Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I read about the Navient lawsuit alleging that they steered loan recipients to forebearance when an income based plan would have been better for them. Navient did this to me. I was in forbearance for years after I graduated when I could have been on an income based plan and still had no monthly payment. That would have been a better option for me.

Subissue: Received bad information about your loan

Consumer Complaint: In XX/XX/2011 I consolidated my student loans with Navient. I chose to conduct my student loan business with Navient because of the Public Service Loan forgiveness program that they told my I qualify for. I qualify for the Public Service Loan Forgiveness program because I am a XXXX XXXX XXXX for a XXXX. When it was time for renewal of my account three years later I was told I was not on a Public Service Loan Forgiveness program. I believe Navient misled me for me to consolidate and become a customer. I have made several attempts to e-mail/phone calls regarding the matter. The public service loan allows forgiveness of student loans after 10 years. If Navient had not misled me I would have my loan forgiven in 2 years.

Consumer Complaint: I have contacted Navient several times and they will NOT honor the postponed due dates as noted in the email. They are confusing the one month deferment provided to all customers and rate reduction program I was in. They will not current the problem. They are misrepresenting what they should be honoring.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I have a loan through Navient and I am unable to pay it because they do not have my correct birth date. I can not log in because I have to validate who I am and it doesn't have my correct information. I've tried to call so many times over the past couple of years and they tell me they can't even talk to me because they can't verify who I am. They just keep pushing my account into forbearance and I keep gaining more debt from interest and ruining my credit. I've been trying to fix this for so long and I'm feeling completely hopeless now.

Consumer Complaint: Continued messages left on voice mail from Pioneer Credit Recovery asking to call regarding debt collection. I have NO outstanding debt of any kind. Company information Pioneer Credit Recovery , Inc . XXXX XXXX XXXX. The XXXX has posted 3 separate notices of government action against Pioneer Credit Recovery. There is also a statement regarding the U.S. Department of Educations decision to cancel their contract with PCR due to allegations they werent engaging in fair and straightforward practices in compliance with Federal and State laws. In addition, the XXXX has closed 261 complaints against PCR in the preceding 3 years, with 42 complaints closed in the past 12 months. The majority of these complaints alleged problems with customer service, with 85 of the complaints alleging problems with billing and collections. Since XX/XX/XXXX, the Consumer Financial Protection Bureau ( CFPB ) has received 68 complaints about PCR. XXXX lists at least 20 cases of civil litigation involving PCR. '' " Currently, there are three pending actions of civil litigation against PCR formally brought by a government agency that have not yet been resolved. Two cases were brought by the State Attorneys General of Illinois and Washington. The third case was brought by the CFPB on behalf of the federal government. In XX/XX/XXXX, the Illinois Attorney General filed a lawsuit against Navient Corporation, its subsidiaries Navient Solutions Inc., Pioneer Credit Recovery Inc., and XXXX XXXX XXXX and Sallie Mae Bank, over widespread abuses across all aspects of its business, including student lending, student loan servicing, and student loan debt collection. Also in XX/XX/XXXX, the Washington State Attorney General filed a lawsuit claiming the business is in violation of state law prohibiting violations of the Consumer Protection Act, relating to the origination, servicing and collection of student loans. ( Those practices included improperly steering financially distressed students toward short-term for bearances, engaging in aggressive and misleading collection tactics, and more. ) In response, PCR alleges all the charges are unfounded, and that the timing of these lawsuitsat midnighton the eve of a new administrationreflects their political motivations. The third action was filed by the CFPB. In a 66-page indictment, the CFPB has alleged widespread fraud and abuses by Navient and its subsidiaries, including violations of the Consumer Financial Protection Act ( CFPA ) ; the Fair Credit Reporting Act ( FCRA ) ; and the Fair Debt Collections Practices Act ( FDCPA ). Charges include allegations that Navient and its subsidiaries routinely steered borrowers to repayment plans they knew would result in higher costs to borrowers ; deliberate misadministration of payment processing and repayment program enrollment ; deliberate misreporting of credit information to the credit reporting agencies ; deliberately misinforming borrowers about credit reporting practices and collection fees ; routine payment processing errors ; and other deceptive and unfair practices that often resulted in financial gain to Navient and its subsidiaries. PCR posted a response to this action that also denied wrongdoing and accused the CFPB of being motivated by politics. Details of these complaints, including the entire 66-page indictment from the CFPB, can be found under the Alerts & Actions tab on the profile page for Pioneer Credit Recovery on the XXXX website. Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been trying to pay my loan in advance. But each time I make a payment, the next due date does not advance. After complaining here, one of my lenders Consumer Advocates assured me that he would manually change the due date whenever I made a payment. That isn't happening, moreover, he appears to be no longer employed by Navient. My email to him bounced and the extension is no longer valid. When I tried to call the consumer advocate office, after being on hold for 10 minutes, I was told to leave a message and they would return my call in 48 hours ( an unacceptable delay ). This issue has been going on for over a year. My account is set up to have payments apply to the next due date -- and it doesn't happen. Each time I make a payment, I have had to spend close to an hour to get the payment due date moved forward. This is unacceptable. I should also note that the response Navient has provided to the CFPB is false. Previously, the reason these payments aren't applied to the next due date is because I have a consolidation loan with both subsidized and unsubsidized federal loans and they can't apply a payment to one without the other. But I have my payments set to apply to both on the same prorated basis as there would be for any normal monthly payment. I can not be the only Navient borrower who wants to pay in advance. For several years, this wasn't an issue ; but only became one about 18 months ago. Suddenly, they are " unable '' to apply payments to future due dates. I am sure this is in the hopes they can hit these borrowers with late payment fees and the like even though we have paid in advance.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I contacted the student loan servicer, Navient, several times over the phone in good faith to fully understand my income-driven repayment plan ( REPAYE ) and associated loan forgiveness. I spoke to at least three ( 3 ) different representatives, and each had varying answers to my questions, including basic information like start and end dates of my repayment plan. Finally, fed up with the ever changing information supplied by Navient, I asked them to email me answers to my questions. However, they declined to put anything of substance in writing. I am formally filing this complaint to make you aware that Navient is intentionally refusing to supply important and necessary information about my student loan, including forgiveness terms. I have nothing in writing to assure me that my loan will be forgiven at the end of the income-driven repayment term. I don't even have a straight answer on when the term started and when it is supposed to end. Navient is making it absolutely impossible for hard working individuals like myself to plan a healthy financial future. They are setting people up for failure.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: In XXXX of 2019, I began to review my annual credit report. At this time, I began to notice several inaccuracies with my student loans services through Navient. From that time, there has been over 27 changes regarding the balance as well as the payment history. At this time, I am unclear of if ANY of the information from Navient is or has ever been reported and calculated correctly. This has made a very negative impact to my credit score and my ability to obtain credit from potential lenders. I do not trust that any the information has been reported correctly, or, that my balance to date including the calculation of interest is correct. I am requesting a formal investigation take place on my account. I want to have all statements and ledgers provided to me showing each payment that has been made from the inception of all loans. I also request that I be provided with the method is which the interest is being compounded and applied towards my account from inception, and a ledger indicating this in writing.
