Consumer Complaint: I write to file a complaint against NAVIENT and a possible collection Scam by TWO Debt Collection companies that are BOTH contacting me for the SAME DEBT. XXXX XXXX was the Lender for my Student Loan. My payment history has always been outstanding over the years. I never missed a payment. When my financial situation dropped, due to the XXXX economical crisis and later on, by my separation, I found myself becoming a single mom of a XXXX years old baby and it all became very hard on my finances. That didnt stop me from trying to still make payments on XXXX XXXX Loan. I could not work full time anymore with the baby and as a single mom, so I requested my Lenders to lower my payments. When my Loan went from XXXX XXXX to Navient, thats when the problems began. When my financial situation became unbearable, I tried all avenues to work with my Loan holders but the result was a complete absence of acknowledgement of my situation in a completely unprofessional manner. My Loan Holders pretended never to have received the numerous letters and e-mails I sent ( I kept all copies of them on file ). I was approved for an Income Driven Repayment Plan the year before and all they had to do was to re-approve for the new year plan. In my last communications I came to the point to even exhort them to look at my financial situation. They were sent all the papers that showed my income and my financial struggle in having to make full payments. I had every right to request a lower payment and a lower percentage based on my income. I already had all the papers approved the preceding year and it was just matter of them renewing with a signature for the new year that would allow me the continuation of lower payments into the following year. It was not a request. Just a simple renewal! They only had to review my tax return to confirm that my situation hadnt changed. They pretended not to receive my papers and made the due date pass. They pretended not to receive any of my communications. I wrote to them and sent my papers to them 5 times. I called them and let them know that everything had been sent in. Their following action was : they made the due date pass so that they could proceed in sending me a request of a payment in full. It was transparent that their entire action was deliberately taken to this path. I then wrote a certified final e-mail to them so I could have profs of validity in court if needed and they never replied to it. At that time I did not absolutely know how to handle this case anymore. I even wrote to them that the anxiety and psychological pressure they were putting on me by not acknowledging my letters and forms sent in was unbearable and was getting me sick. I did not have finances to hire a lawyer. From overseas it is hard to find solutions as well. Only now I come to know that Navient has committed numerous infractions like these and has been sued by numerous students for their illicit actions. Now, because of their unethical conduct, I find myself paying the consequences of an escalated outcome. I was contacted by not one but two Debt Collectors companies requesting me to pay an immense sum on a Student Loan for which I do not recognize the amount nor the Lenders Name. Both companies are contacting me on the SAME DEFICIENT LOAN SUM. The sum corresponds in no way to the amount of my Loan and the Lender is under a name I do not recognize. I understand that all my effort in paying off my original Loan amount has for sure been completely destroyed by interests and fees. But this amount is double what I own. And how can such request come from two companies at the same time? Im probably the subject of a Scam Ive sent a validation request to the first company listed as Pioneer Credit Recovery Inc., XXXX. XXXX XXXX, XXXX, NY XXXX and Im in process of sending a validation request to the second company listed as XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, Ma XXXX but with a letter that came not from this address but from the following : Dept. XXXXXXXX XXXX XXXXXXXX, XXXX, Ca XXXX which address I looked up online and it is being listed as a scam company. These are some links https : XXXX https : XXXX Im absolutely freighted from having to deal with such a situation. I have no idea if these companies are real or fake or if a Lender has sold a debt to both of them. I do not absolutely want to release my personal information to any of these two Companies until Im absolutely sure they are legitimate. I also find it completely absurd that I have to pay for the illicit actions of my Lender if the debt comes out to really be the one I own but with a doubled amount. Please Let me know how I should proceed from this point. I will file a complaint with the CFPB, State Attorney General, State Department of Education, Federal Trade Commission and try to take all the steps necessary to resolve the issue. I would be pleased to receive any input on how to proceed on this matter. Sincerely

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: 6. I have been contacting Navient from XXXX to XXXX to have the 90 day late removed, due to negative handling of my account and I have constantly been giving the run around 7. Navient has NOT investigated any of my claims, because I continue to request proof but none has been sent to me form Navient. Even after I have sent my proof to them. 8. I just received a response after filing a complaint, finally. I was asked to submit any example of the types of communications I was receiving from Navient before my " past-due statue ''. " Past-due statue '' is the words being used by Navient to prove there point, in there recent letter. I wish they used the same verbiage " past-due statue '' before they labeled me 90 days delinquent. Instead, I was being sent misleading Information, with verbiage like due date. I feel Navient actions at the time where very misleading and over all damaging. I have attached an example of the types of emails I was receiving at the time. Enclosed. Also, I did give reference to these emails in my original complaints to them, but not addressed by Navient.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: Hello, I was informed based on this website CFPB that federal student loans were automatically not being charged interest or late payments being reported to Credit Bureaus per the CARES act. However, Navient reported to the credit bureaus that I had a 90 day late payment which has affected my credit score and it dropped 93 points.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: XX/XX/XXXX I had a long phone call with a customer service representative about my " new '' monthly payments. I informed the customer service lady that I was unable to pay the extreme amount of {$400.00} on my monthly loan. The customer service lady told me I had no other choice but to pay that. She told me that, that was the " current '' lowest monthly payment. However, I've been paying on my school loan since XXXX and the payment was {$220.00} a month. I currently have five loans to pay for. I have been paying for them on time. But someone once I finished paying one loan since it was a tiny loan, my monthly payments go up to {$400.00}. I have repeated asked them if I can lower the payments because I can not afford anything else besides these loans. I thought they were going to help me figure out a better solution to pay for them, like a payment that I can afford. Till this day my payments have gone up to {$460.00}. I have no where else to turn too. This is extremely hard to not be able to afford food because Sallie Mae will not lower my monthly payments.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I graduated school in XX/XX/XXXX with a balance of {$25000.00} +/- a few hundred dollars. I wasn't able to make the full payments to my loan servicer XXXX Sallie Mae then Navient ), and was granted several forbearances. I eventually was entered into an income driven plan. I have all the payment history printed from Navient. I have paid over {$16000.00} in the last 10 years and I still owe {$24000.00}. I have been making payments every month even with the government forbearance. I feel there is no way to ever pay these loans off. I would like someone to look over my loans. I have six different federal loans for my XXXX programs from XXXX. I would also like to know how my XXXX tax statement says that I paid in {$2300.00} in interest when according to their website, I have only paid in {$370.00}. Does that mean that while there is a government forbearance that they are still collecting interest? Any help would be appreciated. Thank you.

Subissue: Account information incorrect

Consumer Complaint: Navient has inaccurately reported late pays in my credit report while my status was in deferment. They fraudulently reported 3 late pays on my credit report while I was enrolled in school at the time and my loan status was in deferment. I have reached out to Navient by phone and by mail in order to resolve this issue. I even mailed in a goodwill letter asking them to forgive the late pays although it was inaccurately reported to begin with.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I received a private student loan with Navient in 2010. I have like anyone else financial issues that have come up, however I have paid XXXX to date when my loan was for XXXX dollars. I currently owe XXXX dollars! The rolling interest and forbearances have really increased the balance. How can they do this to struggling students that are trying to do the right thing and pay their student loans! This isnt fair and falls under what they have already been sued for in other states such as Pennsylvania. I called Navient to discuss and see if they would work out a payoff that is less than XXXX. They said no you can pay the balance that is all we can offer you. I was so upset since I am trying to do the right thing and get this loan taken care of yet not being taken advantage of at the same time. No one deserves this.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I have 2 separate XXXX loans both subsidized and serviced through Navient. When I log into my account and look at details of these loans they both state that interest rates are 6.55 % yet it states interest rates are set by Congress and per the CARES act federal loans are 0 %. They claim the reason I am being charged interest is because they do not fall under CARES, however, why does it say the interest is set by Congress and does congress not have rates set to 0 % until XXXX this year? They have not been able to answer these questions. These 2 loans are close to being paid but with the interest I will still be paying until at least XX/XX/2022. I believe they owe me interest on these loans which would help decrease my balance. The way they do their loans in general makes it impossible for people to pay. I have loans where I am paying twice the original amount and they will not work with me at all. I just discovered too late that I could've refinanced those loans into a direct loan to qualify for loan forgiveness as I am a public service worker, yet they never let me know this was an option or that I would not qualify unless I refinanced. I've been making payments under the assumption this would all count towards forgiveness and feel misled and that they are being fraudulent. They do not even make monthly statements readily accessible electronically or through mail.
