Consumer Complaint: We have filed before and the Law firm dropped the foreclosure. They started it again we had to declare bankruptcy. Now they are trying to lift the stay. We found out new information on the loan. They have tried to foreclose 5 times. 2 of the times they filed unauthorized assignments so they could proceed to foreclosure, They do not have any proper assignments. The servicer does not have the servicing rights, they did at one time but they were replaced. There are other issues but they are foreclosing based on the 2 assignments. I will attached them. Our house is paid for, and XXXX XXXX XXXX is trying to foreclose. They ignore all the laws that are in place to protect Homeowners property rights. Select Portfolio Servicing ( the servicer ) cant even produce a signed note. I know for a fact, and I can prove that they lack standing. But I keep getting told that Judges don't want to hear about lack of standing. My main argument is still we paid for the house. Attached is a Loan Summary that will give a quick background. I think it will give you a good idea as to what is going on and if you think you can help us. I know were just one family, but I think they are doing it to other families, and it is unfair, they bully and intimidate, and they have falsified documents to cover their deficiencies on chain of title, payment histories, etc. One of their biggest arguments is that we signed, under duress mind you and with false information, modification agreements so it does not matter what we paid, and they do not have to give us a payment history back to the beginning of the loan. The loan was closed in XXXX and they only have a payment history back to XXXX. We have disputed the balance for years. The first Servicer did not give us credit for about {$52000.00} in payments. I have several pages of documents that I can provide but I thought I would give you an overview again to see if this is something you can help us with. XXXX has recorded assignments with the county using one of their Attorneys who claimed to be a certifying officer assigning the loan from one entity to another. He was not a Certifying Officer I can prove it. He did this so they could try to foreclose. They have tried to foreclose 5 times forcing us into agreements. Agreements they are now using to say we do not have the right to know a history of our Loan. We have all the payment support, and they ignore it. They have ignored it since XXXX. All we want is credit for all payments we have made. Payments that paid the loan in XXXX. We did not realize that it was paid off until recently, because we could never get a proper accounting of the loan. We spent weeks tracking down all the records for 15 years of transactions. We put it in a spread sheet and found out it paid off even earlier that we had anticipated. We are tired of all the intimidation and legal twisting of the truth. We need help with the legal predatory behaviors of XXXX and their XXXX Select Portfolio Servicing. I have decided to include a timeline of the loan I hope that is not to much for now. Consumer Complaint: We lost 100 % of our income when the Covid-19 pandemic hit. The government " made '' banks/servicers offer several options to homeowners, including deferrals. However, the government forgot to include tax and insurance and with the high property taxes we have, we asked our servicer to put the taxes on the back end of the loan. They said the only way to do this is for us to apply for a loan modification. We sent all requested documents, the servicer failed to use our full income and after several months of phone calls and letters citing their error, we finally decided to file a complaint with the CFPB. Once we did that, the servicer finally used the correct income. Originally they used just over {$4000.00}, to finally using our full income of over {$8000.00} and still denied us. They offered us a deferral agreement on XX/XX/2022, and gave us 30 days to respond to it. We signed, sent it in, as well as made our payment prior to the written contract 's expiration date and on XX/XX/2022, the same day we signed, they breached our contract and canceled it. The contract said sign and send in, we did. It did not say anything about making the payment but we did anyways. Pre-Covid, our payment was just over {$2400.00}. Post covid, it was just under {$2900.00}, and post-breach of contract, it's now over {$3000.00}. The payments that were supposed to be deferred will now be added for a payback with the amount exceeding {$4000.00} a month. Working with this servicer has been very difficult. They could not count our income right, they can't count 30 days right, it's absolutely frustrating!!! At this point, we are preparing a complaint, including all that were submitted to the CFPB to send to all government and state agencies that monitor and assist in these matters. We will set up accounts but will await the servicer 's response to this formal complaint.

This company is purposely deceiving me by LYING about documents sent via email. I have sent EVERY piece of documents asked for by this company and more than once. This behavior is a deliberate and repeated action and is a PATTERN conducted by SPS in an attempt of depriving me of a loan modification that has nothing to do with COCID-19 and NO I dont need a forbearance- this is what their employees are scripted to state on each call. SPS is deliberately denying me the ability to have relief and pay a lower mortgage.As you can notice how this company conducts its business thru deceit and lies in hopes. That I will just stop sending documents. SPS constant lying that documents are missing is ignorance on this companys part, asking for the same documents over and over. Please NOTICE how obvious SPS actions are. A VERY DELIBERATE PATTERN THAT IS REPEATED OVER AND OVER. As you can see from the documentation I have presented SPS has 18 instances of REPEAT PATTERNS of asking for DUPLICATE MISSING DOCUMENTS that already has been sent via email at Relationship.Manager@spservicing.com. I NUMBERED EVERY DOCUMENT I have emailed to SPS and have sent over 200 pieces of documents. 214 pieces to be precise and all I have to do is go to MY PAGE of this so called missing document, pull it out and email it to SPS again and again, over and over. Its as if SPS is upset due to my sending every piece of document they have asked for

Consumer Complaint: Originally I applied for a loan modification on my loan due to a job loss of my husband, around XX/XX/XXXX. While in the process of the loan modification, the pandemic came and I than also had job loss for a period of time and income loss which changed the loan modification status and put me into a forbearance because SPS ( Select Portfolio Servicing, Inc. ( acct # XXXX ) ) said that they can't review under both circumstance. In Late XXXX I was put in a Forbearance according to my new situation and due to the income loss i was given some time until my situation changed. on XX/XX/XXXX after my forbearance period ended I called in to see what options I had to re-start my payment but was not given only one option and that was to submit a RAM application. In the process I was asked to submit many documents, which I did provide. They had many questions that need to be answered, which I did answered but the questions came at different times and by the time a received a correspondence for request of document/explanation every time I had to update another document because the date had expired. After a long back and forth I was already in XXXX of XXXX. At this time unfortunately I had a another change in my situation that had to brought forth, because my husband stopped receiving unemployment and I no longer can document that income and they told me that they have to put be in another forbearance. In XX/XX/XXXX at the end of the forbearance I requested a streamline modification but again they said I was not eligible and then I submitted another RAM application on XX/XX/XXXX. It is XX/XX/XXXX and SPS still is asking for more documents. The recent request concerned me because it is not in my control and according to the customer services person the requested document is needed and with out it the application will be incomplete. The request was for a pay stub that has a begin and end date, which my pay stub does not provide. I work for the State of NJ and they only have an end date on the stub and I have submitted my bi-weekly pay-stubs. I'm not sure after speaking to the customer service rep today XX/XX/XXXX what exactly they need as a supporting document as they are not able to change the pay-stub. I am very concerned about my loan and am overwhelmed by the requests. I feel like SPS is just buying time to add more interest to the end of my account. I am looking for a way to settle this in a timely manner as I'm I working mom of XXXX with a spouse with various health problems. This process has impacted me negatively, it has cost me time and mental exhaustion to the point where I feel i'm running it circles. Finally, they agreed to review my escrow account on XX/XX/2022. They finally did on XX/XX/XXXX and decided that yes indeed, they had collected {$18000.00} too much. They " said '' they mailed a check on XX/XX/XXXX. ( Who " mails '' a check over {$18000.00}? ) It is now 11 days later and no check has been received. It has been 23 days since they " learned '' of their over charging me. I still have not been made whole. They have {$18000.00} of my money that they have been earning interest on. I WANT DAMAGES!!!!! They are abusing consumers and are earning thousands in interest rather than promptly reimbursing the client what they should not have had the whole time. I warned their incompetent staff REPEATEDLY that I was going to the CFPB. One of their employees said, " go ahead, we don't care. ''

Consumer Complaint: I was on XXXX XXXX XXXX when I lost my job due to the pandemic. My mortgage company, XXXX XXXX offered a forbearance for 3 months. Since I was still unemployed, they reduced my mortgage payment from {$1000.00} to {$290.00} but in XX/XX/XXXX, they offered a modification and requested income verification as well as additional documentation. Unfortunately, the modification was denied because I was still unemployed due to my health condition. Ive had a lot of medical issues due to my XXXX treatments, which have caused additional health issues, plus I got covid last year. Fortunately, I have a Mortgage XXXX Policy with XXXX XXXX XXXX. I filed a XXXX claim with XXXX XXXX, and it was approved. XXXX XXXX issued a check to Select Portfolio for {$10000.00} on XX/XX/XXXX, to their Utah location. This was a retroactive payment to cover the months of XX/XX/XXXX thru XX/XX/XXXX. However, Select Portfolio claimed they never received the check. Another check was issued on XX/XX/XXXX, for the same amount, this was the XXXX check issued to them. Again, they claimed they never received that payment either. On XX/XX/XXXX, XXXX XXXX issued a XXXX check for {$10000.00} but Select Portfolio said that payment was never received. On XX/XX/XXXX, XXXX XXXX sent another replacement check but this time they sent it via Certified Mail, this was the XXXX sent to Select Portfolio. On XX/XX/XXXX, I contacted Select Portfolio and spoke with XXXX. She said a payment had been received and it was in the XXXX XXXX, but it would take XXXX hours to post to my account. A couple of days later, I checked my account online and the payment had been posted and backdated to XX/XX/XXXX. The account appeared current and up to date! On XX/XX/XXXX, I received a call from Select Portfolios Lost Draft Department in Ohio. They informed me that they received a check from XXXX XXXX in the amount of {$10000.00}, and they wanted to verify if the check was for damages to the property. I explained it was NOT for damages to the property, but it was a mortgage payment. At first, I thought it was one of the lost checks issued the previous month, but after verifying the check number with the representative, I realized it was the most recent replacement check that XXXX XXXX had reissued on XX/XX/XXXX. This entire time the check that was posted to my account in XXXX was not the most recent check, but it was the check from XX/XX/XXXX. The XX/XX/XXXX, payment was returned as a stop payment, which caused my account to become delinquent. Apparently, what happened was when Select Portfolio received the payment via Certified Mail at their Utah location, they assumed the check was to cover damages to the property. They then forward the check to their Lost Draft Department in Ohio without notifying me. Once the Lost Draft Department realized their error, the check was then mailed back to Utah and its now lost again! This situation has caused me so much emotional distress that I ended up hospitalized for 2 days with symptoms of a XXXX. In the meantime, Select Portfolio has sent me serval Notices of Default and Right to Cure by XX/XX/XXXX. I have made every effort to bring my account current, but I feel like Im running into a brick wall. I need your help and assistance in getting this situation resolved to avoid foreclosure.

Consumer Complaint: I have had a FHA loan ever since XXXX when XXXX owned my loan. In XXXX XXXX owned my loan. In XXXX my loan was sold to XXXX XXXX. In XXXX I got a letter for Select Portfolio Servicing stating they were the server but refused to tell me who owned my loan. 3 months ago SPS informed me that XXXX XXXX owned my loan, however on XX/XX/XXXX, I was told by a XXXX XXXX XXXX that XXXX XXXX never owned my loan. I have asked SPS numerous times who owns my loan and they insist, XXXX XXXX bought my loan in XXXX. From day one Select Portfolio Servicing has been running a scam. SPS immediately wanted me to me to authorize them to deduct electronic payments from my bank account. They also wanted to charge me {$15.00} to pay my mortgage online. When I refused, they started sending my mortgage statements late in the mail. They also mailed my end of the year statement late. I did not receive my XXXX end of the year statement until XX/XX/XXXX. I have called numerous times requesting that I receive my mortgage statement on the XXXX or XXXX of the month. I would mail the payment on the same day I received the statement from SPS and was never late. In XXXX SPS said the payment was late, which was a lie because it was mailed 20 days before the XXXX of XXXX. SPS did waive the fee and stated it would not be on the XXXX monthly mortgage statement however, it was. The figures on the XXXX mortgage statement statement are wrong because, my payment is {$530.00} but SPS has a sum of {$720.00} which is wrong. During the month of XXXX, I received XXXX letters from SPS demanding that I let them electronically transfer funds or pay {$15.00} to pay my mortgage online. If I refuse, SPS will deliberately mail my mortgage statements late. So they can charge {$26.00} late fee. These are illegal practices SPS is engaging in. The Electronic Fund Transfer Act ( EFTA ) of 1978 is intended to protect consumers who choose to engage in electronic fund transfers. Consumers should not be pressured in electronic fund transfer, in fear that a company will deliberately mail your mortgage statement late. They mailed me 9 letters in the first 2 weeks of XX/XX/XXXX one after another regarding electronic fund transfer and requesting that I pay {$15.00} to pay online, but they won't mail my mortgage statement on time. When I complained about SPS fraudulent practices, in retaliation, on XX/XX/XXXX they reported deceptive information on my credit report causing my credit to drop XXXX points. This is the second time SPS reported deceptive information on my credit report because I complained about the same issues. The first time after I complained about the same issues, I brought it to the attention, and they corrected their error on my credit report within a week. They have yet to correct their error as of XX/XX/XXXX. On XX/XX/XXXX I requested a hard copy of my 3 annual credit reports. I was shock to learn that the address on my credit report is different from the address on my statement. The address on my mortgage statement for almost two years has been : Select Portfolio Servicing, Inc XXXX XXXX XXXX XXXX XXXX XXXX UT XXXX That's where I was sending my payments, which was a FHA loan XXXX On XX/XX/XXXX I discovered another address on my credit report which is : XXXXXXXX XXXX XXXX XXXX XXXXXXXX, FL XXXX Phone ( XXXX ) XXXX ( This is the same number on my mortgage statement. ) This is a bogus account and it does not belong to me. The Following Information pertaining to this bogus account is also on my credit report : Responsibility : Individual Account Account Type : Mortgage Account Loan Type : XXXX XXXX XXXX XXXX XXXX the Open And Updated date : XX/XX/XXXX My husband and I will speak to a whistle blower attorney. I Have a FHA Loan not a XXXX XXXX XXXX XXXX loan, I did not modify my FHA loan, sign any papers or authorize anyone else to modify my FHA loan. This information is a lie. These are the terms on this bogus account : {$720.00} per month, paid Monthly for 588 months, again another lie because my mortgage payment is {$530.00} a month.
