Consumer Complaint: I am not sure exactly what options for what this problem categorizes under. My problem is with Navient collecting on a private consolidation loan that should be discharged in bankruptcy. I am the cosigner of a private consolidation loan through Navient for my daughter. I have gone bankrupt in XXXX and she has gone bankrupt in in XXXX and XXXX. Yet Navient continues to collect on this loan despite being sent discharge orders from myself and my daughter. My daughter has continued to pay as to not ruin hers and my credit. My lawyer automatically said that since its a student loan it can not be discharged in bankruptcy unless you prove undue hardship which I know is virtually impossible to do. Upon hearing this, I brushed it aside much like my daughter did because it is widely understood that student loans cant be discharged. My daughter is also a full class member of the XXXX XXXX XXXXXXXX lawsuit and is in the process of getting her federal loans discharged. The schools she went to are the former XXXX University and former XXXX XXXX XXXX both of which have closed and are on the list of schools included in the lawsuit. I recently read an article the CFPB has written about heightening its scrutiny against private student loan servicer on people who have gone bankrupt. I have attached the article. I am not sure if I am allowed to attach bankruptcy discharge papers which has personal information on it but will send it upon request.

Consumer Complaint: To Whom It May Concern : I am writing to express my dissatisfaction with Navient, my student loan servicer. In 2005, I consolidated my student loans with a different company, agreeing to a 2.25 % interest rate for 25 years. However, a few years later, my loans were sold to Navient. Navient informed me that my interest rate had increased to 2.85 % and that my repayment period had been extended to XXXX. As a result, my monthly payments increased from {$220.00} to {$280.00}. I have been paying my student loans faithfully for many years, but my balance has not decreased significantly. In fact, it has actually increased from {$43000.00} to {$52000.00}. I believe that this is due to the high interest rates and the extended repayment period. I am also concerned about the way that Navient has handled my account during the COVID-19 pandemic. I was unable to work for almost a year due to an injury, and I requested a pause on my student loans. However, Navient told me that I was not eligible for pause, and they instead placed my account on a forbearance. during this time i was out of work for almost a year. then i found out they took money out of my bank account without informing me. As a result, I was still required to make monthly payments, even though I was not able to work. I am writing to you asking if Navient practice and legal and legit. Ii had other loan and mortgage in the past that change lender, but can they change the terms and payments plan legally without my permission. I also want to know what legal right do I have in regard to my circumstance. I would appreciate it if you would contact me as soon as possible to discuss this matter. Consumer Complaint: I reported to XXXX and XXXX that Navient is reporting my closed account XXXX as having a high balance of {$29000.00}. This is incorrect. When the account was closed, the balance was {$120000.00}. Navient correctly listed the amount while the loan was open, but when the account was closed, suddenly the account had a high balance of {$29000.00}. The interest alone on this account was {$110000.00} Navient 's practices are deceitful and dishonest. Navient is making it sound as if this {$29000.00} took 29 years to pay off and its harming my credit score.

Consumer Complaint: I had student loans taken out in XXXX. Navient bought out Sallie Mae, my servicer. Navient has not submitted information to XXXX XXXX ( DOE ) that payments were made prior to them buying Sallie Mae. Navient has that information because I can see it when I log into my payment history. It shows XXXX to XXXX. But what was submitted to XXXX was XXXX on. I can not get my XXXX qualifying payments because not enough exist at XXXX. It's been a full year since requested and Navient has not sent on my full payment history. My loans from XXXX should also count but those were with DirectLoans, and XXXX and XXXX but those put me far over so I don't need them as much as I need the ones from Sallie Mae and Navient. At no time did I request changes in servicers, the switching was at their business end selling my loans.

Consumer Complaint: XXXX aka XXXX XXXX XXXX , XXXX, called my father and left threatening messages and where I was about a student loan serviced by Navient. The person really upset my father, as not only did he know where I was, he was being called and threatened. My father is willing to make a statement about the constant phone calls threatening him and I. I got the number of the XXXX collector, and he told me I had to pay {$18000.00}, with a total due of {$19000.00}. I was at the time homeless and in XXXX with the Veterans Administration. I had also applied for Federal Loan Forgiveness, ( XXXX Discharge ) and it was approved. I negotiated two payments of {$3200.00}, ( {$6500.00} ) which was debited from my savings by Navient not XXXX. This was all a shady collection tactic because I believe they knew that Navient was about to forgive all of my private loans once they were contacted by XXXX ( XXXX XXXX XXXX ) & The Dept. of Veteran Affairs. I think that XXXX new this was the case but still took the money which is unfair. My father is still traumatized by the nasty collections tactics they did, in which nasty and threatening conversations were threatened towards me via my Father and directed at my Father, with threats that if he is harboring me then he is liable. I was getting treatment for XXXX and XXXX XXXX from Military XXXX XXXX ( XXXX ). ALL other Navient Private Loans were forgiven as soon as they were contacted by XXXX that I was awarded a XXXX ( XXXX XXXX XXXX XXXX XXXX ) and Navient was also contacted by the Department of Veteran Affairs. I was homeless and then at the VA 's Domiciliary at the time. I spent 21 years intermittently homeless due to untreated XXXX from Military XXXX XXXX.

Consumer Complaint: Navient reported to XXXX Credit Report that my balance increased by {$100.00}, this caused my credit score to decrease. I have been paying on this account for many many months over 2 years without covid19 suspension of payments and this company reports negative information to my credit report. The balance of student loan is fraudulent as I never got a payment of the monies that were not used at XXXX XXXX and I never got any payments of monies that was not used from U of AR XXXX. When I disputed this, there was not an investigation. They bill me extreme added fees of interest and they never showed payments that were paid for 10 years after I graduated in 2002. The student loan has been a rope around my neck to freeze my credit score from improvement. This has took away from my education for years of rebutting navient bad unfair practices.

Consumer Complaint: I am writing today to raise an issue with Navient. During the covid pauses Navient did not stop charging. The allowance of this is shameful ; however, this created another very concerning problem for those of us whose federal loans are held by multiple services providers. Namely, Navient now thinks it should be able to force IBR recertification on dates not congruent with all the other federal loans, meaning that borrowers like me now have two separate IBR recertification dates. The Navient one is not noticed or visible through the federal system, despite the loans they are servicing being federal. This is a logistics nightmare and will cause borrowers to miss deadlines and be uninformed as to the correct recertification deadlines. Missing one of these deadlines has critical consequences and thus this treatment of borrowers should not be allowed. Navient should instead realign their due dates for recertification with the federal due dates for all federal loan holders. Who can assist me in resolving this issue?

My brother is not a cosigner nor is responsible for making payments on any of my finances. According to 805 ( b ) of the Fair Debt Collection Practices Act, it is illegal for debt collectors to call your family members to discuss your debt.
