Consumer Complaint: In XX/XX/XXXX My sister and I purchased my property for {$320000.00} with a loan through XXXX XXXX and XXXX. I was the primary. I was with XXXX and My sister was with XXXX XXXX thru Home Loans Servicing and both were all interest paying loans with 7 % adjustable rate after 5 years. In XXXX of XXXX I was under the impression that I was purchasing the property for myself thru XXXX loans Servicing for {$340000.00} ( removing my sister from the loan ) with a monthly payment of {$3000.00} at 2 % Fixed 30 year. To my knowledge I was the sole mortgagee since XXXX. My sister has XXXX letters of Satisfaction of Mortgage from XXXX. In XXXX letters were sent to my sister with XXXX letter head threatening foreclosure on my premises. I assumed letters were fraud and ignored them as I was up to date and my sister not involved. In XXXX I received a call from an organization that identified itself as " my current lender '' and they offered me a modification. I was asked several questions during this call including current loan amount which I replied {$340000.00} assuming I was speaking with current servicer. In XXXX I recieved a call to me directly from XXXX XXXXXXXX XXXX threatening foreclosure. I informed them that they were mistaken and I was up to date. Also that I had no knowledge of their involvement in my property and asked for a copy of assignment and the note. It was during this time XXXX XXXX XXXX changed my payment location every month in XXXX. I was told by XXXX XXXX XXXX Rep that my Note holder was XXXX XXXX and that I had to write the institution directly for that request. I wrote XXXX XXXX and instead recieved copies of unfamiliar documents from XXXX XXXX XXXX. On XX/XX/XXXX at XXXX I called XXXX XXXX XXXXXXXX informing them that I wanted to participate in the global XXXX XXXX XXXXXXXX lawsuit. I was told since XXXX XXXX is backing my loan that I was not XXXX XX/XX/XXXX my sister had me remove her from the deed as she felt somehow it connected her to the house concerning the foreclosure letters. Although I was up to date on payments I could not convince her otherwise and she was removed XX/XX/XXXX. Due to intimidating threats of foreclosure ( while caught up ) I applied for a MOD knowingly with XXXX XXXXXX/XX/XXXX. On XXXX XXXX XXXX filed a foreclosure case against my sister with my property address ( by this time she lived in Texas ). I was not going to answer the complaint as it was not valid however I was told I would lose my house to summary judgment ( if filed ) so I answered it. I fought pro se thinking the forged documents would be evident to the judge. Supporting documents and bank transactions submitted to the courts were not mine and fraudulent. XX/XX/XXXX Bank Filed Motion for summary judgement and to Amend title to remove my sister and add me. My sister was removed from case and one of my tenants names was added next to mine and then the tenant was served thereafter. Sometime in XXXX the judge removed my sister from case and added me and granted summary judgment to the bank ( which was now XXXX XXXX ). I retained a lawyer and saved my property from a speedy auction but the Judge denied my right to prove my case with a lawyer and I was forced to sign an " iIlegal Mod '' ( With XXXX ) for XXXX before foreclosure was vacated XX/XX/XXXX by the Bank.It was suggested that I let the bank sale then XXXX however I want to keep my home. In XXXX of XXXX I went through Mod with XXXX XXXX XXXX which they made me do twice before accepting me. They also charged me two months mortgage payments ( after the " 2 '' 3 month trials ( 6 months total ) before they accepted the mod. XXXX never returned a signed copy to my lawyer of that MOD. I recently recieved a signed copy of XXXX XXXX XXXX XXXX on my online mortgage account ( requested XX/XX/XXXX ) from Select Portfolio Servicing on XX/XX/XXXX which was signed XX/XX/XXXX by XXXX On XX/XX/XXXX I recieved a foreclosure letter addressed to my sister from XXXX XXXX XXXX at my property which was initially after signature of MOD and account was up to date. On XX/XX/XXXX I called XXXX XXXX XXXX and informed them that the loan was illegal and I requested someone to contact me for a resolve. At that time I was also informed XXXX XXXX was my note holder. I called XXXX XXXX to confirm ; the request is under # XXXX. XXXX XXXX never responded. In XX/XX/XXXX XXXX transfered me to Select Portfolio Servicing. Only upon my request, Select Porfolio Mailed me a hello letter addressed to XXXX XXXX XXXX ( Not my Property ). I requested a copy of my note and again received a forgery prompting me to request note holder info. Select Porfolio XXXX has said that my current note holder is XXXX XXXX. I have contacted them and they do not have any account information concerning my property. Through email I asked XXXX XXXX if they hold the note for account XXXX and I asked who the contracted servicer was and XXXX responded XX/XX/XXXX with the following pasted from my email " Your servicer would be whoever you pay your mortgage to. If you dont know who that is, please do the following : Please contact the county Recorder 's office to obtain the text of the Assignment Clause that notes an association with XXXX XXXX XXXX XXXX XXXX XXXX The clause should read as follows : XXXX XXXX XXXX XXXX XXXX XXXX, not in its individual capacity but as Trustee for_____________________ With that information we will attempt to determine the Servicer and forward your request. The servicer will then contact you directly. To learn more about our role in this transaction, please vXXXX XXXX Thank you. Property Inquiries cf XXXX XXXX XXXX XXXX XXXX XXXX, XXXX Floor XXXX, DE XXXX XXXX XXXX / wsfsinstitutionalservices.com '' I recieved a letter from Select Portfolio Servicing Inc stating the following " XXXX XXXX XXXX XXXX XXXX XXXX, not in its individual capacity but solely as Owner Trustee of XXXX XXXX XXXX is Select Porfolio XXXX XXXX XXXX XXXX XXXX I have also notified XXXX XXXX XXXX XXXX XXXX and they can not locate my account, or ss # as their client by them or any of their several partner, sister, child... ..organizations. I spoke to them ALL. I have never recieved a " Hello '' assignment or Note transfer letter since I purchased my property. After my purchase I found out that the house was over appraised {$100000.00} I thought " Obama '' bail-out would correct this. Since the inception of my loan my payments have not been allocated properly and the financial intitutions have failed to honor this loan since inception XXXX Note. When requested ; the Note holder information is improper or all together missing. The bank has mailed and shared my personal account information with strange people and locations.The banks have mis appropiated fees and arrears since inception. The banks have falsified property history documents to boost price ( House built really XXXX but on record in XXXX XXXX but in County Records XXXX based on bank misinformation ). The bank has falsified documents concerning legal property interests and liabilities ( on county record my sister purchased this house in XXXX by herself and then with me in XXXX ). The bank started a forclosure proceeding under false pretenses ( missing payments ). The bank aqcuired personal information under false pretenses as existing servicer. The bank aqcuired more personal information by using intimidation by means of legal litigation.The bank abused the legal system to ligitamize fraudulent documents. The bank since inception has violated Federal Respa Laws.

Consumer Complaint: I requested a payoff on our mortgage with select portfolio services attorney, XXXX XXXX. I left a message with her on XX/XX/XXXX. She did not return my call for over a week. When she did finally return my call I requested a payoff letter. As of todays date, XX/XX/XXXX I have yet to receive that payoff. We have had our house on the market and had an offer and a contract on it. That contract fell through because we could not get a payoff from select portfolio services and the buyer cancelled. I have requested a payoff letter XXXX times. XX/XX/XXXX, XX/XX/XXXX and XX/XX/XXXX. By phone and by email. They have cost us the sale of our home to avoid the foreclosure that is set to take place on XX/XX/XXXX. We are still in the process of trying to sell our home prior to the foreclosure date but without this payoff we can not. They are costing us a sale to avoid foreclosure. If we had the payoff in a good amount of time we could avoid the foreclosure. Requested escrow analysis to get overage for property taxes but specifically asked for payment not to decrease as the first year 's property taxes were based on the lot value and would be grossly under estimated for this year, if changed. Received check. Payment lowered. 3 attempts to raise payment have been made. XXXX ext. XXXX Discussed increasing payment back to {$3600.00} on XXXX at XXXX. He is getting with the escrow department to get payment increased after the escrow analysis. Calling me back. Never received a call. Called Back and spoke with XXXX ( dialed XXXX 's ext ) on XXXX at XXXX. Was told by XXXX to call back on Friday XXXX to follow up. Asked why they can't call me? She said that the outbound calls are automated and she suggested me calling back to follow up. Offered to send the Closing Disclosure to verify estimated taxes. No go ( I have attached for verification along with the title work- Please note that this is not my XXXX when reading ). Why is there no e-mail or messages that can be sent back and forth to track progress?

This balloon payment became required for me to make after several years of making a normal payment of {$1400.00}, then suddenly I am required to make this outrageous payment of at least {$81000.00} to keep my home. I was in process of getting a XXXX XXXX flex modification when my loan was switched to a new servicer select portfolio servicing. I have not gotten any answers as to what happened to the flex modification I was supposed to need put in from this new servicer. They tried to put me in a repayment plan that is {$14.00} more than my total monthly income of {$1000.00}! All without me submitting any financial documents to them. I can afford my regular payment with an additional {$100.00} towards balance of unpaid payments, but not much more. Please help, I'm a single, XXXX woman on XXXX and do not want to lose my home.

Consumer Complaint: I have applied for a loan modification. The servicer is stating there are no retention options available. I have been trying to do a loan modification and a short sale for the last 3 years and the bank is not offering me any options at this time. I spoke to the investor who stated that they do allow modifications and short sales and that SPS is the one who is making this decision although they allow both options. SPS states the investor doesn't allow the options, which the investor has stated isn't correct.

The first problem, SPS does not know, nor have they verified the current and rightful owners of the property. Therefore, they are foreclosing in the wrong Homeowners names, while failing to serve the rightful owners of the property, prior to advertising a foreclosure sale. SPS, Inc claims to work on behalf of XXXX XXXX XXXX XXXX XXXX XXXX ( the alleged creditor ). XXXX and XXXX claims to work as a Power of Attorney for The XXXX XXXX XXXX XXXX XXXXXXXX on behalf of SPS. However, XXXX has claimed on several occasion that their firm does not own the property or the loan. Per the Supreme Court of Georgia, only the secured creditor can foreclose. The XXXX XXXX XXXX XXXX XXXXXXXX is not the secured creditor, nor have they invoked SPS or XXXX and XXXX to collect a debt. We also had a Licensed Financial Private Investigator cross reference our findings please see attached. SPS has also instructed our homeowners ' insurance company to discontinue our decade plus old policy. Please see attached. SPS and XXXX and XXXX are engaging in illegal and fraudulent activity that is causing irreparable harm. We the rightful owners of the subject property have retained legal counsel. SPS, Inc refuses to acknowledge or communicate with legal counsel, hired to amicably resolve all matters surrounding the account. SPS, Inc in connection with XXXX and XXXX are attempting to sell illegally converted stock instruments, represent entities that have no interest in the subject property, perform an illegal foreclosure, theft by taking personal property, false and misleading representation, ignore homeowners counsel while interfering with their constitutional rights through deception, theft and fraud.

Consumer Complaint: I received a letter from Select Portfolio Servicing dated XX/XX/2022 stating that my mortgage is now being transferred to a new company called XXXX. I have an open and current dispute with Select Portfolio Servicing because they assumed my mortgage from XXXX XXXX and didn't transfer over the escrow analysis from XXXX XXXX. Instead of fixing my mistake which they were notified of on XX/XX/2022 they are now transferring my loan. I have at this point requested to have my escrow account removed because it wasn't setup correctly when the loan transferred and at this point I'm getting the run around instead of my issue corrected. I'm more than capable of paying my insurance and taxes and want to assume the responsibility as I can do it much better than the mortgage company can.
