Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: My student loan was in forbearance yet Navient still gave me a late on my credit report. This has impacted my credit score very negatively. I am currently on XXXX and unemployed as a result of the global pandemic. I let Navient know and they wont remove late. I have given them documentation that i was in forbearance at the time of the late and also provided them XXXX information. They are rude and refuse to help. It is my understanding that Navient should not be collecting or penalizing borrowers until at least XX/XX/2021 yet they will not stop harassing me. This loan stresses me out and I XXXX XXXX over it. It elevates my XXXX and makes me feel helpless. Thank you.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Hi, I do not believe Navient has handled a specific loan/payments correctly. I have asked for clarification, but none seem to answer my specific information. I have asked numerous times to talk to a representative directly in addition to receiving paper mail, but have not received a follow up. I was in the rate reduction program, and before it ended I refinanced a loan in XX/XX/XXXX. It was my understanding that the rate reduction program was ending in XX/XX/XXXX. I have documents to support that. Around the time that I entered into the rate reduction program, I also had a covid forbearance applied to my account ( which added confusion to dates ). XX/XX/XXXX, a large amount ( {$35000.00} ) was sent to Navient. It turns out it did not cover the full pay off amount. I owed {$140.00}. That's fine, because I assumed {$490.00} that was scheduled to come out through the rate production program would cover it in for XXXX 's payment ( XXXX XXXX ). Instead, of taking out XXXX, {$800.00} was taken out. I tried to call Navient, when I saw an email the day before it came out, but the offices were closed due to the Christmas holiday. I called Navient the following morning, they stated that through the recorded phone calls I did agree to the large payment, but my account was weird because it actually wasn't ending until the next month ( something about the covid forbearance ). That phone call prompted Navient to send me an email that the rate production was ending but that I would be refunded for XXXX. ( That was the difference between XXXX and XXXX. ) However, I noticed that although I had one more month in the rate reduction program, my original interests were high again. That shouldn't have happened until XXXX. I called a customer service rep, she agreed with me, and this would be adjusted. I've asked for documentation to show that. But no documents they provided me ever show that I received the low interest rate for the month of XXXX. Also, the {$300.00} payment was refunded on XX/XX/XXXX. On XX/XX/XXXX, I received a statement from Navient, that may balance was {$0.00}. I have that statement to show for. There was a balance showing, and I called a few times trying to confirm that there wasn't an additional balance. I was advised that I should probably wait because there were things being done in the background on my account. On XX/XX/XXXX I received a refund for this specific loan for {$18.00} and another refund on XX/XX/XXXX for {$210.00}. I'm assuming that's fine too, and something must have been overpaid with the XXXX check. On XX/XX/XXXX I have screenshot showing that Navient states I only have 2 loans. Fast forward to late early XX/XX/XXXX, the loan that I thought was gone reappears. I never received any statement, calls, anything. I call Navient trying to figure out how was that possible. How did I receive 2 refund checks if I actually owed a balance? My account and information was forwarded to a research department. I never heard back on where this amount came from and why I received refund if it actually wasn't paid I full. I paid the remaining {$140.00} on XX/XX/XXXX because I was not hearing a response from Navient and did not want interest to accrue. It is not acceptable to send a statement with a {$0.00} balance, remove a loan, and then add it back with no acknowledgement that this happened.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: In total, {$26000.00} has been paid towards the total original principal private loan balance of {$43000.00}. That should leave {$16000.00} remaining on the principal balance. However, instead of the original balance decreasing by the {$26000.00} that has been paid towards it, Navient instead is reporting a balance of almost $ XXXX more than the original balance. More than half of the original total loan amount has been repaid, yet Navient is requesting an additional {$36000.00}. How can interest be an additional 84 % of the original balance despite payments being made? In other words, 61 % of the loan balance has already been paid yet, instead of showing 39 % due, Navient is currently requesting 122 % of the balance. Where only {$16000.00} total should be owed with regard to all private loans, Navient is stating that {$53000.00} is owed. How can more than the original balance be owed, when over $ XXXX has been paid towards it? This is unconscionable and usurious. Also, XXXX XXXX, Office of the Customer Advocate who has represented Navient in my on-going complaint, has refused to respond to requests for information and clarification. Fundamental questions regarding the status of the loans and loan agreement were submitted via email on XX/XX/2020 to Navient and Ms. XXXX ( Navient ) refused to respond. I followed up almost two months, and she still did not respond. It has now been almost 7 months. Navient asserts that a co-signer can make changes to loan terms, but requires the permission of the primary borrower to do so however, they have continued to make numerous changes to the loan terms without the permission of the primary borrower.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: I am trying to track down my Stafford student loans to be able to pay them off. Navient told me that my loans went into default because I was always a month behind in my payments. They sent the loan back to XXXX. When I phoned XXXX on XX/XX/2021, I was directed back to Navient. I requested a balance, and I was told I owed {$31.00}, XXXX. I asked for a balance statement to be sent to me via email and USPS. Two weeks later, I have not received anything. I am trying to pay off these loans! I called Navient today, and when I asked again for a statement, I was told again that they can't produce a statement because of the " system integration. '' I find it hard to believe that the company can not provide me with a way to pay off my loan balance. I am afraid they are stalling to add penalties to my current balance which they said was good for 30 days. It has now been two weeks. P

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: XXXX is incorrectly reporting that NAVIENT is the owner of a student loan placed in my XXXX consumer credit file under my personal information. On XX/XX/2020 XXXX initiated a three-way recorded call between XXXX, NAVIENT and myself, in that call NAVIENT acknowledge to XXXX and myself that they were not the owner of the debt listed under NAVIENT and stated that XXXX XXXX at XXXX XXXX XXXX, XXXX XXXX, NEW YORK XXXX at phone number XXXX was the owner of this debt. XXXX continues to list NAVIENT as the owner of this debt in my consumer file. I spoke to XXXX of XXXX XXXX at the phone number provided and she said that they do not have any information under my personal identification and promptly transferred me to a California phone number where I spoke with XXXX at XXXX. She stated that they did not have any information pertaining to this debt nor any debt pertaining to my name and social security number or any other personal identifying information. A second call to XXXX XXXX in California on XX/XX/2020 with XXXX confirmed again that they did not have any information pertaining to this alleged debt. Navient has since, sent written documentation stating that they are not the owner of any alleged student loan under my name. This document was forwarded to XXXX, XXXX refuses to correct or delete their reporting despite the recorded phone call and direct written documentation from Navient that acknowledged that they did not own the alleged student loan. XXXX continues to inaccurately list Navient as the owner of a student loan listed under my personal information.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have a loan, which is subsidized and is currently in the education deferment. It has @ {$69000.00} in unpaid principal and has no unpaid interest. I also have an unsubsidized loan. I am currently paying {$300.00} a month while in deferment, with that amount being split per Navient policies between loans. The account history for my subsidized loan shows that on XX/XX/2021, I was credited {$180.00}. Then also on XX/XX/2021, I was debited {$180.00}. This pattern has been ongoing for years and is also the case with the unsubsidized loan : my account is credited, and then the exact same amount is debited. Despite having made this payment for some time, the balance of unpaid principal according to the account history has not changed on this subsidized loan. I have called and I have written previously, and I receive back boilerplate language explaining how payments are divided between the accounts. Now, the Navient portal will not allow me to send questions to Navient by the portal 's email system, despite whatever browser or computer I use, retuning an error stating I do not have to access the email system. The fact that there is a cycle of debits and credits and never shrinking principal on my subsidized loan is never addressed in any response. I am becoming increasingly frustrated at the lack of explanation. I am making a good faith payment every month despite having an education deferment, and yet, it appears that Navient is pocketing my payment and not crediting my account. I would really like an explanation of this revolving credit/debit cycle and why the principle is not showing a reduction on the subsidized loan despite regular payments.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I was directed by my school ( XXXX XXXX XXXX, now closed ) to apply for private student loans with Navient in XXXX. The original balances were {$10000.00} and {$9100.00}. I have made my {$450.00} payments every month since XX/XX/XXXX, besides when I was in-school deferment or financial hardship forbearance, never going into default. It is now XX/XX/XXXX, and those private student loans have current balances of {$24000.00} and {$10000.00}. The interest rates are are 12.25 % and 7.25 %, respectively. At the beginning of the pandemic, I decided it was a good time to go back to school. First, to be able to finally finish my XXXX XXXX XXXX, but also because I could not afford to pay my private student loans, which did not qualify for the federal government 's student loan freeze. I began classes in XX/XX/XXXX, but was just informed by Navient that I have reached my limit of 48 months of in-school forbearance, which I do not recall ever being informed about. Private student loans can not be consolidated, or put on income-based repayment. I reached out to Navient to try to refinance these loans, but they informed me that they are not currently offering refinancing. I reached out to other student loan servicers XXXX, and XXXX, but they also can not help me. I am feeling hopeless that I will ever be able to pay off these loans are the balance seems to just go up instead of down. It is my belief that the interest rates that Navient is charging are exorbitant, and their unwillingness to offer me anything else besides more forbearance, which increases my loan, is unfair and unreasonable.
