Consumer Complaint: On XX/XX/23, I made a payment in the amount of {$250.00} to XXXX XXXX. I checked my M & T checking account ending in XXXX and I noticed a possible duplicate payment to XXXX. I contacted XXXX first to confirm if they had received two payments on the amount of {$250.00} each. The company confirmed that the had only received one {$250.00} payment. I called M & T Custoner Service # XXXX on XX/XX/23 to open a complain # XXXX. They indicated that I would get a letter mailed to me within a week, and that they would investigate the issue. No letter was sent so I called back on XXXX and had to explain again the fact that M & T had taken out of my checking account and additional amount of {$250.00}. I also told them I had not received any letter as I was told, and this new representative told me that they had not even started the investigation. I also opened Dispute # XXXX, and mentioned that I had also noticed that my Overdraft Line of Credit ending in XXXX had made a transfer in the amount of {$230.00}. On XX/XX/23, I went to the XXXX XXXX branch and spoke to the Manager who was very proffesional and apologized i had experienced that issue. She stated that she had the ability to return the {$250.00}, which was completed on XX/XX/23. She explain that she was unable to refund the money in the Overdraft Line of Credit. On XX/XX/23 I paid a total of {$230.00} which included {$1.00} in interest to cover for the Overdraft caused by the additional money that was deducted from my account. If the extra withdrawal would have not been taken out, my account would have not overdrawn. It is XX/XX/23 and I have received no letter. I call the branch again to see what they can do and they told me the complain or dispute was closed out. I am assuming because M & T thinks that by refunding the {$250.00} I would be satisfied. If M & T would have contacted me as they said they would, they would have known thay they still need to refund me for the {$230.00} payment I did against my overdraft line of credit.

My brother XXXX XXXX XXXX XXXX XXXX has a checking account ( XXXX ) with M & T Bank under his name and his business ( XXXX, XXXX, XXXX ). He passed on XX/XX/XXXX and I have been responsible for settling his business affairs. I initially contacted the bank on XX/XX/XXXX to find out what paperwork they required to disburse funds in his account to his successor which is not me. I have been in contact with the Banks Branch Manager, XXXX XXXX, at least a dozen times since my initial contact on XX/XX/XXXX and XX/XX/XXXX, and still can not obtain an update on the status of the review because the legal department has not been forthcoming or transparent in communicating to the Branch Manager the status of the review or the required steps to disburse the funds. According to XXXX XXXX, the legal department needed to establish that my brother had 100 % ownership in the business which makes sense. Therefore, I sent the articles of organization for the LLC and a letter from the Department of Treasury, Internal Revenue Service, both of which are attached for your review, and which show that he is the sole member of the LLC. I also submitted his death certificate, a copy of his XXXX individual tax returns that he filed under the business name and a Collection of Personal Property by Affidavit Pursuant to 15-12-1201, C.R.S, all of which are attached. The basis of the complaint is two-fold : 1 ) the banks legal department has not been forthcoming or transparent about the status of the review. In fact, when I contacted the liaison with the legal department ( XXXX XXXX ) most recently on Wednesday, XX/XX/XXXX, after checking the status of the review, she conveyed to me that the legal department withdraw my request. According to her, she sent an email to the legal department to request clarification on what withdrawal meant and as of Friday, XX/XX/XXXX, XXXX days after submitted the documents to close his banking account and disburse the funds to his successor, I have not received any clarification or communication from the Banks legal department on the status of the review. 2 ) the funds remain on deposit in the bank in my brothers account, which based on conversations with my brother before he passed may be as much as {$50000.00}, without any clear communication from the legal department about the status of the review and the steps necessary to disburse the funds to his successor. For additional context, my brother was living with our mother and working remote after he lived in the New York area where he opened the account. I understand that you can not compel the bank to close the account or disburse the funds. However, my objective is to receive a status update on my efforts to close the account and disburse the funds. The legal department has been less than transparent and uncommunicative in terms of the status and what if any additional paperwork is required.

Consumer Complaint: On XX/XX/2023 at approx XXXX XXXX I recieved an Email from what appeared to be XXXX XXXX. My wife and I had been trying a 30 day trial and had decided to try a one year subscription to XXXX. The Email stated the 30 day trial was about to expire. On this XXXX web site screen was a phone number to call XXXX to purchase and activate a one year subscription. After calling the number what appeared to be an XXXX employee stated he would help to activate the new subscription. I used my M & T bank credit card to attempt to purchase the subscription. The fraudster then asked me if I had sent money to anyone in California, Louisiana, and Texas. I stated I had not and immediately opened my electronic M & T Bank accounts to examine what he was talking about. As soon as I opened the XXXX account I observed a name XXXX XXXX typed in the send money spot of the XXXX screen. As soon as I read this my account was activated to send {$990.00}, and {$1400.00} to this false name. Whoever this was had control of my XXXX. I did not type anyones name or authorize anyone to send this money to XXXX XXXX.

Secion2 also states that a consumer reporting agency can not furnish my account without written instructions. 15 U.S.C. 1666B : A creditor may not treat a payment on credit account under an open-end consumer credit plan as a late as late for any purpose. Remove the late payment and update the account immediately as you are in violation of several laws under the Fair Credit Reporting Act.

Consumer Complaint: I reached out to M & T early XXXX of XXXX due to them providing personal information to 3rd party Companys, XXXX XXXX, XXXX, and XXXX providing false late payment information and account information. They are in direct violation of the Privacy act of 1974. This information provided is negatively affecting my credit report I have disputed this with the credit bureaus for accuracy of reporting as well. This company is in direct violation of 15 U.SC 6802 & 16 CFR 313.1 and U.S.C 1681 ( b ) No opt out notices were giving in regard to summiting non accurate information. They are also in violation of the security act of 1974. The privacy notice is attached which states they would not share 3rd party information, nor would they share with any non-affiliates.
