Upon reviewing my credit reports, I have identified an inaccurately reported late payment. I have made several attempts to contact the creditor in question to address and rectify this discrepancy, but unfortunately, I have not received any response. Consumer Complaint: In XXXX XXXX : Transunion use an account that was closed and part of a bankruptcy case to decrease my credit score in excess in an unfair way that decreased my credit score by XXXX points. This was unfair discrimination, retaliation behavior in a recent dispute on my credit report and this action Transunion did was not reasonable. In comparison to a recent change to my credit report with this agency I paid down a credit card account significantly. Transunion didn't increase my score fairly as to the same magnitude and fair as they did based on how they decreased my credit score. I feel this type of action on my credit report was discrimination and negligent. They failed to exercise proper care or taken action that is reasonable in regards to my credit information in which that is negligent, retaliatory unfair discriminant behavior. Consumer Complaint: On XX/XX/XXXX I received a copy of my TransUnion credit report and I noticed an auto loan account being reported as a collection account by XXXX XXXX XXXX. Specifically, a XXXX XXXX XXXX. Therefore, I contacted the creditor XXXX XXXX XXXX by phone for additional information regarding the status of the account. However, the customer service department was unable to locate any account with my information in their system. I explained to the representative that I reviewed my TransUnion credit report and the auto loan was being reported as a delinquent account in collections by their financial institution. I also explained to the representative that the automobile was stolen in XXXX XXXX XXXX and the account balance was paid in full by my auto insurance at the time. The claim was settled directly with the XXXX loan department. Unfortunately, because the customer service representative was unable to locate any account in their system, they were unable to provide with any additional information and documentation that the account was settled. It was recommended for me to contact XXXX XXXX XXXX by mail. On XX/XX/XXXX, I drafted a letter to XXXX XXXX XXXX and TransUnion Credit Bureau which is reporting the delinquent/negative account. I sent the letters via USPS mail on XX/XX/XXXX and have not received a response in writing and/or via telephone.

XXXX did correct the information but now it seems like all of the fraudulent and incorrect information has made its way back onto my report. Consumer Complaint: My rights have been violated and the improper use of data furnishing is causing financial hardship. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX, XXXX, Transunion are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies Transunion, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, & Transunion ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than XXXX years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. Transunion, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of the reporting services of any collection agencies. Also, Reporting Transaction history is also illegal according to 15 U.S. Code 1681a. All data must be furnished correctly. To enforce my rights, I request Under 15 U.S. Code 6805 - Enforcement ( a ) In general Subject to subtitle B of the Consumer Financial Protection Act of 2010 [ 12 U.S.C. 5511 et seq. ], this subchapter and the regulations prescribed thereunder shall be enforced by the Bureau of Consumer Financial Protection, the Federal functional regulators, the State insurance authorities, and the Federal Trade Commission with respect to financial institutions and other persons subject to their jurisdiction under applicable law.
