) Debt collector communication disclosure. Show ( 2 ) Information about the debt. Except as provided in paragraph ( c ) ( 5 ) of this section : ( i ) The debt collectors name and the mailing address at which the debt collector accepts disputes and requests for original-creditor information. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( i ). Show ( ii ) The consumers name and mailing address. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( ii ). Show ( iii ) If the debt collector is collecting a debt related to a consumer financial product or service as defined in 1006.2 ( f ), the name of the creditor to whom the debt was owed on the itemization date. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( iii ). Show ( iv ) The account number, if any, associated with the debt on the itemization date, or a truncated version of that number. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( iv ). Show ( v ) The name of the creditor to whom the debt currently is owed. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( v ). Show ( vi ) The itemization date. ( vii ) The amount of the debt on the itemization date. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( vii ). Show ( viii ) An itemization of the current amount of the debt reflecting interest, fees, payments, and credits since the itemization date. A debt collector may disclose the itemization on a separate page provided in the same communication with a validation notice, if the debt collector includes on the validation notice, where the itemization would have appeared, a statement referring to that separate page. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( viii ). Show ( ix ) The current amount of the debt. Official interpretation of Paragraph 34 ( c ) ( 2 ) ( ix ). Show ( 3 ) Information about consumer protections. ( i ) The date that the debt collector will consider the end date of the validation period and a statement that, if the consumer notifies the debt collector in writing on or before that date that the debt, or any portion of the debt, is disputed, the debt collector must cease collection of the debt, or the disputed portion of the debt, until the debt collector sends the consumer either verification of the debt or a copy of a judgment. ( ii ) The date that the debt collector will consider the end date of the validation period and a statement that, if the consumer requests in writing on or before that date the name and address of the original creditor, the debt collector must cease collection of the debt until the debt collector sends the consumer the name and address of the original creditor, if different from the current creditor. ( iii ) The date that the debt collector will consider the end date of the validation period and a statement that, unless the consumer contacts the debt collector to dispute the validity of the debt, or any portion of the debt, on or before that date, the debt collector will assume that the debt is valid. ( iv ) If the debt collector is collecting debt related to a consumer financial product or service as defined in 1006.2 ( f ), a statement that informs the consumer that additional information regarding consumer protections in debt collection is available on the Bureaus website at www.cfpb.gov/debt-collection. ( v ) If the debt collector sends the validation notice electronically, a statement explaining how a consumer can, as described in paragraphs ( c ) ( 4 ) ( i ) and ( ii ) of this section, dispute the debt or request original-creditor information electronically. 15 U.S. Code 1692g - Validation of debts ( a ) Notice of debt ; contents Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing ( 1 ) the amount of the debt ; ( 2 ) the name of the creditor to whom the debt is owed ; ( 3 ) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector ; ( 4 ) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector ; and ( 5 ) a statement that, upon the consumers written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor. I received none of that. Even after asking for over a year now. This is my last step before pursuing litigation and proceed with legal action for all my consumer rights violations under this subchapter plus all remedies and actual damages as a result of your failure.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: To whom it may concern : I went to XXXX XXXX XXXX in XXXX, PA on XXXX XXXX, XXXX for a XXXX XXXX to return to XXXX ( I live in XXXX although I am an American citizen ). I paid completely for the XXXX XXXX, {$110.00} with my credit card. The statement from XXXX states, " prompt pay ''. In XX/XX/XXXX, I received a letter from Transworld Systems Inc that I owe {$70.00} to XXXX XXXX XXXX. I immediately went online to the account indicated and initiated a dispute. The letter required that I initiate the dispute by XX/XX/XXXX. Following the initial date that I went online, I went online again and the account still did not show the dispute initiated so I clicked again on the dispute. On XX/XX/XXXX, I did the same thing again and it still did not show the dispute initiated so I decided to call Transworld. I was told that they confirmed the dispute was initiated, only on the second time I went online but would not provide proof that I initiated the dispute. Since then, I have not heard anything from Transworld and also tried to log in to their website ( XXXX ) but the site is no longer working. At this point, I am not sure what I should do and decided to reach out to CFPB as I do not want this episode to affect my credit rating and be solved quickly. Thank you for your support! Best regards, XXXX

Consumer Complaint: I previously received an email from Transworld Systems Inc. informing me that they werre charging my XXXX card for {$410.00} for a computer fraud monitoring system. If I didn't want this charge, I had to telephonically contact them and they would " refund '' this amount. I contacted them and they said they needed my bank checking account number so that they could directly credit this amount to my account. I immediately realized this had to be a scam because I never authorize anyone to have direct access to my bank accounts unless I had previously arranged this process. I immediately hung-up on this person and immediately disconnected my computer from their website. I am a retired XXXX XXXX XXXX and worked XXXX XXXX XXXX ( XXXX XXXX XXXX XXXX, etc. ) and know the above described efforts are made by fraudsters. It was also obvious from the Transworld Systems person that they were calling from a foreign country because of his heavy foreign accent.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: On XX/XX/XXXX, I requested contact information and an address for the persons/department at University Accounting Services ( UAS ) so they could receive my XXXX XXXX XXXX XXXX Payment Request ( Payment Request ). An XXXX XXXX XXXX can be used to pay off federal student loans and I have a XXXX Loan with UAS. UAS is not registered with the XXXX XXXX XXXX XXXX and UAS needs to fill out a voucher to receive payments from my XXXX award. During this call I asked for an email after the phone call to confirm they are looking into the problem. I received no email confirmation. On XX/XX/XXXX, I called again to find out that this request was never looked into. I restated my initial request above and asked for a call back from a supervisor, as well as an email, confirming they are looking into my problem. I received no call back and no email. On XX/XX/XXXX, I called to follow up. I was able to speak to a Team Lead, who provided me with the standard address, generic email address and the general phone line. She admitted she wasn't sure what department would handle this request. During this call, I also requested my late fee be removed since I have been troubleshooting this payment request since XX/XX/XXXX. The Team Lead stated they would submit a request to remove the late fee with a XXXX. Later on XX/XX/XXXX, I called XXXX and they suggested I get a direct contact and email address from UAS. This would ensure that my Payment Request could be delivered to the correct address and potentially have the voucher filled out quicker to avoid additional late fees and interest. Later that day I called UAS back, an agent answered and told me they could not provide any phone numbers or email addresses for other departments because UAS keeps that internal. I then requested to speak to the Team Lead and the Agent stated that this request would need to be sent to a supervisor, requests take 10-14 business days, and that I can't submit another request because the Team Lead submitted one for me already. Since XX/XX/XXXX, I have been the only party to initiate correspondence about my XXXX XXXX XXXX XXXX Payment Request. I feel that there is too much " red tape '' at UAS which is causing my problem to go unanswered and unresolved. UAS has not handled my request in a timely or effective manner, causing more interest and late fees to add up on my account. My next payment is due at the end of the month and I am not confident they are taking steps to help me pay off my loan.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: Received a letter on XXXX offering a payment plan for a debt. Creditor name was present but no other details regarding the debt At XXXX MST XXXX I called the debt collector and requested they provide me the following : -copy of the original contact/receipt with my signature -full payment history from original creditor -proof they now own or have been assigned this debt The agent advised that the letter they sent was the only proof they could provide and anything further I would need to contact the original creditor for. I told the agent they would need to provide the requested information in order to validate the debt and continue trying to collect it She continued to repeat that the letter they sent, which only provide creditor name and debt amount, was enough to prove they can collect on it.
