Consumer Complaint: I spoke with representative on XXXX XXXX, XXXX regarding a debt that showed up on my rental report. I requested a letter of deletion as this debt is invalid. Representative stated that company claims last months rent was reported as unpaid and additional fees were assessed, totaling the debt amount. Representative recommended sending in supporting documents such as bank statement showing receipt of rent payment. According to FDCPA, debt collectors are required to provide proof of debt, in which I have not received. I explained to the representative that I sent in a written dispute in XXXX XXXX, in which the judgement ( Docket # XXXX ), as well as collection, connected to the debt were permanently removed from all credit reports. Representative confirmed that account has been disputed online and via a third party agency, yet no debt validation has been received. Debt collectors are required to send a written debt validation letter within five days of the initial dispute, which in this case was XXXX XXXX. Given that the debt has not been validated, nor has it been proven that any debt is owed I am demanding that National Credit Systems permanently removes account # XXXX from rental report, and verify that no further collection efforts will be made.

Consumer Complaint: In XX/XX/XXXX and XX/XX/XXXX, I sent written correspondence to National Credit Systems as well as their attorney via registered mail informing them of my correct address and asking for verification of the debt. TO DATE, I have yet to receive any verification of the debt or any written correspondence at all. Today, XX/XX/XXXX, I contacted National Credit Systems successfully after many unsuccessful attempts and was treated with complete contempt, despite all of my attempts to be professional. I was put on hold abruptly on many occasions and given excuses about there being phone issues, " a skeleton crew, '' and I was barely able to understand what was being said because the phone lines kept cutting out on the other end. I could n't even get my full account number and was told hastily by XXXX that " he 'd get back to that. '' I informed XXXX that in the six-seven months since my written correspondence had been sent to NCS, I had received nothing in return, despite multiple letters that I had sent and confirmed delivery of, via USPS. XXXX intimated that perhaps I had not provided NCS with the correct address, although I did provide them with the correct address and have received all mail from that address and continue to do so to date. I updated NCS with my current address even though XXXX implied that I should give them a better address. I will continue to send written correspondence to NCS as well as to the credit bureaus asking that this debt be removed since NCS has been unable and unwilling to do anything other than state that their " computer systems '' show that they are sending correspondence back to me, none of which I have received.

Consumer Complaint: I sent several certified mail in XXXX of 2017, Ive filed several complaints within the 6 months for this particular account. I havent gotten no response. Im fed up, Ive asked to prove how both XXXX and National Credit System were able to verify this account 100 accurately before placing it on my credit file as an error. By law you cant verify an account without original documents. FCRA Section 609. I repeated that Im not aware of the account several times and Ive been ignored so whats left is to take legal actions against XXXX & National Credit System. You will be contacted by my lawyer and the attorney generals office about this account. It has caused great pain and suffering to my life. I will make sure this matter is resolved within the next month.

This is incorrect and XXXX will not let me fix the problem or claim that they have " verified '' the information as correct. They send notices that : " You have previously disputed this item. Pursuant to Section 611 ( a ) ( 3 ) ( A ) of the Fair Credit Reporting Act, we will not process a duplicative dispute ... Nothing showing that are able to collect this debt, meaning that the debt was assigned to them, nor does the XXXX that they sent me include the amount owed thats being reported. They are reporting that I owe is XXXX. According to collection laws If the debt collector does not verify the debt, it is not allowed to continue collecting the debt from you nor can it sue you or list the debt on your credit report.

Consumer Complaint: My credit reports from XXXX, XXXX and XXXX all show an attempt by National Credit Systems to collect close to {$4000.00} that I do not owe. They claim that I owe the money for damages done to an apartment in which I lived in 2012. I have been disputing this debt with all three credit reporting agencies for some time ( since I first realized it was on my credit ). It is still on every single report, and is currently preventing me from renting an apartment in which to live. I have attached a letter from an apartment complex that I applied to the day before yesterday that states that it is this specific debt on my credit report that is preventing them from allowing me to lease an apartment in their community. I contacted National Credit Systems today to dispute the debt and ask them to remove it from my report. They were extremely rude, refused to offer any evidence in favor of their case, and showed no willingness to get to the bottom of my complaint, or to even remove the debt from my credit report temporarily until my complaint could be resolved. They went so far as to say that I needed to prove that I did n't owe the money in the first place. I 'm not sure how to do this, since proving a negative is a logical impossibility. Plus, asking me to, in essence, prove my innocence flies in the face of one of the most fundamental notions on which our country was founded, namely the notion that we are innocent until proven guilty. The fact that they offer no evidence whatsoever that I owe the money is very disturbing, since this item on my credit has had, and is still having, very negative repercussions for my life. In addition, the notion that anyone with my social security number could invent a debt and then proceed to report the debt as unpaid to one of the credit reporting agencies, thereby damaging my credit, my potential job opportunities, and my living situation is scary to say the least. It seems to me to be a breach of the credit reporting agencies ' fiduciary duty to consumers to report debts as owed with no proof other than the word of the entity claiming to be owed. In essence, National Credit Systems is committing extortion, and all three credit reporting agencies are knowingly complicit. National Credit Systems is attempting to force me, by actively damaging my credit, to pay them thousands of dollars before they will remove a negative item from my credit. An item for which they have no proof that I actually owe, other than that they say I owe it. When I contacted the credit reporting agencies directly to complain that I do not owe the debt, their response was that I should pay it, and then they would remove it from my credit. Moreover, none of the dispute investigations that the credit reporting agencies say they carried out can have been carried out in good faith or with due dilligance, since any thorough investigation would demand that National Credit Systems provide proof of the debt beyond a letter claiming that I owe the money. Adequate proof that I owe the money would consist of, at minimum, documentation of the debt, including, but not limited to, pictures of the damage to the apartment that they claim I damaged, and invoices detailing the dates and charges for work performed to fix the alleged damage. The credit reporting agencies should have a fiduciary duty to consumers to verify the validity of any debt they report as owed. No one should be allowed to report anything negative on anyone 's credit without first providing proof that the debt is owed, and that the person who owes the debt is actively refusing to pay. Just because some company with access to my social security number claims that I owe them money should not be enough to justify listing the debt as unpaid on my credit report. In addition, the credit reporting agencies should keep a record of, and be able to furnish to any affected consumer any proof offered on behalf of the creditor that the debt is actually owed by the consumer they claim owes the debt. Furthermore, disputed debts should be removed from all credit reports until the dispute is resolved.
