Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I called Navient to ask for a PAY OFF BALANCE. I was talking to Navient. They indicated a false balance and said I was eligible to just pay 4 lump sum payments and have the rest forgiven. I followed their procedure, made 2 of the 4 payments, then receive a letter from the US Dept of Education with correct balance information and how this company enrolled my into a Income driven IDR consolidation that is incomplete. The company that serviced the consolidation is a fraud entity called XXXX XXXX XXXX XXXX, XXXX. I call them to get an email of the contract they set up with me. They digitally put my signature on a contract that I would have never signed. The language is beyond misleading and does not make sense. I call them, they reiterate false information about how the balance will be forgiven. I tell them to cancel. I call my bank to cancel my debit card. I am now seeking to be placed on the class action lawsuit. I have lost {$1400.00} from this misleading information process. I wanted to pay off my balance, and trusted the agent in what she was telling me. The phone call took place in XXXX, 2020.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have been paying {$670.00} since XX/XX/XXXX. Prior to that, I had been paying more than the monthly payment when I found out that none of the overpayment was going to additional principal, but instead was going to future payments. To my surprise, my current statement for XX/XX/XXXX still carries the same principal Balance from over two years ago. Apparently, I have been making interest only payments, and none of the required payments have been going toward principle.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Private student loan servicer Navient has been making CONSTANT phone calls to me ( from phone numbers that my phone carrier flags as " spam '' or " possible scam '' ) to HOUND me MERCILESSLY about making a payment that, by admission on Navient 's own statement, IS NOT EVEN LATE YET!!! This situation could have been mitigated, or even completely avoided, if Navient had refrained from sending me a semi-literate letter indicating that my forbearance period was coming to an end on XX/XX/2020, without ANY indication of when the next payment would be due, the payment amount, etc. It would have literally required an additional sentence on the semi-literate letter that Navient sent to me - this is hardly rocket science, and is not something that I, as the borrower, should be required to brainstorm or to fix for a multi-BILLION dollar corporation like Navient.

Consumer Complaint: I have been a XXXX XXXX for 16 years. I made my payments on time with a goal of having loan forgiveness due to being in a public service position. During all of my years with Sallie Mae & Navient, they told me about having to make all payments on time, however, I was never informed that I had to have my students loans moved into a PSLF loan until about a year ago. So now, I would have to apply for PSLF and pay off another 10 years. Ill already have them paid off on my own by then. So frustrated and so disappointed!

Consumer Complaint: When I consolidated my loans back in XXXX with Navient, they told me in 10 years I would be able to have my loans forgiven since I work for a non profit. 17 years later, I found out they were dishonest about my loan and I am still paying on it after working in the nonprofit field for 20 years.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Navient has been reporting my student loan as a charge-off status since XXXX but the account has been delinquent since some time in XX/XX/XXXX-XX/XX/XXXX. The delinquency is greater than 7.5 years old and would have been removed from my credit report had they not reported my last date of payment was on XX/XX/XXXX. This payment was made by the co-borrower, my father, when he settled his portion of the loan. Unfortunately he was misled by Navient and thought he was settling the loan in its entirety. Navient then put the account in to charge-off status in XXXX and has been asking for the full amount ( including the co-borrower portion that was settled ) to be paid by myself. I believe this is a deceptive tactic. I also believe they can not continue to report inaccurate information to the credit bureaus. I have tried to reach out to them several times since XX/XX/XXXX. Their only response has been to forward me to a third party collection agency for settlement or to get me to settle the loan for its entirety including paying the amount my co-borrower already paid when he settled his portion. I have also disputed the incorrect date of last payment with the credit bureaus multiple times over the past year. Navient continues to say the information being reported is correct despite having letters from them and the payment to Navient from my co-borrower bank account reflecting the XX/XX/XXXX payment was made by the co-borrower not me.

Issue: Dealing with your lender or servicer

Subissue: Problem with customer service

Consumer Complaint: I need your help in regards to problem I continue to have with Navient Student Loan services. I have been dealing with them for several months regarding my son 's student loan that I co-signed on. Due to both of us losing our jobs in XXXX through XXXX and not being able to gain employment until XXXX, we could not pay on the student loans. This summer during the month of XXXX and XXXX I started getting calls and emails to my work number and work email address. I filed a complaint to you all and they have stop doing that. I told them I could only pay {$200.00} per month on the loans which I did in XXXX and XXXX. Three days after I made the XXXX payment, they defaulted on the loans. Then I get an email from their recovery unit about options. They started calling me again, during work hours. I sent several emails advising them of my options to pay {$200.00} per month and that calling me during work hours is not an option. There is no available time to call them after work or weekends since they only accept calls during XXXX to XXXX eastern time. I am on the XXXX time zone so those hours are either too early in the morning for me or not late enough in the evening. So I have ONLY one way of communicating with them and that is through email. I get an email today saying that I have not tried to contact them and that if I don't then they have no option but to go to the next level. Well that is a complete lie. I have contacted them SEVERAL TIMES through email. They only responded once through email telling me that the payment option I provided them was not acceptable. I don't feel that Navient wants to works this out in good faith and just going through the motion to pretend that they are. I have asked for documentation on options and they refused to give me any. They just simply ignore my emails and continue to call during hours that I am not available. I really don't understand why Consumer Financial Services or XXXX XXXX XXXX is not going after Navient. They break all debt collection regulations by calling/emailing people at their employment. They hack into businesses network to get email addresses ( that is the only way they could have gotten my work email ). I don't know what else to do. Can you guys please help.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I have sent 7 previous letters to the US Dept of Education and Navient, XX/XX/2020, XXXX XXXX, XX/XX/2020, XX/XX/2020, XX/XX/2020, and XX/XX/XXXX and XX/XX/2020 that I have repeatedly made offers for settlement of the alleged referenced matter immediately upon providing me with written and legally binding assurance that they will accept payment in full settlement of this alleged obligation in direct and immediate exchange for the original instrument of indebtedness in its original form with the original signed consumer contract, and if unable to provide I have requested that they remove and delete inaccurate, incomplete, and unverified information from my file and they have failed to do so. Accordingly, I can show a judge that these accounts are inaccurate, incomplete, and unverifiable and that are in violation of the Fair Credit Reporting Act Section 609 ( a ) ( 1 ) ( A ) and Regulation V, the Truth in Lending Act ( TILA ) and Regulation Z, and Fair Debt Collection Practice Ave ( FDCPA ) by ignoring my requests to make arrangements for settlement of the above referenced matter. Yet they have not verified or validated that this alleged debt to be in fact mine. They previously stated on XX/XX/2020 " The Department only provides the original promissory note to a borrower after his or her debt has been satisfied in full. '' This is in clear violation of TILA regulation Z, as this information was not advertised on the master promissory note, as according to TILA they need to provide additional disclosure, such as not being able to provide the original promissory note. And in violation of FCRA Section 609 ( a ) ( 1 ) ( A ), the credit bureaus are required by federal law to verify - through the physical verification of the original signed consumer contract - any and all accounts posted on a credit report. Under the FCRA, inaccurate, incomplete, and unverifiable accounts and information must be removed and deleted. They have previously sent a discharge letter that I ignored, because this was not my request, I asked for validation and verification that these alleged accounts were mine with evidence of the original promissory note bearing my signature, as they have failed to do. As they have also tried to re-age my account and falsely claim I made a payment on these accounts in XX/XX/2020. They have continued to keep these remarks on my credit report, reporting to all three bureaus that this account is verified and correct. I have contacted the 3 credit bureaus XXXX, XXXX, and XXXX, with all documentation and my credit reports and they have all failed to comply and ignore my request.
