Navient claims to be unaware of the discharge and that I owe them the remainder of the student loans. As the amount owing far exceeds the amount of tuition it would have been wiped out in bankruptcy. CREDITORS LACK OF COMMUNICATION REGARDING DEBT Please note that at no point between the bankruptcy XXXX on XX/XX/XXXX and the filing of the first arbitration lawsuit on XX/XX/XXXX, did the creditor or their attorneys attempt to contact me about what they deem to be an outstanding debt. I did not receive anything via mail, email or phone regarding this or any other XXXX debt. No attempts to collect this debt or otherwise communicate with me were made before filing the lawsuit in question. CONTACT WITH CREDITORS ATTORNEY I have attempted to notify the attorney for the creditor regarding the XXXX debt by phone on multiple occasions. They did not return any of my phone calls. I also provided a copy of the Order of Discharge ( Form XXXX ) via email on XX/XX/XXXX. I did not receive a response beyond the automated receipt response. Finally, I personally handed a copy of the Order of Discharge ( Form XXXX ) to the creditors attorney during court proceedings on XX/XX/XXXX. Again, no one responded via phone or email. FILED MOTION TO QUASH SERVICE OF PROCESS I filed a Motion to Quash Service on XX/XX/XXXX, disputing the receipts of summons, as I do not believe the Plaintiff/Petitioner followed proper procedures for serving me with the summons and complaint. Service of summons was not made : ( XXXX ) by leaving a copy of the summons with me personally, ( 2 ) by leaving a copy at my usual place of abode with a family member of the age of XXXX or upwards, or ( 3 ) by informing me of the contents of the complaint/petition. I requested that all proceedings be suspended until I receive proper notice and documentary evidence from the Plaintiff/Petitioner. The Motion to XXXX was denied on XX/XX/XXXX, despite the creditors attorney stating that I was served via substitute service at my parents ' residence and providing to the Judge a physical description that did not match that of either parent. Consumer Complaint: Navient has repeatedly called and harassed my family, my nieces ( who were not even born when I started college ), and ex 's people I have not seen or heard from for 30 years or more. These people do no know my business. and calling my ex just places me in danger. i had a Income driven plan with them and they did not recertify me after 3 years. When I asked why I got no reply. They wanted me to pay them more than my monthly income. I am now retired XXXX on a fixed income. They have MY phone number they will not work with me. I am being harassed and I have complained about this before. When they called my ex husband. they are NOT working with me on this situation and after paying on time with the IDP THEY CANCELLED IT NOT ME.

Consumer Complaint: I am a private student loan account holder with Navient. I requested from Navient a detailed student loan payment history that includes the bank accountor at least the last four digits of said accountfrom which my payments to Navient were withdrawn. Navient has refused to provide me with this information. By way of background, I am in the middle of a process to have my past student loan payments reimbursed. Among other documents, the reimbursing party wants two documents : ( 1 ) the bank statement showing the withdrawn payment; and ( 2 ) my student loan servicers payment history showing acceptance of the payment. All this is to say that they simply want me to demonstrate that I made a student loan payment from my bank account. However, for the payments in question, there are no existing bank statements because these payments that I made to Navient are over 7 years old. According to XXXX XXXXmy personal bank from which these payments were withdrawnthey do not keep bank statements over 7 years old pursuant to federal law. After working tooth-and-nail with XXXX to otherwise obtain these statements, it was clear that the statements do not exist. That said, the reimbursing party advised me to find another source of this information, so I called Navient. And indeed, I was advised by Navient that Navient has this information on its end ; this information is not available on my end. To acquire this information, I submitted XXXX requests over 2 months ( XXXX and XX/XX/2023 ) to have produced a more detailed payment history with the bank account information but was ultimately told on my 4th phone call ( dated XX/XX/2023 ) that it is Navients policy to not disclose such information. After going back-and-forth during the 4th phone call, the worker from Navient with whom I spoke instructed me on my options. He advised that I could mail a hardcopy request ( which he admitted would likely be futile ) and/or initiate legal process, i.e., a subpoena. I think it is perfectly ridiculous that I would have to undertake legal process to simply obtain bank account information for payments that I made to a student loan servicer. The worker with whom I spoke at Navient during the 4th phone call advised me that the main issue is the risk that a writing with the bank account information will be lost, intercepted, or otherwise possessed by a third party, thereby rendering Navient liable. I made it demonstrably clear how absurd this policy was, given that another Navient worker had advised me orally over the phone which bank account the payments were withdrawn from and that Navient could simply send the information over a secure email or through my account portal. That is the gist of my complaint. Thank you.

Consumer Complaint: I took out a {$15000.00} " signature student loan '' private student loan from XXXX XXXX in XXXX and because my credit was not good, I needed a co-signer. This loan was in addition to federal loans taken to cover living expenses and costs for school XXXX XXXX XXXX University XXXX campus in XXXX Fl. I was a part time XXXX and working full time. For many years, until XXXX, we paid the best we could until my exhusband and I filed for XXXX XXXX bankrupcty and was ordered NOT to pay this account. The intersest capitalized and the loan grew and grew until payments continued in XXXX. In XX/XX/XXXX, the loan topped out at {$18000.00}. I continued to pay the best I could until another personal XXXX XXXX bankruptcy in XXXX. To date, I have paid over {$15000.00} on this loan. I still owe {$11000.00}. I have attemped to remove my co-signer a few times and every time it is denied. The interest rate is above 7 %. My loan was not included in the Multi-State Navient settlement because the company says that I was never deliquent. I argued with them that XXXX separate bankrupcties is delinquency and that there were more than XXXX months of missed payments. I think Navient/Sallie Mae has collected my debt unfairly as this private loan should have been discharged with my bankrupcties. Please let me know how I should proceed.

Consumer Complaint: On XX/XX/2023 Navient student debt collection called my personal cell number for someone elses loan. They left a message claiming it was urgent, and that I needed to call them back regarding a business matter as soon as possible. When I called back and asked how they received my number for someone else 's loan, they claimed my number was listed as a contact on the account. That is untrue, and I told them so. Being single and not listed as anyones contact, I knew they were being deceitful. After asking 3 times where they received my number and stating I was filing a complaint, Navient then changed their story and reluctantly stated they received my phone number from " skip vendors '' but wouldnt be more specific. I demanded my number be removed from her database as I have not had student loans in over XXXX XXXX. They are obtaining numbers in a malicious and dishonest manner.

Consumer Complaint: Navient bought my loans from Sallie Mae, sold them to a collection firm in XXXX and now I am being garnished from another collection company in XXXX XXXX called XXXXXXXX XXXX XXXXXXXX, even though part or all of these are supposed to be discharged! ( See below ) Sallie Mae has claimed private loans were sold to Navient, then Navient refuses to deal with me, as they were sold off to XXXXXXXX XXXX XXXXXXXX collections in XXXX XXXX. As per my understanding, the following has taken place and applies to me : To qualify for discharge under the Navient settlement, a private student loan must have been originated between XXXX and XXXX by Sallie Mae ( SLM Corp. ) and must have been charged off by Navient as of XX/XX/XXXX. Additionally, the loan must meet one of three conditions. The borrower at loan origination had a FICO score below XXXX and attended a for-profit school or below XXXX and attended a non-profit or public school The loan was used to attend of the for-profit schools included here under # 6. The loan originated under Sallie Maes opportunity or Recourse program. I did have a FICO score under the XXXX and attended a non-profit school within the time frame of these loans being offered. XXXXXXXX XXXX XXXXXXXX, through Sallie Mae and Navient, is still collecting on these even though this took effect over a year ago! In other words, XXXXXXXX XXXX XXXX jumped on this in XXXX, knowing this was NOT supposed to take place. Dealing with this group is very difficult. They never act forthright, use courts to intimidate and bully, collect on my pay through back door means and likely bought this debt for pennys on the dollar, yet are collecting it all!
