Consumer Complaint: I was in forbearance with Select Portfolio Servicing. During my forbearance I was told that I had to pay {$390.00}. I would like to know where did they come up with {$390.00}? That is about the same I owe for taxes every month. I owe $ XXXX dollars or so in escrow fees. Why do I owe so much for my escrow when {$390.00} went to taxes. This is an offshoot of complaint # XXXX

Consumer Complaint: I have been making payments to my loan servicing company Select Portfolio Serving during my six-month long forbearance. Most of these payments were in excess of {$1200.00}. I only had to pay {$390.00}. I am very confused and dont understand where exactly did these funds go.

Consumer Complaint: I received documents about my proposed forbearance on XX/XX/2022 from Select Portfolio Servicing. I looked through my documents and it seemed that there was a signature page missing, but I was not sure. I went online on XX/XX/2022 and felt really lucky that SPS actually upheld the forbearance because when I downloaded the documents from their website I was actually missing several pages including the signature page. I never signed to approve my forbearance. I was very happy that all three times that I called SPS confirmed that they had not been tricking me and that I was really on forbearance and that all I had to pay was {$390.00} and that they still confirm that I was on forbearance. Thank you SPS.

Consumer Complaint: I am having all different kinds of problems with my mortgage loan servicing provider. Please look at complaints # XXXX, # XXXX, # XXXX, # XXXX, and # XXXX. I suddenly owe - {$2300.00} or something in my escrow account I am not sure why. I believe that I was told that while I was in forbearance that I had to pay {$390.00} and that this was going to be applied to my escrow account to pay for my taxes. I am not 100 % sure on this and I dont have a recording, but I do believe this is what they said. I am not sure why I owe a negative balance in forebearance. I think this is fraud.

Consumer Complaint: On XX/XX/ 2022, I spoke with a counselor at XXXX XXXX XXXX and Select Portfolio Servicing inc. a conversation that was recorded ( please see complaint # XXXX ). During the conversation the representatirive from SPS told me that I was going to be three months behind and facing foreclosure soon even though I was in forbearance. They told me that they had started a special account of unapplied accounts and that I had a balance of over {$400.00} and that if I paid {$350.00} dollars that suddenly I would not be 3 months behind in my mortgage payment, but rather only two. This was a secret that the representative said SPS didnt really want her telling me. My mother who is retired and does not have much income wanted to stop SPS from foreclosing on me. She was generous enough to pay {$350.00} to SPS on XXXX2022. This is how SPS tricked me and my mother into paying them an extra {$350.00}

Consumer Complaint: Select Portfolio Servicing Company told me that I owed over {$3000.00} and that I would soon be facing foreclosure even though I was in forbearance and that I had been making my payments. I was very scared. I called XXXX XXXX XXXX on XX/XX/2022, a conversation which XXXX XXXX XXXX and partially Select Portfolio Serving recorded. Select Portfolio Servicing tried to explain why I owed so much money etc. I also made a complaint # XXXX. Today XX/XX/2022, I called Select Portfolio Servicing and they have completely changed their story. Please listen to their new story which you will find attached. I suddenly only owe {$1200.00} for XXXX and that is only because I was tricked by SPS into ending my forbearance early by SPS ( see complaint # XXXX ). I am not facing foreclosure. Thank goodness except guess what they put me in so much stress. My mother made extra payments to them for no reason and I am very upset that they thought it would be okay to take advantage of anyone like they just tried to. Not to mention to me, a person who is XXXX XXXXXXXX and who was deemed to be too XXXX XXXXXXXX to handle their own check book by the Social Security Administration.

Consumer Complaint: Today, XX/XX/2022, I called the XXXX XXXX XXXX hotline and asked a representative if they record conversation between their counselours and clients. They confirmed that they do indeed record these conversations. I have a recording of them confirming this. On XX/XX/2022 at XXXX XXXX I made an a phone call to XXXX XXXX XXXX and I spoke with a counselor. The counselor and I discussed what was going on with my Loan Servicing Company Select Portfolio Servicing. Then we proceeded to call SPS. The phone conversation was very long and I still don't understand any of it. I forgot to record this conversation. I would like the CFPB to ask the XXXX XXXX XXXX hotline for a copy of this conversation. In this conversation SPS tries to explain why I owe them over {$3000.00} and am facing foreclosure. This is excellent evidence that will support my former complaint with # CFPB XXXX.

Consumer Complaint: On XXXX XXXX, 2022, I realized that I owed {$1200.00} for XXXX 2022, {$1200.00} for XXXX 2022, and was about to owe {$1200.00} for XXXX 2022. That I would owe over {$3000.00}. I had been told that I was in forebearance and that I only had to pay {$390.00}. Suddenly I was about to be in foreclosure and my forebearance would end on XXXX. I had paid the {$390.00} and most of the time over {$1200.00} a month during this forebearance. I was freaking out and was told the only way to avoid foreclosure was to end my current forebearance and apply for a new forebearance. The agent with SPS new that I had no income coming in and that I would not be approved for any new foreberance. They said that the only difference it would make for me to end my current forebearance and start a new one is that with my current forebearance I only owed {$1200.00} and that if I ended my forebearance early and reapplied I would then owe {$1200.00}. I thought the only difference was {$14.00}. That is how SPS tricked me into ending my forebearance early.

Consumer Complaint: I received a letter from Select Portfolio Servicing, Inc ( SPS hereafter ) dated XX/XX/XXXX stating that, effective XX/XX/XXXX, SPS will be servicing my mortgage loan number XXXX. Since SPS is managing my escrow account, SPS is responsible for paying my real estate property tax and the insurance premium when they are due. On XX/XX/XXXX, I called the SPS customer service number, XXXX, and talked to XXXX at extension XXXX. I asked whether SPS had already paid the property tax. I told XXXX that the property tax was about to become delinquent on XX/XX/XXXX and any payment received by the XXXX XXXX XXXX after XX/XX/XXXX will be assessed an additional 10 % penalty. I was told by XXXX that SPS had not paid it yet and SPS had until XX/XX/XXXX to pay the property tax. On XX/XX/XXXX, I called SPS customer service XXXX and talked to XXXX at extension XXXX. I was told that SPS had still not paid and that they had until XX/XX/XXXX to pay for it. On XX/XX/XXXX, I called SPS customer service XXXX and talked to XXXX at extension XXXX. XXXX told me that SPS had not paid the property tax yet, and if I want the property tax to be paid by XX/XX/XXXX, I can pay it directly to XXXX XXXX. I told XXXX that SPS had my tax payment money withheld in the escrow account and SPS should pay for it and I did not have additional money to pay the property tax directly to the County. On XX/XX/XXXX, I called SPS customer service XXXX and talked to XXXX at extension XXXX. XXXX said he was a relationship XXXX at SPS. He said SPS could not verify XXXX XXXX XXXX ( hereafter XXXX ) of my property and therefore they could not pay the property tax. I told XXXX that 1 ) SPS could easily search the XXXX on XXXX XXXX XXXX XXXX website; and 2 ) my XXXX is XXXX. XXXX said that SPS has XXXX plus employees working in the escrow department and they are professionals at handling property taxes issues. He said that if 10 % penalty is levied on my account, I will not be responsible for the penalty and that SPS will be responsible for the penalty. I wanted some assurance of that promise so I was transferred by XXXX to his supervisor, XXXX at XXXX XXXX, who reaffirmed that SPS will be responsible for the 10 % penalty if levied by XXXX XXXX. On XX/XX/XXXX, I checked with XXXX XXXX XXXX XXXX XXXX and found that SPS did not pay my property tax. A 10 % penalty was levied on my account. Over the next few months, I periodically checked with XXXX XXXX XXXX XXXX and found that the tax payment was still unpaid by SPS. On XX/XX/XXXX, I received a letter from XXXX XXXX XXXX Collector Office stating that the XXXX installment of tax was delinquent and {$580.00} penalty was levied on my account and the XXXX installment of the property tax was overdue and will be imminently delinquent on XX/XX/XXXX. See attached letter. I am wondering why SPS chose not to pay my property tax. If they could not verify the XXXX on XX/XX/XXXX, they should have been able to verify the XXXX by now since XXXX months have passed. Besides, I had already informed SPS of the XXXX on XX/XX/XXXX. My bigger concern is that the 2nd installment will be delinquent 18 days from now, and another 10 % penalty will be levied against me if SPS does not pay the 2nd installment on time. To further complicate the matter, the interest will start accruing on the penalty and XXXX XXXX XXXX XXXX will put a tax lien on my property. I have been paying the property tax in a timely matter since I owned the property in XXXX. This is the first time that a mortgage loan servicer such as SPS is paying for the property tax on my behalf out of the escrow account. I believe that SPS has the fiduciary duty to ensure the property tax be paid on time to protect the owners interest in the property.
