Consumer Complaint: Navient As one of the many affected by the lack of implementation of the Joint Consolidation Act, XXXX, my former spouse and I have been working towards the long term administrative forbearance that has been requested by the Department of Education XXXX My former spouse claimed XXXX XXXX bankruptcy in XXXX, which put the joint account into a bankruptcy forbearance. ( I had no knowledge for months that this had occurred, as I was working towards getting our IDR payment plan recertified ). I was told by Navient that in order to get the discretionary administrative forbearance as the Department of Education had outlined, both my former spouse and I had to be on the line together. As my ex and I are amicable ( to a degree ), I was finally able to get her on the phone with myself and a Navient account specialist on XX/XX/XXXX. On that call we both verbally requested that the bankruptcy forbearance be rescinded. The CSR, who had spoken to a supervisor about this process, said that it would be sent to the next level of bureaucracy to be discussed and that we should have a decision by XX/XX/XXXX, at which time one of us could call back and have the loan put under the discretionary administrative forbearance outlined by the Department of Education. I called on XX/XX/XXXX & spoke with a CSR named XXXX, who indicated that the request for rescinding the bankruptcy forbearance had been denied. No reason was given. After escalating the call to a supervisor, I received the exact same information : The request was denied on XX/XX/XXXX. No further information was available. I continued to make " What if? '' statements to try to find out what mechanism was necessary to make this happen, such as a letter from the bankruptcy attorney or even a letter from the bankruptcy judge citing that the XXXX was to be excluded from the bankruptcy. No information was available. The supervisor finally said that since it was in bankruptcy, the guarantor of the loan may have more information. XXXX at XXXX. As the loan is in my former spouse 's name and I am listed as a co borrower, I can not get access to any information with XXXX. We need to know how to get this bankruptcy forbearance removed from this JOINT loan. If the loan stays in the bankruptcy forbearance, both the former spouse and I will miss out on months, if not years of PSLF counts, as the administrative forbearance will count towards PSLF, whereas the bankruptcy forbearance time will NOT. Both of us have been XXXX XXXX XXXX for 25 years ( I'm on year XXXX ), have never been eligible for any XXXX forgiveness program, PSLF program, etc. due to being in this Joint Spousal Consolidation Loan program, which was abandoned on XX/XX/XXXX.

Consumer Complaint: I have called Navient, XXXX, XXXX XXXX, and Student Aid. Nobody can tell me whats going on. First, the two loans that were with Navient, that are reporting me late were consolidated. They were for XXXX XXXX university that was part of the XXXX XXXX XXXX settlement and should not be on my credit report. But this is the biggest issue, XXXX doesnt have these consolidated loans that are reporting me late on my credit! Nobody can figure out whats going on. Navient suggested I call borrowers defense however borrower defense said they can not help with my reporting. XXXX said they dont have these consolidated loans! SO WHERE ARE THEY? AND WHY ARE THEY ON MY CREDIT? Somebody please figure it out!

Consumer Complaint: Per the new Navient Bankruptcy Settlement, Navient must refund any funds collected post XXXX XXXX on Private Student Loans. The " Private student Loans '' were included and you received notice for the meeting of the Creditors back in XXXX. The 2 Private Loans were Predatory. The loan amount for a non-certified degree for which I was misled by the school, Amounted to XXXX ( variable interest pd {$6500.00} ) and XXXX ( variable interest pd $ {$13000.00} ) respectively. The cost of the loans was {$14000.00} of which almost XXXX was refunded to the school. The total cost you billed me post XXXX XXXX was $ ( XXXX + [ accrued interest - ( XXXX ) = XXXX ( accrued interest fees ) ] TOTAL = {$33.00}, XXXX more than double the amount initially borrowed. Furthermore, NO fees should have been collected post my XXXX XXXX Discharge as I was still recovering from my double mastectomy where I had to have about XXXX XXXX due to them finding more XXXX after initial XXXX possibly due to all the stress you were causing me that affected my health negatively. I ended up paying almost the interest as mentioned was exorbitant. The magistrate knew this was a hardship as I had recently recovered from XXXX XXXX XXXX starting XXXX and ending in XXXX. I had numerous medical bills that were not covered/authorized by my insurance and this is why I had to file for XXXX XXXX.

Consumer Complaint: I attended several for profit schools. Navient currently handles my private student loans in the tune of XXXX dollars. My private student loans should have been covered under the class action lawsuit brought against Navient for their illegal practices. The original loan balance was XXXX dollars and now it XXXX XXXX. Navient has proven to be a criminal enterprise that prays on peoples with these predatory loans. I was told that my loans did not qualify for forgiveness because I was in bankruptcy at the time of the lawsuit was in place making my loans current. Had I not filed for bankruptcy my loans would have been part of the discharge. Im hoping you can help resolve this issue and do the right thing and stop this criminal enterprise from further ruining my life as well as everyone elses life who are in the same situation. Please look into this and help with a resolution. Thank you!
