Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: You are in direct violation of FCRA 623 ( a ) ( 5 ). Negative re-aging debt on a credit report is changing the delinquency status of an account to fool the credit bureaus into thinking its more recent than it really is, which is what you are doing by reporting the account as such and updating it monthly. I am very well versed in credit law and the practice of re-aging accounts. As you are no doubt aware, a collection is tied to the original account before it is charged off.You report that this account was opened - and therefore you are re-aging this account, which is illegal - so you are in violation of the FCRA, with fines of { {$1000.00} } per incident. I am requesting that you investigate this matter under the FCRA : * FCRA 623 ( a ) ( 8 ) Ability of Consumer to Dispute Information Directly with Furnisher * ( E ) Duty of person after receiving notice of dispute. After receiving a notice of dispute from a consumer pursuant to subparagraph ( D ), the person that provided the information in dispute to a consumer reporting agency shall -- * ( i ) conduct an investigation with respect to the disputed information ; * ( ii ) review all relevant information provided by the consumer with the notice ; * ( iii ) complete such person 's investigation of the dispute and report the results of the investigation to the consumer before the expiration of the period under section 611 ( a ) ( 1 ) within which a consumer reporting agency would be required to complete its action if the consumer had elected to dispute the information under that section ; and * ( iv ) if the investigation finds that the information reported was inaccurate, promptly notify each consumer reporting agency to which the person furnished the inaccurate information of that determination and provide to the agency any correction to that information that is necessary to make the information provided by the person accurate. In addition to the investigation, I am going to have to insist that you remove this illegal account from my 3 credit reports ( XXXX XXXX XXXX ) or you should expect an intent to sue in the mail, because I will have no choice but to take legal action.

Consumer Complaint: On XX/XX/2020 I was contacted by a collection agency about my private student loan. I checked Navient 's website and found my loan was in repayment with the last amount due showing in XX/XX/2020 which was paid. No amount due was shown after this, and with the cares act everything was assumed to be in order. XX/XX/2020 I contacted navient by phone and was told their website no longer updated even though it showed that it had been updated that day and my loan was still showing as in repayment with no amount due. Navient 's collection representative then informed me she had no access to my account other than the balance and that I would have to cl tact the collection agency to pay the amount in full within 30 days. According to the records I have access to on Navient 's website, they have been accepting payments for that account and my account is in good standing. Upon checking my credit report, Mavient is reporting my account as delinquent and has been for over a year along with making regular credit Inquiriees without my permission.

Consumer Complaint: I had previously asked Navient to close my account due to Identity Theft. They never responded. This is not a duplicate complaint. I have filed for Identity Theft protection with the FTC. I am sending Navient my Affidavit from the Federal Government. FTC told me to have all my fraudulent accounts closed. Navient is a fraudulent account. The Department of Education have already started a investigation. Including a police report and other enforcement agencies. This Affidavit Identity Theft from the Federal Trade Commission gives me Rights to have this fraudulent account of Navient closed and removed from my credit report. Navient if you do not accept this FTC Affidavit of Identity Theft and have any other form to state Identity Theft with Government approval to remove from my credit report download the form to this CFPB website and I will have an Government official to sign it.

Consumer Complaint: Navient seems to have increased the amount I owe on a loan by {$2700.00} after the 3 month COVID deferment.. I was paying {$320.00} per month for over a decade which was the agreed amount for the life of the loan. I am being charged {$340.00} per month for what seems the life of the loan. There was 3 month 's deferment during Covid where I did not pay a total of {$960.00} ( XXXX x 3 ). By paying {$340.00} per month it increases the overall amount of the loan by {$2700.00}. How can this be? Did they increase my interest rate with during those 3 months of Covid? If so the banks raked in tons of extra money by giving a deferment to tens of thousands of people? If that is the case it is atrocious and borderline criminal. I sent them the following on XX/XX/XXXX through my borrower portal, but have not received an answer ... ... .. I need some clarity on how my monthly loan payment went from {$320.00} for the life of my loan until the year XXXX to now {$340.00} per month for the same time period. Three loan payments were missed which is a total {$960.00}. That is an additional XXXX for the life of the loan. ( ( {$3700.00} - {$960.00} ). Why am I now paying. {$2700.00} for the life of these two loans? That is the way it certainly looks to me when I look at my data beforeXX/XX/XXXX and the data that is presented now. I am looking for a response that clearly breaks down the payments I owed before XX/XX/XXXXand compare that to what you show now. I see a large discrepancy that I can not explain.

Issue: Getting a loan
Subissue: Fraudulent loan
Consumer Complaint: I was told by the borrowers defense program that my student loan should be forgiven by Navient. I called Navient several times to fix it and try to get my loan forgiven, and they shared they received the paperwork from borrows defense gov program, showing they approved my loan to be forgiven 100 % fully, and they were going to write off my loan and forgive it within 60 days. However after 60 days I did not hear back from them I called back in and they said I would need to apply for a new consolidation loan from Navient before they could forgive my loan. I felt totally mislead by Navient and their tactics to have them try to get more money out of me, and not follow the process of forgiving my loan which was authorized by the borrowers defense program / USA government, and now over 100 days since XXXX of 2020 when I received the letter from the borrowers defense showing they approved my loan to be forgiven fully. Please contact me and let me know what I can do to resolve this issue. I am not working at this time, and trying to find a place to live due to the poor economy and the pandemic, this has been very stressful time for me. In addition, I notice Navient also has a class action lawsuit for miss leading consumers similar to what happened to me. I am very concerned how I was treated and I feel totally taken advantage of by Navient. https : XXXX # XXXX

Consumer Complaint: My name is XXXX XXXX XXXX and I currently have a loan from my former university XXXX that is and always has been in good standing with Navient. I continue to get mail from XXXX XXXX who claims they are the lender for the same XXXX loan and have been reporting non payments to the credit bureau negatively affecting my credit. I reached out o FASA who confirmed that the loan in question is in fact in good standing with Navient. I also filed a dispute with XXXX and have a file # XXXX thus far XXXX XXXX has not responded. Using the account number from them XXXX they claim that XXXX sold them the loan and that they are the new lenders. Again this loan has been under Navient for a few years and there can not be 2 lenders for 1 loan. FASA also confirmed that they only have Navient and has no knowledge of XXXX XXXX and according to their records it appears that XXXX XXXX maybe engaging in fraudulent activities. I do have fraud alerts with all 3 credit bureaus.

Consumer Complaint: I filed a complaint with CFPB regarding the inclusion of Navient in the Public Records section of my XXXX XXXX report. In response to that dispute, XXXX XXXX now has two Navient accounts that have been reported as included in bankruptcy on my credit report. At the very least these are duplicate accounts and at most they are outright false accounts. I spoke to Navient and they indicated that they have done an investigation, but I have to wait 30 days to get the results. I asked when the letter was sent out and they said it had not been sent out yet, but that the investigation was complete on XX/XX/XXXX. The new entries on my credit report, which caused my score to drop 56 points, are dated XX/XX/XXXX. I have until the XX/XX/XXXX to appeal a decision to fund my business and this is going to drag on past that date, which means I will be denied the funding.
