Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: I have a loan with XXXX XXXX XXXX XXXX ( Original Creditor : XXXX XXXX XXXX XXXX XXXX ), NAVIENT, and US DEP ED. I have always made my payments on time. As you can see, I have always had a stellar payment record with this company. I tried contacting XXXX, XXXX, XXXX, XXXX XXXX XXXX XXXX ( Original Creditor : XXXX XXXX XXXX XXXX XXXX ), NAVIENT, and US DEP ED with no successful resolution. There was definitely an error on their part.

Issue: Attempts to collect debt not owed

Subissue: Debt was already discharged in bankruptcy and is no longer owed

Consumer Complaint: 1st I was scammed by XXXX XXXX XXXX and then Sallie Mae and now you Navient. Since XXXX XXXX XXXX broke the law, and admitted to it during the proceedings of their class action lawsuit, former students are entitled to apply for a Borrower 's Defense Discharge, which makes them eligible to have all their related student debt wiped out.class-action lawsuit filed on behalf of 2,200 students at the for-profit cooking school is on its way to settlement, with XXXX XXXX XXXX. I have been paying on my school loans {$500.00} a month for 13 years. This is ridiculous. I received an email from you guys in XXXX stating that no payments would be due until XXXX which is aparently a lie because my account is now thousands of dollars past due. I have had enough and him financially burdened and can't do this anymore the hardship is overwhelming. I can not make another payment and will be filing bankruptcy if I need to. I believe all my loans should be discharged and considered paid and full. I have been paying for 13 years and this is enough. Technically speaking this should have been gone a long time ago with all the lawsuits that both Navient, Sallie Mae and XXXX XXXX XXXX have ancured. But you are the one who most recently screwed up my account with this covid stuff and the no payments due till XXXX. Start by adjusting and fixing the mess you made from this year and then we can finally talk about the rest. I would be open to a small settlement to clear this without lawsuits proceedings hearings and all that XXXX. Once you get the account current I'm sure we can come up with something. I will keep an eye on my account for It to be up to date. But the information is not acceptable. The original in my I received said that the loans would not be due till XXXX and were not made clear that this was not for all the phones. I even received an email as early as a couple days ago that said no money was due and XXXX balance. Please fix this issue to make the account 's current or you will not see another dime from me ever. I will still be keeping an eye on my count for the changes to be fixed.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: Navient is breaking federal law on many fronts. They allege that the federal stafford subsidized loans that I have do not qualify for Cares Act relief. They allege that instead of being direct from the federal government, they are from a private bank which is not the case. The federal government holds the paper on my loans. They have called repeatedly at off hours violating federal communications laws. They are collecting on loans that qualify for moratorium relief. I have requested an audit on these loans and for them to provide copies of the original promissory notes.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: I have requested of Navient multiple times a full accounting audit for my XXXX XXXX and Department of Education loans. Each time they have given me the run around and provided me the same incomplete or inaccurate information. The initial communication was in XXXX, and on XX/XX/XXXX I was provided an incomplete list of transactions, but no audit. Then on XX/XX/XXXX, I contacted XXXX where they provided on XX/XX/XXXX another list of transactions and referred us to studentaid.gov, but still not an audit. Studentaid.gov does not have any more or different information than what Navient has, so we still have no resolution or further insight. I believe a XXXX XXXX opened in XX/XX/05 has been improperly accounted for, inflating my current balance due. According to my records and credit reports, the amount was consolidated and closed ; however, I dont think it was cleared from their books and was re-consolidated causing it to be double counted. I request your support in resolving this issue.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: At this time, I have paid Navient approximately {$16000.00} from XX/XX/XXXX through the current date. I'm in good standing. My original loan was issued for {$13000.00} on XX/XX/XXXX. As XX/XX/XXXX, I still owe {$13000.00}. This company takes advantage of young adults who want to go to school, the interest rates spike so high that most payments only go towards interest. I have already paid back the original loan amount and then some. To still owe almost the same amount of money to this company as I originally borrowed 14 years ago, with long standing payments is asinine. There is a recorded call ( Navient ownership ) from XX/XX/XXXX discussing this issue. Thank you for your time reviewing this, and please let me know if I can provide any additional documentation.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I filed a complaint on Navient because I received an email about interest being added to my account during the time it's not supposed to be added and along with no payments. In XXXX my balance was less than it is reporting on my credit report now. They have added over {$2000.00} in interest from XXXX to XXXX. They aren't supposed to be doing that. Who else can I reach out to about this matter?

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: You are in direct violation of FCRA 623 ( a ) ( 5 ). Negative re-aging debt on a credit report is changing the delinquency status of an account to fool the credit bureaus into thinking its more recent than it really is, which is what you are doing by reporting the account as such and updating it monthly. I am very well versed in credit law and the practice of re-aging accounts. As you are no doubt aware, a collection is tied to the original account before it is charged off.You report that this account was opened - and therefore you are re-aging this account, which is illegal - so you are in violation of the FCRA, with fines of { {$1000.00} } per incident. I am requesting that you investigate this matter under the FCRA : * FCRA 623 ( a ) ( 8 ) Ability of Consumer to Dispute Information Directly with Furnisher * ( E ) Duty of person after receiving notice of dispute. After receiving a notice of dispute from a consumer pursuant to subparagraph ( D ), the person that provided the information in dispute to a consumer reporting agency shall -- * ( i ) conduct an investigation with respect to the disputed information ; * ( ii ) review all relevant information provided by the consumer with the notice ; * ( iii ) complete such person 's investigation of the dispute and report the results of the investigation to the consumer before the expiration of the period under section 611 ( a ) ( 1 ) within which a consumer reporting agency would be required to complete its action if the consumer had elected to dispute the information under that section ; and * ( iv ) if the investigation finds that the information reported was inaccurate, promptly notify each consumer reporting agency to which the person furnished the inaccurate information of that determination and provide to the agency any correction to that information that is necessary to make the information provided by the person accurate. In addition to the investigation, I am going to have to insist that you remove this illegal account from my 3 credit reports ( XXXX XXXX XXXX ) or you should expect an intent to sue in the mail, because I will have no choice but to take legal action.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: On XX/XX/2020, my loan was reclassified as a commercial loan through Navient.com When I called on XX/XX/2020 at XXXX, I spoke with 4 different representatives, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX during one 46 minute call. Three agents indicated that my loan was " coming up '' as a commercial loan. And the last person I spoke with a supervisor named XXXX, at XXXX, she indicated that my loan was indeed a federal loan, but that Navient classifies it as commercial because Navient bought the loan and it is now owned by Navient , so federal laws like the CARES ACT do not apply. That is illegal under US law.
