Consumer Complaint: XXXX mortgage fraud and illegal debt collection practices. trying to foreclosure and suing under us bank on a mortgage loan that was settled in XXXX by us banks through their law firm when we informed then they just keep trying to collect what we believed to be a settled debt recorded in the public record and for 3 years they did nothing either in court or through us bank to address the situation until now after the filing a lawsuit for a property they claim to be the servicer of but county records show was assigned ( sold XXXX to them after we were informed the debt was satisfied in XXXX XXXX the fraudulent activity by all the parties from origination in XXXX to present false information with the court filing should be invested to see who to bring criminal charges against. will not provide the closing documents to show who ( XXXX bank or XXXX ) funded this loan if it was funde at all? charges to maintain a property I live in and they do not maintain it I do, charges for property inspection, some mouths shows XXXX or more of these charge. XXXX and us bank with the help from the XXXX circuit court of Florida who disregarded the facts and has foreclosed and stolen our home. I will forward XXXX of the XXXX judgment the last XXXX were removed. next please ask XXXX and us bank to submit a certified copy of the actual illegal and invalid mortgage documents they filed with the court. as it differ from the version they gave you what of the frauldant charges by attorney XXXX XXXX XXXX for mandatory mediation that we were never ordered to attend by the court and if mandatory mediation is required by law why did the court skip this step and her response to me in a email was XXXX County does not require mediation. I guest XXXX county has their own foreclosure laws I thought it was Florida law or federal law Moreover, these issues should have been raised by you to the Court prior to the entry of judgment. that would be the same court who does n't believe the facts of the case and a very clever scheme to defraud by nationstar and us bank and what of the relocation expenses for being forced out of our home with less than 45days. please forward this complaint to us bank for their response to this case now that XXXX and us bank stole our home I am formally requesting to file federal charge against all the parities and request that the dept. of justice investigate this matter and look up the court file to confirm my statements. nationstar and us bank needs to stop stalling and formally respond, now that they have completed their fraud and stole our home. Consumer Complaint: Approximately 4-6 months my wife and I applied for a credit loan and was turned down because of 2 late payments to Nationstar reflected XX/XX/2016. We were not aware of this and wrote both the credit bureau and Nationstar Mortgage and received a reply from Nationstar dated XXXX stating that after review they would not change the credit reporting and it was my fault. They said because they sent us a letter stating a rate increase back XX/XX/2016. I do not remember seeing it. We average getting 3-5 pieces of mail from weekly along with numerous calls asking us to refi our loan. The customer service rep that was not their problem. My feeling is this " bunk ''. If you look at our history of paying this loan you will see payments being made on time and had made numerous payments in amounts greater than the normal payment. When I call Nationstar to speak with a customer service rep, 99.9 % of the time I get an " non-English speaking '' person of which is very hard to understand. I am hearing impaired and have asked to speak to an " English '' first speaking person and have n't had much luck. We have had numerous mortgages over the last 20 years and hands down Nationstar is the most difficult to work with. The loan we had applied for was with XXXX XXXX XXXX XXXX for the purpose of purchasing and RV.

Consumer Complaint: We experience a medical hardship at our house last year.. My husband and I were hospitalized, i needed a XXXX and my husband had a XXXX, this situation leaved us with medical bills plus additional expenses. We were current paying our mortgage but we needed assistance because the medical expenses were really high. I called our Mortgage company ( Nationstar Mortgage ) XX/XX/XXXX/XX/XX/XXXX for assistance, according the website or mail information they offer assistance in case this situation. The only option that they offered me was a repayment plan, it sounds good but I was told that they needed to report with the credit buro so i told them this option is not possible because I have worked to have a good credit and not possible, so I told them that in this case my only option was to be delay on my next payment and in the next months I will become current. they said ok, but they not only charged me Usd XXXX per month but also they reported me with the credit buro. Not sure if the reasson that was n't clear is because they want to charge the late fee. I called them and they said that they are really sorry, my credit was affected, XXXXpoints less, all credit cards started reducing my credit, increasing my interest, or closing credit cards. I am current now but the damage is done. I have asked them to listen to the conversation and communicated this to credit offices. I was behind 30 days all the time and now i am current but this does n't help to bring my points back. Please kindly assist with the situation, they offer / advertise assistance however, when i called I di n't receive anything and i trusted them and proceed based on the given information but i was affected. i have all documents from the hospitals and medical bills. i am asking to fix the information error with the credit offices taking our 30 days late plus late fees.

Consumer Complaint: A job transfer required a move out of state. We listed our home for sale for over a year with no offers. We contacted Nationstar for our options. Working through our " dedicated loan specialist '' XXXX, we were approved for a short sale in approx XX/XX/XXXX which placed any potential foreclosure activity on hold. She stated that if this option did n't work, we could file for a deed in lieu at any time during the process and before any potential foreclosure date. By XXXX we had not had any offers. We called Nationstar XX/XX/XXXX to find out what our other options were. With XXXX not available, we spoke to another representative XXXX in the bankruptcy/foreclosure prevention dept. She informed us that we were great candidates for their Deed in Lieu program and that we could get cash for keys if we turn the property over in good condition. We stated that this is the option that we 'd like to choose and she emailed us the application. We completed and returned the application. We contacted Nationstar to confirm receipt of our application. They said that they denied our application because there was a pending sale date. We had not been notified of a sale date at that time. XXXX told us that we had plenty of time to do a Deed in Lieu. We later received a letter dated XX/XX/XXXX stating that there was a pending sale date one month later on XX/XX/XXXX and no time to review our file for a Deed in Lieu. There were 30 days. We contacted XXXX, a non profit organization that assists homeowners, previously they assisted with HAMP/HARP programs. We gave them authorization to assist us with this matter and their contact XXXX assisted us in contacting Nationstar. On a three way call, we spoke to XXXX, Team Lead/Assist Agent in the Bankruptcy/Foreclosure prevention dept. He stated that at this point the only way to avoid foreclosure was to file for a loan modification, which would halt the foreclosure. He then emailed us an application for modification on XX/XX/XXXX. He told us that as long as it was received by Nationstar 7 days prior to the foreclosure date, that the foreclosure would be placed on hold. We emailed a complete application for a modification on XX/XX/XXXX, 10 days prior to sale date, and received an email confirmation that it had been received and to check back in 48 hours for a status. We called Nationstar on XX/XX/XXXX and spoke to their agent XXXX, he said mod was denied and transferred us to XXXX. He denied telling us that a modification application would halt the foreclosure. He mentioned two additional documents that were not stated on the application as needed and we immediately emailed them to him and to the email provided for modifications. He stated that Nationstar was not able to delay the foreclosure date, that decision was controlled by the attorneys acting as trustee for the foreclosure. We contacted Nationstar 's attorneys, XXXX. We spoke to their representative, XXXX. She told us that submitting the application for Deed in Lieu 30 days prior to the sale date gave Nationstar plenty of time to review our file and complete a Deed in Lieu. She also stated that Nationstar can postpone the foreclosure at any time by simply contacting them through a third party software that they use to communicate. She stated that Nationstar controls postponing the sale date, not the attorneys and that sometimes Nationstar tends to " forget that ''. Nationstar has repeatedly promised us solutions to avoid foreclosure and we have done everything that they have asked us to do to avoid it. They have failed to honor the processes that they outline on their website to avoid foreclosure and that they have stated through verbal promises on the phone. They have lied to us and failed to honor programs that we clearly qualify for to avoid foreclosure.

Consumer Complaint: During my relationship with Nationstar as my mortgage holder, they tend to lose or misapply my mortgage payments to completely unrelated accounts at least once and in some years twice. XXXX has done this with my XX/XX/2016 payment which exceed the amount due and was sent in the form of XXXX cashiers checks and XXXX small money order totaling XXXX. The loan account number was written on each and a cover letter was also provided. I called them in XX/XX/XXXX when I received a notice concerning the XX/XX/XXXX payment. on XX/XX/XXXX, the gentleman on the phone at Nationstar confirmed that they had just received the XX/XX/XXXX payments and he could see it in his system. He could also see the wire I had sent earlier that day for the XX/XX/XXXX payment. On XX/XX/XXXX, I received a notice dated XX/XX/XXXX that they were threatening foreclosure and I was owing a payment. I called Nationstar and spoke with a person named XXXX who was useless in identifying my earlier conversation that had said he could see the checks. The threats to foreclose and the mishandling of my payments has increased since my house is no longer underwater in value to debt. Nationstar is either deliberately putting my account n jeopardy or is grossly incompetent

Consumer Complaint: I am in active XXXX bankruptcy. My plan included payment of mortgage arrears to Nationstar mortgage. Nationstar modified my loan in XX/XX/2016 and rolled all of the arrears ( about {$14000.00} ) into the modified loan. They never filed an amended proof of claim with the trustee, so the trustee continued to send them funds to pay the arrears. I called Nationstar asking where that money was going, they had no idea. I called the trustee and they said they were still paying Nationstar for the arrears, which no longer exist. So Nationstar has been pocketing all of the money sent by the trustee on my behalf since XX/XX/2016, a total of {$1900.00}.

Consumer Complaint: This is an amendment to claim # XXXX that was submitted on XX/XX/XXXX. In that complaint there were XXXX issues that were of concern regarding the servicing of the my mortgage loan and of the unauthorized disbursements of premiums and taxes. On XX/XX/XXXX I received a call from XXXX, who previously identified herself as a manager in the escrows department in a conversation of XX/XX/XXXX. During that conversation she acknowledged Nationstar was receipt of the documented proof of flood coverage, but the flood line had not been removed as promised.She said there were notes in the files of previous calls regarding these issues and the promises made to resolve them going back months. She informed me that based on our conversation on XX/XX/XXXX and the documents I provided she has removed the flood escrows line but has refused to remove the tax escrows line from my mortgage although she found that I had the escrows shortage in the amount of {$400.00} XX/XX/XXXX but the tax escrows line was not removed as promised. The 2 reasons for the denial of the tax escrows I was told was that ( 1 ) the loan was delinquent ( 2 ) the taxes were late. I believe Nationstar is acting punitively by taking such a hard stance on one of their policies regarding non escrows accounts. The delinquency was caused when Nationstar made the error in increasing my payments. It remained delinquent because Nationstar was negligent in the servicing of the account. Nationstar did not resolve the issue in a timely manner even after showing proof that they were in error. Finally, Nationstar has never provided anything regarding the implementing of an escrows on account that were originated as non-escrows accounts. I agree my XX/XX/XXXX taxes were not paid until XXXX. They were delinquent for 6 months and I had every intent on paying them but Nationstar had already disbursed payment. It is customary for " any creditor or company '' to issue a late notice when payments are late. The city of XXXX XXXX did issue send a such a letter. However, the property was not in imminent danger of being sold for a {$360.00} tax bill and Nationstar, being a major lender in home mortgages and serving industry is well aware of the time lines associated with tax sales. By taking such a punitive stance it appears Nationstar, who is a leader in the mortgage and GSE servicing industries, is saying it is ok for a major company to to make egregious errors, display poor customer service, and to make adverse decisions without quick resolutions, but the consumer in non exempt and must adhere to all the rules and regulations regardless to whom erred. I believe this has been the a very poor display of customer serivce and of servicing.

Consumer Complaint: I have been trying to receive a loan modification from Nationstar for over a year with the help of XXXX. A law firm that I hired that solely is committed to helping people work with Mortgage Companies to avoid foreclosure. I have been denied four different times. Each time the reason has changed. The first time my income and my mother 's income were used, we did not have enough disposable income. My son moved in with me and we used my income and his income Nationstar calculated the numbers wrong and XXXX appealed the denial. A third time the numbers were calculated wrong and another appeal by XXXX that shows we have XXXX in disposable income well over the XXXX disposable income required by Nationstar. The last denial was because the Net Present Value of my home is lower than the XXXX that is owed. My house is now in foreclosure, and the sale date is XXXX/XXXX/XXXX. As a XXXX I am absolutely certain a XXXX square foot home on a lot and a half in the XXXX Metro area is worth more than XXXX. The last appraisal that was done on my home was XX/XX/XXXX and the value was XXXX. Furthermore, many exciting things are happening in XXXX. XX/XX/XXXX the voters approved new infrastructure and roads throughout XXXX. XX/XX/XXXX XXXX XXXX XXXX opened XXXX XXXX XXXX an XXXX state of the art XXXX school. And construction is underway for XXXX XXXX homes all within my District. All of these have increased the value of homes throughout XXXX, I find it very hard to believe that my home would be excluded from that increase. Also, I have filed a complaint with the Federal Consumer Financial Protection Bureau as well as the Colorado Attorney General. My feeling is that if Nationstar is adjusting numbers and criteria to continue to deny my modification it is not an isolated case and others are also being unfairly denied.

Consumer Complaint: I have a Reverse Mortgage with Champion Mortgage, and for the 3rd time in one year they are threatening foreclosure for taxes & insurance. I have been continuously jumping through hoops with these people and in 100 % compliance of everything they ask. I have been on a repayment plan for T & I ( even though I am 100 % exempt from Real Estate taxes ) and they called the loan due & payable XXXX XXXX, XXXX for back RE Taxes & Insurance. As of XXXX XXXX they said I owed for back taxes and insurance of over {$9000.00}. I paid off that amount immediately. They said if I had called 24 hrs prior the amount would have been different, that they had further advanced my T & I and I would have to be placed on another Repayment Plan. I have been continuously threatened, intimidated, and harassed by these people regarding the status of my reverse mortgage for nearly 2 years and I am exhausted, frustrated, and bewildered. It seems as though they are conducting fraudulent activity because I pay and pay and pay and they ALWAYS declare that I have a default balance for T & I of thousands and thousands of dollars!!! I am 100 % EXEMPT from Real Estate taxes ( please see attached docs )!! I have been on the phone for hours with these people and to no avail, it 's usually some young person reading from a script who is rude & belligerent, as well as extremely unprofessional. I have requested a statement of accounting from Champion dozens of times and they REFUSE to release XXXX, always stating they do n't have access to that information! Where did my {$9000.00} go to and what for??? Why do I still owe over {$7000.00} and what for?? They REFUSE to release any documents or itemized statements explaining what the money has been put towards, where my repayment plan money is being put towards, or why my default balance continues to balloon when the current forced insurance that 's been put in place is active and good through XXXX XXXX!! I am being STOLEN from!! Common sense shows that these ridiculous numbers absolutely CAN NOT be CORRECT, nor do they make any sense, nor can anyone explain them. I am SICK and DISGUSTED over the way I 've been treated, it has made me physically ill, and I 've lived in my home for over 40 years!! I 'm XXXX XXXX XXXX, a widow, and on Social Security XXXX income and feel like my home is going to be ripped away from me by CRIMINALS!! I have thoroughly researched this Company on Consumer Reports/Affairs and have found that there are XXXX pending Federal Class Action Lawsuits against Champion Mortgage aka Nationstar Mortgage. The dozens of consumer complaints I 've read through are a nightmare, horror show, and what they are allegedly doing to the elderly and other persons like myself is criminal and they should be shut down!! I 'm also being charged for home inspections I have no knowledge of and other fees I simply do not understand! Every time I 've asked to speak to a Manager or someone who can explain these fees and both my current situation I am told that they are unavailable, in a meeting, or busy! Please find enclosed the corresponding documents that bear witness to my current and ongoing situation with Champion. Again, I have paid them everything they 've asked of me, been in complete compliance, can get no help or resolutions from them, only continued threats, harassment, & intimidation. I am desperate for immediate RELIEF and HELP and SUPPORT! I can not be HOMELESS, as I have nowhere to go, and my daughter lives with me, who is also XXXX! We have also found that Champion is not XXXX accredited, there are no satisfied, happy customers/consumers anywhere to be found in terms of doing business with this sham and scam of a company. The rate at which they are defrauding people is astonishing, and it must be stopped!! I thank you in advance for your time in dealing with and hopefully resolving my issue. Please, please HELP ME!!
