Consumer Complaint: I was affected by the XXXX XXXX and fell past due on XX/XX/XXXX when I was forced to take time off so my income decreased. I have been requesting for XXXX XXXX relief from XXXX since then and all they did was place me on a forbearance with no modification help and the end but continue to demand the entire balance owed. I recently submitted on XX/XX/XXXX and was immediately denied for modification options and any home retention options. I have offered XXXX {$4500.00} to contribute towards the past due but refused to review me for a repayment plan or even consider my request but are more interested in the foreclosure of my home.

Consumer Complaint: Our mortgage was sold to another bank and is now serviced by a company called Select Portfolio Servicing ( SPS - spservicing.com ). SPS charges a fee for each online mortgage payment if payment isn't done via auto-pay, and I'm not certain this is legal. Especially because our last mortgage servicer charged no such fee. We've seen class-action lawsuits against other mortgage servicers for similar fees ( eg. https : XXXX # XXXX ). See attached screenshot describing the fee.

Consumer Complaint: I am an independent XXXX. During the beginning of COVID, many of my clients were afraid to come out of their homes to my office. I was severely impacted due to COVID. I am a XXXX. My boss was holding my pay as well as my colleagues pay. My clients were not coming in and My income dropped down to less than XXXX a week. I was borrowing money from everyone to help me pay my mortgage. Select portfolio servicing had forbearance programs and I completed each one. I was still in a financial struggle because I could not find a job paying me enough money. I paid my forbearance up until XX/XX/2021. Select portfolio services said I could apply again but asked for so many documents, in which I gave them, they were giving me a hard time. I have constantly kept in touch with SPS but they refused to help me with a mortgage deferral program. I have lived in my home for XXXX years and want to keep my home. I am working small hours but am looking for work aggressively> Please help. I started gong through the issues XXXX. But I was in forbearance plans and kept each one not missing any. I was told by my homeowners that a collection law firm has my mortgage. I was not notified by my mortgage company and I don't know what to do.

Consumer Complaint: Select Portfolio Servicing is attempting to carry out an illegal foreclosure sale against my homestead residence without any right to do so. Below, I will highlight the reasons this is a wrongful foreclosure action in XXXX XXXX Florida. 1. This wrongful foreclosure case began on XX/XX/XXXX, more than 13 years ago. 2. Case was dismissed for Lack of Standing on XX/XX/XXXX, by XXXX XXXX XXXX. ( XXXX Docket # XXXX ) 3. Discovery was compelled to Plaintiff to prove Standing on XX/XX/XXXX, by XXXX XXXX XXXX. ( XXXX Dockets # XXXX, XXXX, XXXX, XXXX, XXXX ) 4. Eight days later, Plaintiff filed notice of dismissal on XX/XX/XXXX, since they would not respond to compelled discovery to prove Standing. I received a short sale acceptance form from SPS to list my house as a short sale and sign and submit the form along with the listing agreement by XX/XX/2022. This was done and emailed on XX/XX/2022. In XX/XX/XXXX I was told the documents are in underwriting and were received. On XX/XX/XXXX I was told that the short sale was denied because the sale date was too close. A supervisor helped to try and correct this with a dispute stating we sent the documents before the expiration date and the short sale should have been opened.

Consumer Complaint: XXXX received letter from lender Select Portfolio Servicing, stating that my interest-bearing portion of my loan was paid up and that they were requiring the balloon payment asap. over {$76000.00}. I spoke with several representatives ; I was instructed to continue making my payments. Which I did. I was under employed due to CoVid19. and receiving some unemployment. I made every payment despite. After first payment was accepted, the second was rejected. Was told that I could not pay through customer portal so I sent through the bank app. It was accepted. The next month payment was reject through transfer so I sent money order. It was destroyed by company instead of sending it back. At this point they asked for all monies and instructed me to refi or remodify. They put my account in forbearance which made it impossible to refi. ( I did try ) I was trying to pay half of the due amount which they refused. I was allowed to make any further payments during forbearance. I did everything they requested for the remodification. They asked me to do a remod and then I could do refi after. XXXXAfter months after months of me being in compliance and change of under writing I was offered a repayment plan. I was told I could not be approved for a remod. I began making the payments plus extra to catch up on my escrow. Every month I had to call and request that the payment be applied to my account before I sent the next payment. In the mean time, I was contacting my banks to see if I could refinance since I was out of forbearance. I was told I needed about 6 months of payment history. ( which I was working on ) XXXXhad to call and have the check applied to account again, was told that the check was being scanned in but the funds were not being applied upon receipt. XXXX received message that my payment was due. I had already sent 2 weeks prior. Representative informed me that the check had been scanned and funds applied. about XXXX a representative called asking my intentions for property, said that the payment had not been applied. Next rep l spoke with said that they did not know why I was offered a repayment plan but that they again would not take a partial payment ; full payment only but she could put in another application for remod. Insanity since they are the ones that said I could not be approved for remod. Now I can not show payment history for a refinance either. I do not make enough income with my long term job under a refi. Complaining on the company because I have been in compliance the entire term of my loan, did everything they insisted for a remod so l could have an opportunity to refi. They are not honoring their agreement terms. But since the letter is a computer generated letter I have no legal action at my disposal.

Consumer Complaint: Prior to Covid, we had not missed a payment for years. Due to our line of work, once covid hit, our income was reduced to {$0.00} so I had to find another job while my XXXX XXXX XXXX was on hold. We contacted our servicer and asked for mortgage assistance in the form of a loan modification once it " appeared '' that the pandemic was over and we were once again receiving income from our XXXX XXXX XXXX. At the time of submission of the loan modification package, we had W2 income as well as our real estate income. Rates were at an ALL TIME low and based on the income that was provided, we would have easily qualified for a loan modification. However, our servicer, after repeated verbal and written requests by us, still would not use the full income that was provided. They only used the W2 income, not the real estate income. We had been in real estate for over a decade, the W2 income was for barely a year as we only went W2 because of the pandemic and its effect on our real estate income. They finally offered us a deferral of all past missed payments, including tax and insurance but refused to recalculate us for a loan modification so we submitted a complaint to CFPB and after XXXX months of us pretty much begging them to use the correct income that was provided, they finally did. Rates at this time were on the rise and we were told that we still did not qualify for any type of a loan modification but stated they would still defer all missed payments on the back end of the loan. The letter was dated XX/XX/2022, with XXXX payment due and in just a few days, a XXXX payment would be due for a total of {$5700.00}. We requested that the bank please defer and make XXXX the XXXX payment as we are doing everything we can to keep our home, they refused. This servicer has done nothing but torment, harass and discriminate against us ever since we asked for their help. To send a letter on the XXXX, payment due, with another payment being due just a few days later, shows the lack of common sense that we have been dealing with. Servicers are supposed to do all they can to help American 's retain their home after the pandemic and this servicer has done the exact opposite.

Consumer Complaint: As evidenced by the enclosed reporting to the IRS - 1099A - Select Portfolio Servicing stole {$31000.00} in insurance proceeds due me, as the beneficiary, for work I completed to the house PRIOR to them foreclosing on the " property ''. *PROPERTY being the contracts and security futures - separate and distinct from the real property they simply stole ( or believe I gifted to them ). Nonetheless, if SPS is able to refute the claim put into the IRS for the {$31000.00} please do so. Otherwise, I wish for the funds to be returned to me within 14 business days time. Thank you. A formal demand letter has been sent to SPS attorney XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX XXXX and the XXXX XXXX XXXX to audit the account.

Consumer Complaint: XX/XX/XXXX regular payment made {$780.00} mis-applied to principal XX/XX/XXXX regular payment made {$780.00} mis-applied to principal both mis-applied by servicer as principal balance reduction. I calledXX/XX/XXXX ( 12 min call ) and XX/XX/XXXX ( 26 min call ) requested twice for corrections. I followed up on XX/XX/XXXX ( 5 min call ) and was told had to be transferred to someone else ( another 8 min call ) I was assured this was corrected and corrected 1098 would be sent out. XX/XX/XXXX, got the same 1098 in the mail again ( not corrected ) another call ( 23 mins ). I was told this time not corrected and will now take another 30 days and they make lots of errors. ( they do ) I am not able to determine on their website what is the last payment applied nor see any of my payment history, but each time I sign into my acct it prompts me repeatedly to go paperless. ( That way i'd never know what they are doing ) Also they failed to pay my hazard insurance {$2000.00} causing cancellation of my insurance XX/XX/XXXX. I called them to advise and they paid it twice. {$2000.00} & $ XXXXThis also caused my escrow account to go into the negative. My insurance was reinstated and I was sent the overage and paid it back into my escrow account XX/XX/XXXX. I need this all corrected prior to my annual escrow analysis being done in XXXX as the mis-applied 2 pymts will cause further shortage in my escrow acct resulting in higher payment thus another mess to deal with. I want my 1098 corrected like yesterday to include those 2 payments paid in XXXX and a statement to SHOW the corrections and the funds XXXX and XXXX applied as regular payments back dated to XX/XX/XXXX and XX/XX/XXXX. It seems every time I call I get a different made up story oh I can't get into my back office right now to see? ( LIAR- made up XXXX please don't insult me ). I asked for escalation tonight XX/XX/XXXX and was told they can't do that? This is causing undo stress an anxiety on me for multiple errors this company has made. I'm a senior citizen now and should not have to deal with this stress or repeated calls to correct.

Consumer Complaint: In XX/XX/XXXX I noticed that my statement from my mortgage company was inaccurate with the amounts that I had paid for my principal and the interest. Every month since Select Portfolio Services , Inc bought my loan from XXXX XXXX XXXX around XX/XX/XXXX I have had to continually call them to fix the separate Principal payment. They tend to put it where ever they choose. I have always kept my statements and still have most of my statements from XXXX XXXX XXXX and Select Portfolio Services. Recently they have not been fixing these errors and have even sent an incorrect 1098. I called them back in XXXX of XXXX to make sure that my Principal Payment was sent to the appropriate address and it still gets messed up. When I call and tell them to fix it they say that they are in the process of fixing it, but it has now been 3 months and it is still not correct. My Principal paid should be showing {$640.00} that I have paid so far this current year and my new mortgage payment should be due for XXXX. Instead the amount showing is {$42.00}. I pay {$300.00} a month separately to principal. They also tell me that I owe a fee of {$90.00} that was a carry over from the previous mortgage company. Which I have never had a fee from my previous mortgage company. That fee is now lower and when I asked when was it that I made a payment to this supposed fee they could not answer me. I keep very good records on my account and any payments that I make. I will have to call them again, because when I went to their web page to check my account it is showing that I am not do to pay until XXXX which is not correct and the {$300.00} principal payment has not been applied.
