Consumer Complaint: According to the Fair Credit Reporting Act I have the right to make sure my private information is not shared which is backed by the Privacy Act of 1974 by 15 USC 6801-6805 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its consumers and to protect the security and confidentiality of those consumers ' nonpublic information. '' XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX and XXXXXXXX XXXX XXXX XXXXXXXX are all financial institutions by definition under that title. XXXX, Transunion and XXXX are credit reporting agencies and I am the consumer. Under 15 USC 1681 section 604 a section 2 states that " In general subject to subsection ( c ), ANY consumer reporting agency may furnish a consumer report under the following circumstances and NO other : in accordance with the WRITTEN instructions of the CONSUMER to whom it relates. '' XXXX XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXXXXXX are all financial institutions and the consumer reporting agencies XXXX, Transunion and XXXX do NOT have my consent to furnish this information and they definitely do NOT have my written consent. According to 12 CFR 1016.7 it states that " A consumer may exercise the right to opt out at ANY TIME. '' I specifically sent Opt out letters to each financial institution and credit reporting agency stating that they do NOT have my permission to utilize my private information and the opt out should be affective immediately and indefinitely. Any and all consent to XXXX, Transunion and XXXX, XXXX XXXX Bank XXXX XXXX XXXX, Capital XXXX XXXX XXXX XXXX and XXXXXXXX XXXX XXXX XXXXXXXX whether verbal , non verbal, written, implied or otherwise is REVOKED. 15 USC 6802 ( b ) ( c ) states that " A financial institution may NOT disclose nonpublic personal information to a NONAFFILIATED THIRD PARTY unless - the consumer is given an EXPLANATION of how the consumer can exercise that nondisclosure option. '' XXXX XXXXXXXX XXXX XXXX XXXX XXXX, Capital XXXX XXXX XXXX XXXX and XXXXXXXX XXXX XXXX XXXX never informed me of my right to exercise my nondisclosure option and are committing language fraud and solicitation which by law of 17 CFR 230.424 they agreed NOT to do. They also have been participating in unfair and deceptive practices 16 CFR 433.2 by illegally reporting transaction history. Also, according to 16 CFR 433.3 if the contract was written AFTER 1979 it applies to them as well. Because of all the fraudulent activity that has occurred to me as the consumer, my private information was found to be apart of the XXXX data breach and I have NOT received any resolution or compensation for the fact my information was sold to third parties. The accounts are adverse items they are reporting again WITHOUT my permission which is again against the law. 15 USC 1681 2 ( A ) ( 1 ) A states " A person shall NOT furnish any information relating to a consumer to ANY consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. '' 15 USC 1681 ( e ) states " Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681 ( c ) of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681 ( b ) of this title. XXXX, Transunion and XXXX are NOT maintaining reasonable procedures. This inaccurate information has caused deliberate pain and suffering to me as I can NOT gain access to the essential things I need in life because of what is illegally reporting on my credit as a consumer. I have also filed FTC reports on the companies as well to ensure my rights are being heard and met.
