Consumer Complaint: On XXXX XXXX XXXX, I XXXX XXXX was a guarantor for my daughter XXXX XXXX XXXX attending college ) for an apartment at the University XXXX XXXX in XXXX Ms XXXX The rental agreement that we applied for and completed a notarized document was for was for 1 year lease from XXXX XXXX, XXXX XXXX, XXXX. XXXX did not move from XXXX XXXX XXXX XXXX after the first year and she extended the lease for another year immediately after for XXXX XXXX, XXXX thru XXXX. Months later, I noticed a {$2800.00} debt on both our credit reports. I have disputed the debt for several years explaining I did not renew a contract nor did I sign for another lease in my name after the first lease but National Credit System nor the Credit Bureaus removed the debt. On XXXX XXXX, XXXX, I sent a certified letter and requested a letter of authorization for the debt owed by XXXX XXXX XXXX XXXX. The documents I recieved from the National Credit Systems were inaccurate and falsified. I did not relieve the lease that we both sign but instead I was sent a lease contract dated XXXX XXXX, XXXX thru XXXX, XXXX, a period that me nor XXXX never sign for. Here are a list of inaccurate item in the contract. 1 ) The lease contract was not filled out by XXXX nor myself. It 's in someone else 's handwriting and the Guaranty Information at the top of Guaranty page was not completed by me. 2 ) The starting date on the new contract do not coincide with the date of the original lease from XXXX XXXX, XXXX to XXXX XXXX, XXXX. 3 ). The date on page XXXX of the contract was changed to XX/XX/XXXX. Why would anyone sign in XXXX, XXXX to rent an apartment in XXXX XXXX. XXXX ). The notary signed by XXXX and myself was signed XXXX XXXX, XXXX for a lease dated XXXX XXXX, XXXX XXXX, XXXX, XXXX. This notary was attached to the new lease dated XXXX XXXX, XXXX thru XXXX, XXXX XXXX. 5 ). The Residents Transaction inquiry detail show for months outside of the contract date, Also on the transaction page it showed she was a previous tenant. Where is the previous contract? 6 ). There are no transactions to show charges and amounts paid from the beginning of the original contract ( with XXXX an last months rent deposit ). XXXX ). The move in condition form was dated XXXX XXXX, XXXX. Which was the date she first moved into the apartment. I did not sign nor did I agree to attaching the original notary with my signature to a new contract nor was I informed that this would be done. After carefully looking at the XXXX XXXX XXXX contract, I recognize that the XXXX XXXX contract was completed by taking pages from the original XXXX XXXX contract and inserting pages with our signature to forge a new contract. Please investigate this matter!

Consumer Complaint: This is a complaint from XXXX XXXX against National Credit Systems for National Credit 's failure to provide requested information for the debt alleged. National Credit Systems has been reporting two open accounts on consumers credit report that client does not recognize. On XX/XX/XXXX, consumer ( through legal counsel ) responded with a written request for documentation, including the following : a. Signed copy of the original contact ( s ) ; b. Any notice ( s ) of assignment or receipt of sale of the debt alleged ; c. Any notice ( s ) of delinquency ; d. Ledgers/spreadsheets/accounting statements showing how the debt alleged was accrued ( including any fees and interest charges added to this debt ) ; e. A copy of your debt collection rights license ; f. Proof that you are licensed to collect this debt in Arizona ; and g. Any other documentation which tends to show validity. On XX/XX/XXXX, National Credit Systems responded providing only original statements with no verification that they own the debt or that it was transferred to them. Creditor 's failure to respond to a consumer 's good faith request for documentation makes it impossible for the consumer to make an informed decision regarding the debt alleged. This is a violation of USC 1692, and other federal acts which require lenders and debt collectors to act in good faith and refrain from unfair deceptive or abusive acts.

Consumer Complaint: This is in response to a previous compliant, which was not resolved and marked CLOSED. SInce I was not able to reopen the CLOSED complaint, I am creating a new one. The previous compliant # was XXXX. MY COMPLAINT I am writing this letter in response to the letter received from National Credit Systems , Inc. on XX/XX/XXXX. In the letter the debt collector has mentioned that I owe {$820.00} to the XXXX XXXX in XXXX, IL. On XX/XX/XXXX, I sent out a debt validation letter to the mentioned company asking for the following documentations 1. Agreement with the creditor that authorizes you to collect on this alleged debt. 2. The agreement bearing my signature stating that I have agreed to assume the debt. 3. Valid copies of the debt agreement stating the amount of the debt and interest charges. 4. Documentation containing the creditors signature and my signature indicating a routine inspection of the apartment unit was completed in presence of both the parties. 5. Documentation showing the validity and necessity of the charges that were applied on my account. 6. Proof that the Statute of Limitations has not expired. 7. Complete payment history on this account along with an accounting of all additional charges being assessed. 8. Show me that you are licensed to collect in my state ; and 9. Your license numbers and Registered Agent National Credit Systems , Inc. has failed to respond to my letter with all the necessary proper documentation. They sent me few documents such as the lease agreement between the XXXX XXXX and myself, Invoices and Move-In/Move-Out Inspection document. Over here I would like to mention the XXXX XXXX in XXXX is charging me for the replacement of the carpet for the entire unit, which I rented and stayed for 1 year. I have mentioned in a letter to National Credit Systems , Inc. dated XX/XX/XXXX, that the charges that XXXX XXXX has made is unethical and does not comply with the lease that XXXX XXXX and myself have signed before moving into the apartment. After moving out of the XXXX XXXX, I had exchanged emails with the authorities at XXXX XXXX and they have shared several pictures of the carpet. I would like to raise few points over here, based on the email communication between XXXX XXXX and myself and the lease document, invoices and inspection document received from National Credit Systems , Inc. 1. Pictures of the carpet with no stain The pictures of the carpet provided by the XXXX XXXX, shows there were no stain or mark in the carpet for which the entire carpet need to be replaced. A regular vacuum or a steam vacuum would have cleaned the carpet and made it look new. I want a proper justification on why the entire carpet was replaced when it was not at all necessary. Replacing the entire carpet, when that is not needed, and charging the amount back to the previous renter is an unethical practice, which need to be dealt with properly. 2. Carpet life The life these kind of carpets are usually 5~6 years. It can be seen in the email from XXXX XXXX that the carpet was replaced just prior to my move to the unit. Based on that, the carpet had about 4~5 years of life left on it. Also going by the pictures taken by XXXX XXXX representatives, the carpet is in a pretty good condition which does not require a full replacement. This also indicates unethical practices conducted by the XXXX XXXX. 3. Inspection was not done in front of me, no signature Based on the documents provided by National Credit Systems Inc. there is a Move-In/Move-Out report which needs to be signed by both the parties to accept the damages done to the unit, which requires replacement or cleaning. It can be seen from the document that my signature was not present in the document. The Move-out inspection was not done in front of me. XXXX XXXX never invited me for a joint inspection. A joint inspection is an absolute necessary in this matter, because we will never be able to find out any intentional damage done by XXXX XXXX to get the replacement cost from me. 4. Normal wear and tear Based on the City of XXXX renters lease guidelines, a normal wear and tear that happens due to living in the unit during the lease tenure is acceptable. Over here from the pictures that were given to us by XXXX XXXX, we could not see any damage on the carpet apart from normal wear and tear that can happen while staying in the unit. I am sending this letter to raise unethical practices conducted by the XXXX XXXX in XXXX. I also demand if either XXXX XXXX, XXXX or National Credit Systems , Inc. are not able to clarify my concern, the debt amount be removed from my credit file in all 3 credit bureaus immediately. For any other concern or question, please reach me at XXXX XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, AL XXXX COMPANY 'S RESPONSE ( NCS ) This is National Credit Systems , Inc. ( NCS ) response to the complaint filed with your office by XXXX XXXX I would like to point out that National Credit Systems , Inc. is only a third-party debt collection agency that is collecting a debt on behalf of XXXX XXXX. XXXX XXXX is disputing this debt because of the charges accessed to him by XXXX XXXX. These charges were not accessed by NCS. XXXX XXXX 's dispute is with XXXX XXXX. That is the original creditor who owns this debt and placed it with NCS for collections. Obviously he and XXXX XXXX do not agree with each other. Since there is an on-going dispute between XXXX XXXX and XXXX NCS will cease our collection activity until the dispute can be resolved. I hope that the above response will provide your office with the information you are seeking. Please contact us with any additional questions MY COMPLAINTS WHICH NEED TO BE ADDRESSED IMMEDIATELY - This issue is not resolved and I can not deemed it to be CLOSED. The company National Credit Systems ( NCS ) has indicated in their comment that, there is an ongoing dispute between the XXXX XXXX and myself. They have also indicated that NCS is just a collection agency and they will cease any attempt to collect the debt until the dispute between XXXX XXXX and myself is resolved. Going by their response, I have following concerns - 1 ) NCS has no right to put the collection on my credit file with 3 credit bureaus. I want NCS to immediately remove those collection from my credit file with 3 credit bureaus. 2 ) I want NCS to issue a written letter to address, they have cease all attempts to recover the debt unless the dispute is resolved. Also they need to issue a written letter that all the collections will be removed from my credit file with immediate effect. I want them to issue a hard letter and mail it to my address. 3 ) I want punitive damages from NCS. Without investigating the validation of the debt NCS has put up this collection on my credit file. That has cause significant damages to my credit history. Which in turn has increased my APR for Auto loans and Credit Card. I will only consider this case to be CLOSED after the above 3 issues are resolved.

Consumer Complaint: XXXX- XXXX 2017, I sent multiple letters and contacted the collection agency via phone to inquire about a debt that appeared on my credit report. I have asked them to validate the debt, documentation showing where I signed paperwork from the original creditor. They could not validate debt or have proof where I owed the debt. In turn, they sent fraud paperwork to my address to complete. It is unnecessary for me to complete such paperwork when the debt is not mine. I would like to be provided validation or contract from this company for said debt! I do not have a contract with this company also this company does not have an active license to collect debt in AL state

Consumer Complaint: XX/XX/XXXX2017 An amount of {$710.00} was reported to my credit. When i inquired it said it was from XXXX XXXX. This was my old apartment and i had moved out according to my lease but, I have no idea what this bill is for. I called them and asked to speak to the manager but they said they are having change in management. How is this even fair for someone who never received the bill? Also, they are not willing to work with me. I have no idea what I am being charged for. This company is making fraudulent claims on my account because they did n't send me any bill and I have no idea about these charges.

Consumer Complaint: Recieved call from a collection company regarding an amount owed to previous landlord for back rent following moving out of our apartment. The apartment claimed we did not give adequate notice of vacating. We were told by the apartment complex that we would receive a written notice of amount due following move out. This written notice was never received. We requested a written statement from the collection company and received it after 2 requests. After receiving written statement with amount due, we reached out to the collection company regarding payments to resolve the amount. Spoke with a gentleman who informed me that making a payment and continuing to pay each month would prevent the amount from being placed on our credit reports as a collection account. Following that conversation, I immediately went online and made a payment. I then called and informed the representative that I had made the payment. I did this to be certain that I was following the correct procedures to protect our credit and resolve the debt and was assured that I was. Within one week of making the payment, the company hit both mine and my wifes credit with a collection account, which was extremely detrimental to our score. I then spoke with the representative at the collection agency again, letting him know that a collection account was placed on our credit, and he informed me that he would be speaking with his manager to get it resolved and removed and would be calling me back that afternoon. I never received that callback. After two weeks, the representative did call back. He was oblivious to the conversation wed had prior regarding the collection account. He assured me AGAIN that he would reach out to his manager and have him speak with me directly. I have yet to receive a call back, and can not get in touch with the manager despite repeated attempts.
