Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have two consolidated XXXX loans that were opened in XX/XX/XXXX and are serviced by Navient. The loans consolidated student loans that were originated between XXXX and XXXX. It appears that I may be able to qualify for loan forgiveness because of changes implemented to the IDR repayment plans on XX/XX/XXXX an updated on XX/XX/XXXX. It appears that if I convert my loans to a consolidate Direct loan under an IDR plan that the months I've been paying, in deferment and forebearance would all be counted to wards the 20years required for IDR forgiveness. However, Navient is not able to give me any information that i've asked to give me advice. All they say is to contact the board of education or FSA who refers me back to Navient. Navient has also advised me that they don't think student loan forgiveness will ultimately occur. I've asked for my payment records on my originating loans and for an explanation whether or not my commercially held XXXX loans will qualify for IDR conversion and or IDR forgiveness if I convert them to direct loans.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I recently contacted Navient my loan servicer to get 2 charges of {$110.00} removed. Last month on XX/XX/2022 they set up 6 month plan with me to pay the lowest amount which is around {$30.00} for 6 months. I had to pay a very small fee to do this. After this contract was completed last month, they charged me {$110.00} for XXXX and XXXX which is not what I consented to. The payments Navient does for the smaller amount in the contract is through autopay but the contract clearly states that the amount to be withdrawn is the amount in the contract not any other amount. Navient sent me a message this week saying that they can reverse the {$110.00} but doing so will be reported to credit bureaus as delinquent status for my loan. They also said the amount withdrawn on XX/XX/2022 was done by myself but the account is on autopay which is required for the contract. I did not authorize Navient to charge me 2 separate times of {$110.00} and they are trying to blame me for having auto pay on as if them making extra payments outside contract while Im on autopay is consensual which it is not. Autopay doesn't mean Navient can take out what and when they want it is designated for the contract amount once a month for 6 months and nothing more. Navient does not have the right to abuse autopay and tell me that I will be reported for delinquency to the credit bureaus when I am making payments via contract to them for 6 months. In the documents I will submit to you I will show the messages I got as well as the payments that show only 1 reversal instead of 2. So Navient is taking advantage of the autopay while trying to ruin my credit and they won't refund both of the XXXX illegal charges from their unauthorized transactions.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: It's hard to describe just how miserable Sallie Mae/Navient has made me, but I will do my best. In XXXX of XXXX, I was still newly married, but I had no job. My wife had just begun her career as a nurse, and we had our first child on the way. With financial pressures building up, I responded to an offer that I had received in the mail from Sallie Mae. Promising the convenience of lower payments, interest free deferments, and generally a much simpler process for paying our student loans, we immediately moved forward with consolidating our loans together. My wife had graduated from college with {$31000.00} in debt, and I was struggling to pay the balance from my year and a half in college, which amounted to {$26000.00}. This was without even having a degree to show for it. We did our best to make our payments ; There were times when we had to use the deferments due to economic hardship. I was either unemployed or underemployed for most of my twenties. But we did make payments, a lot of them. However, the payments, along with our other consumer debt, drove us to bankruptcy in XXXX. Every one of our credit cards was paid off because of this, and our total settlement fee was around {$2500.00}. What I noticed as I was going through our paperwork, that a portion of our settlement went to all of our creditors- including Sallie Mae. This seemed odd to me, since our loan with Sallie Mae was not discharged. It was our largest debt, and the payment had ballooned to more than our mortgage, as did the balance of the loan. But Sallie Mae STILL got almost half of our entire settlement for our bankruptcy. With capitalized interest, our student loan was increasing despite every payment that we made, and the payoff date kept moving further and further away. As of this writing, our payoff date is now XXXX of XXXX, when my wife and I will be almost XXXX years old. That means the loan itself will be XXXX years old by the time it is paid off - the same age as my oldest son, who by then will have been out of college for close to 13 years. I'm sure my story is not unique. What happened was Sallie Mae ( and Navient ) were deceptive and predatory, coercing my wife and I to sign on to a loan that is impossible to pay off, and when we were under extreme duress to the point of bankruptcy, they took money from our settlement payment even though they were not being discharged like every one of our other debts. The fact that we are supposed to pay for a loan until our children have graduated from college themselves, is robbing us from being able to plan for our future, but also makes it difficult to make ends meet some months. We were lead to believe that they were going to make our lives easier ; instead, they have chained us to a loan that is sinking us financially. A choice I made when I was XXXX should not affect my life until I am nearing XXXX age.

Issue: Dealing with your lender or servicer

Subissue: Keep getting calls about your loan

Consumer Complaint: I have been receiving phone calls at least XXXX out of XXXX days a week and sometimes up to XXXX calls per day from Navient. I am the co-signer of private student loans for my daughter. My daughter recently moved from XXXX to XXXX and was unemployed while job searching for about XXXX months. She said she spoke with a representative from Navient explaining her situation and thought the matter was cleared up; i.e. a delay in payment. Navient did not take this into account and called me incessantly. My daughter had asked for a consolidation of her Navient loans in the past but that has never occurred. I truly just want this company to work with the students taking out loans. We were presented with no choice when my daughter went to college and had to apply for loans. I understand that I took on a responsibility when becoming co-signer but never expected this level of loan shark tactics and harassment.

Issue: Attempts to collect debt not owed

Subissue: Debt is not yours

Consumer Complaint: Navient is a student loan debt, collecting agency which has sent me numerous postal and digital correspondence attempting to collect a debt. I responded on, XX/XX/2022, by simply asking for this company to provide three things : validation that this debt belongs to me, verification of this debt belonging to me, and for a copy of the original contract containing my signature and the signature of a Navient authorized representative. Since then Navient notified me, XX/XX/2022, that it had started a credit fraud investigation, untruthfully stating that it's per my request, on XX/XX/2022. I never requested this. Navient has sent via postal mail dated XX/XX/2022, a documented list of loan disbursements, interest accruals, and a promissory note. Neither of the aforementioned documents validate or verify that this debt is mine nor does a promissory note equate to a contract ; note, this was my postal response to them on XX/XX/2022. The promissory note contained the printed name XXXX XXXX XXXX, but no signature from either side. If this is a legitimately, legal business, there should never be an issue with providing, verification, validation, and the contract. Paying what I owe legally is desirous, but paying without legal validity is consumer abuse. As of today, I have received another digital correspondence from Navient dated XX/XX/2022, stating they have begun another credit investigation. I did not request this either. This " company '' is using its resources to degrade my credit and threaten my livelihood.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I transferred my FFELP loans serviced by NAVIENT to DIRECT LOANS serviced by XXXX XXXX. I applied for this transfer ( re-consolidation from FFELP to XXXX ) on XX/XX/2022. The estimated payoff on that date per NAVIENT was {$110000.00} in subsidized loans and {$53000.00} in unsubsidized loans. NAVIENT received payment in full on XX/XX/2022 of {$160000.00}. {$110000.00} was paid to subsidized loans and {$53000.00} was paid to unsubsidized loans serviced by NAVIENT ( more than the amount stated when the re-consolidation was applied for at XXXX on XX/XX/XXXX ). Prior to transfer of these loans to XXXX XXXX these loans were in an XXXX payment plan. The payment amount was XXXX. NAVIENT now states, after the loans were paid off and transferred, that I owe NAVIENT {$92.00} per my conversation with them on XX/XX/XXXX. This is inaccurate. The monthly payment was {$0.00} under XXXX prior to the loan transfer/re-consolidation to servicer XXXX XXXX XXXX I do not owe NAVIENT {$92.00}. The entire loan amount held by NAVIENT was requested to be transferred to XXXX XXXX. No remaining amount should be held my NAVIENT. Moreover, NAVIENT was paid more ( additional interest ) than they stated the payoff amount was for these loans. The current interest rate on these loans is XXXX percent. Please assist with having this resolved as soon as possible. Thank you!
